Recommendation:
  1. That approval be given to enter into Agreements with organizations producing major festivals/events in accordance with the terms and conditions outlined in Attachments 1-7.
  2. That these Agreements be acceptable in form to Corporate Services (Law Branch) and in content to the General Manager of Community Services.

Report Summary

  • The City of Edmonton wishes to enter into Agreements with each of the organizations listed in the attachments to allow them to stage their festival/event in the City of Edmonton. These organizations all require the use of civic services and City owned property to stage their annual festival /event.

Report

  • The organizations described in attachments 1-6 are all hosting annual events and have received a Community Investment Grant in support of their endeavours.
  • Attachment 7 describes the terms and conditions for a 24 Hour Relay, as produced by the Easter Seals Ability Council. This event differs from the other six agreements in that there is no City grant involved, only the use of City property. This event has previously been held in the City of St. Albert and is a new event for Coronation Park.

Justification of Recommendation

  • These Agreements will serve to clarify the obligations and responsibilities of each party respective to their festival or event.

Terms and Conditions

  1. Organizations will be responsible for payment of damages to City of Edmonton property resulting from their occupancy of the licensed lands.
  1. Any liability claims that arise from the staging of an event will be the sole responsibility of the organization producing the event.
  1. The festival organizations will be responsible for the payment of costs associated with the provision of identified civic services required to stage the event.
  1. The organizations are to maintain in full force and effect comprehensive, general public liability insurance of not less than one million dollars.
  1. Festival dates are:

The Works International Visual Arts Society -The Works Festival:June 19-July 1, 1998

Jazz City Festival Society -Jazz City Festival:June 19-June 28, 1998

Agreement will cover period from June 19 to July 2, 1998.

  1. Licensed areas will include:

A)Sir Winston Churchill Square

B)99 Street between 102 and 102A Avenues

C)Various downtown sidewalks (as approved by Transportation and Streets Department)

7.License rate will be $1.00

*Because these festivals occur concurrently in Sir Winston Churchill Square, the Works International Visual Arts Society and the Jazz City Festival Society enter into a single agreement.

  1. Organizations will be responsible for payment of damages to City of Edmonton property resulting from their occupancy of the licensed lands.
  1. Any liability claims that arise from the staging of an event will be the sole responsibility of the organization producing the event.
  1. The festival organizations will be responsible for the payment of costs associated with the provision of identified civic services required to stage the event.
  1. The organizations are to maintain in full force and effect comprehensive, general public liability insurance of not less than one million dollars.
  1. Festival dates are July 10-19, 1998*:

Agreement will cover period from July 8 - 18, 1998.

  1. Licensed areas will include:

A)Sir Winston Churchill Square

B)99 Street between 102 and 102A Avenues

C)Various downtown sidewalks (as approved by Transportation and Streets Department)

7.License rate will be $1.00

*Overlap for four days with the Edmonton Klondike Days Association (July 16, 17, 18, 19, 1998). Each organization will produce some programming on Churchill Square during these three days as detailed in the Agreement. No programming will be done on July 19 in Churchill Square by the Street Performers Festival.

D)Parkland located between 85 and 86 Avenues east of 104 Street east to the alley

E)85 Avenue from 104 Street east to the alley

F)Alley between 103 and 104 Streets running from 84 Avenue to 83 Avenue

G)84 Avenue from 104 Street east to the alley

7.Fringe Theatre Adventures will be permitted to use Lots J and K as described in point 6C above, as a controlled parking lot during the Fringe Festival. The organization will be granted permission to use the land at a rate that is less than fair market value from August 11-26, 1998.

  1. The Easter Seals Ability Council will be responsible for payment of damages to City of Edmonton property resulting from their occupancy of the licensed lands.
  1. Any liability claims that arise from the staging of an event will be the sole responsibility of the Easter Seals Ability Council.
  1. The Easter Seals Ability Council will be responsible for the payment of costs associated with the provision of identified civic services required to stage the event.
  1. The Easter Seals Ability Council is to maintain in full force and effect comprehensive, general public liability insurance of not less than one million dollars.
  1. Event dates are June 13 and 14, 1998:

Agreement will cover period from June 12-14, 1998.

  1. Licensed areas will include Coronation Park and various roadways and sidewalks as approved by the Transportation and Streets Department.
  2. Liquor service will be permitted in a designated area of the Park from 12:00 to 10:00 p.m. (consumption until 11:00 p.m.) on June 13, 1998
