The Practice – First Degree

  • Talking about the last case – the juror who spoke to Lindsay. Eleanor and Lindsay potentially getting disbarred.
  • Bobby- you can state it to a medical certainty that it wasn’t suicide. Doctor – have you had other patients that did commit suicide? More than 10 patients – of those suicides was there an occasion were the suicide surprised me – yes. It does happen. With no apparent suicide. Argumentative and badgering. Let’s just have a nice civil murder trial. Affair and his wife upset him. Is it possible – his wife of 12 years? He was more enraged then depressed. I don’t think he committed suicide. Suicide would represent your failure. There was no way he would take drugs.
  • I can see it in the eyes of the jury – we are going down.
  • They were honest – you never made a mistake. Bobby talking to the judge.
  • Eleanor at the office – we are still suspended?
  • This is awkward Jimmy – this guy used to be a PI. Eugene – you are black – John says – we aren’t talking about a bummed knee. Racism is a disease for a disability pay. Am I proud of that that I am racist and that I draw my gun with a black suspect? I got fired for telling the truth. I never used to have these tendencies and this job has done this to me.

  • Is there any possible way that Mary Jane did it?
  • Defence law don’t offer a point that you can’t prove. (Plan B) – Let’s blame someone else.
  • Bobby goes to talk to the judge to get Eleanor and Lindsay off.
  • Judge – I had a client that raped and killed 3 children. She knew he was guilty she released the person on technical grounds. 2 weeks later he killed again. The lawyer cried for a week, and I suspect the judge did too.
  • I’m suggesting that doing things by the book don’t always work. The judge - We take an oath to this judicial process. Technically right – they were both wrong, but that is a much greater injustice to disbar them.
  • Jimmy – Rebecca – Racism is a handicap. I’m sure that he’s legit. Jimmy and Lindsay talk about a dream that he had.
  • He died by grounding up poison and putting it in wine?
  • Back to court – the wife testifies. You are about to inherit 3.7 million, but under the pre-nup you were only going to get 400,000. You were at the movies when he died.
  • Question – why are they being tried at the same time – isn’t that a conflict?
  • If that is the lesson learned on the streets then the Boston Police Dept has a serious problem.

  • An idea can be held – I take issue that other cops feel this way. Job related diagnosable problem that is the main issue.

  • I’m entitled. This is unfair surprise. He has the right to question and you have the right to re-direct. Bobby is going to go after the wife. He does not represent the wife. Divorce was not in your best interest. Did you go back to your husband and say that you wanted to get together. I couldn’t bear hurting him. Are you telling this court that you told him that it was over? You didn’t want to hurt your husband. He wouldn’t take you back and you killed him. She poisoned her husband.
  • We are facing a double conviction. I had to turn against her. What I did in there was desperate.
  • Back to the cop case – Post traumatic stress disorder. Even if racism was a disorder. This hearing wasn’t about blame. If he shot himself in the foot he would still get disability. Racism is a cancer. The idea that his idea that he killed a black man, there can’t be anything more hateful than keeping him on the streets.
  • As bigots go you are one of the better ones, but we are not
  • Interesting move- ambush the council. Things don’t happen in a vacuum. But if others take direction from you. If Eleanor and Lindsay it mitigates their defence. They will get probation. I have a client and a duty. What you did was disgraceful. You walk in with your reputation. I’ll be less likely to trust you. Who would want to have co-counsel? I’m the guy with the guy’s life in my hands. Judge is speaking to him – Jerald Braun – he was morally correct – he fought the good fight. In victory you are despised. Pulling this stunt. If you lose your integrity in that room but you would lose it all.
  • They find the wife – Mary Jane guilty and he gets off.
  • The guy says I’m glad I got acquitted, maybe you convinced them – she went to jail for murder. You two were with him – you are lucky you both didn’t go down. Maybe she didn’t do it. He had to be carried to the bath tub. There was nothing introduced about carpet fibres. I never gave you the investigative reports. All I’m telling you Mary Jane didn’t kill him. I know that she didn’t do it. Ethically and legally what is bobby to do?
