TENANCY AGREEMENT

AN AGREEMENT made on the ______of ______(20 ______)

BETWEEN

______NRIC / Passport No. ______of ______(hereinafter called "the Landlord") which expression shall where the context so admits include the person entitled for the time being to the reversion immediately expectant on the term hereby created) of the one part

AND

______NRIC / Passport No. ______of ______(hereinafter called "the Tenant") which expression shall where the context so admits include the Tenant's successors and assigns) of the other part.

NOW IT IS HEREBY AGREED as follows:

1. The Landlord agrees to let and the Tenant agrees to take all that property known as ______(hereinafter called "the said premises") together with the furniture, fixtures and fittings and household effects now in the schedule hereto (hereinafter collectively called “the effects”) TO HOLD unto the Tenant from ______for a term of _____ ( ____ ) years, at the rent of SINGAPORE DOLLARS ______

______(S$______) per month.

The first payment of rent is payable on the signing of this Agreement and subsequent payment of rent is payable monthly in advance without deduction whatsoever on the ______day of each month to Bank Account :______.

2. The Tenant(s) hereby agree(s) with the Landlord as follows:

(a)  To pay the said rent at the times and in manner aforesaid without deduction whatsoever.

(b)  To pay a deposit of SINGAPORE DOLLARS ______

______(S$ ______) being equal to ______( _____ ) months rent upon the signing of this Agreement (the receipt whereof the Landlord hereby acknowledges) as security against the breach of any term or condition of this Agreement, such deposit to be refunded (free of interest) within fourteen (14) days after the expiry or lawful termination of this tenancy. This deposit shall not be utilised as set-off for any rent due and payable during the currency of this Agreement.

(c)  To pay all charges due in respect of any telephones, cable television or other equipment installed at the said premises, including any tax payable thereon.

(d)  To pay all charges for the supply of water, electricity, gas and any water borne sewerage system, any such installations installed or used at the said premises, including any tax payable thereon.

(e)  To be responsible for all minor repairs and replacement of parts and other expendable items at its own expense up to Singapore Dollars ______

______(S$ ) per item. Such expenditure in excess the said amount per item shall be borne by the Landlord.

(f)  To keep the air-conditioning units installed at and for the said premises in good and tenantable repair and condition which air-conditioning units are to be serviced and maintained at least once every three (3) months at the expense of the Tenant by a reliable air-conditioning contractor, a copy of the service contract to be forwarded to the Landlord.

(g)  During the tenancy not to remove from the premises any of the effects in their present state of repair and condition (reasonable wear and tear and damage by accidental fire excepted) save where the insurance moneys are rendered irrecoverable in consequence of the act or default of the Tenant who in such an event shall replace the damaged or destroyed articles with similar articles of at least equal value or if the Landlord so requires, pay to the Landlord the value of any part of the effects which may be destroyed or so damaged by accidental fire.

(h)  Not to make or permit or suffer to be made any alterations or addition (structural or otherwise) to the premises or any part thereof without first obtaining the written consent of the Landlord.

(i)  Not to assign sublet or part with the possession of the premises or any part thereof.

(j)  Not to do or permit or be done anything whereby the policy or policies of insurance on the premises against damage by fire may become void or voidable or whereby the premium thereon may be increased and to repay the Landlord all expenses incurred by him if brought about by any breach or non-observance of this clause.

(k)  To permit the Landlord and his agents at all reasonable times to enter upon and examine the condition of the premises and to enter with such workmen and appliances as may be necessary to execute repair on the premises.

(l)  At the expiration of the term hereby created to peaceably and quietly deliver up to the Landlord the premises together with all the fixtures and fittings in like condition as the same were delivered to the Tenant(s) at the commencement of the term hereby created authorised alterations or additions and damaged by fair wear and tear.

(m)  During four (4) weeks immediately preceding the expiration of the tenancy herein to permit the Landlord or its representative at all reasonable times and by prior appointment to bring interested parties to view the said premises for the purpose of letting or purchasing the said property.

(n)  To keep the interior of the said premises and all additions thereto including the flooring and interior plaster or other surface material or rendering on walls and ceilings and the Landlord’s furniture, fixtures and fittings therein including doors, windows, all shutters, locks, white-washing, colour-washing and decoration thereof in good and tenantable repair and condition during the tenancy (fair wear and tear excepted).

(o)  To use the premises for residential purposes only and not to use the premises in any manner that runs contrary to HDB rules and regulations or any other laws in force ant any time.

(p) To keep the Landlord fully indemnified against all claims or damages that may be incurred by him resulting from the setting of the premises to the Tenant as from any breach by the Tenant or its agents, servants or employees of the term & condition herein.

(q)  The Landlord shall write to the appropriate authorities or Tenant’s employer for information relating to the Tenant’s particulars or employment status. The Tenant shall produce all original copies of necessary documents such as Passport, NRIC etc. to the Landlord for examination and a copy each of all these documents shall be given to the Landlord. The Tenant shall inform the Landlord of any new particular’s change, such as change of employer or jobs etc. The Tenant shall ensure that at all time, there will be no illegal migrants staying in the said premises. Should this be happened, the Tenant shall be solely and fully responsible for any consequences.

(r)  The following shall be the registered occupiers to the premises :-

3. The Landlord hereby agrees with the Tenant(s) as follows:

(a)  The Landlord undertakes that he has obtained the requisite approval from the Housing Development Board for the tenancy herein, failing which this tenancy agreement shall be deemed terminated and the Landlord shall compensate the Tenant for all the loss suffered and all expense incurred as a result of the termination of this Agreement.

(b)  To pay all rates, taxes, assessments and outgoings in respect of the premises.

(c)  The Tenant(s) paying the rent of the premises and effects hereby reserved and observing the agreements, conditions and stipulation on his/their part herein contained shall peaceably hold and enjoy the premises and effects during the tenancy without any interruption by the Landlord or any person lawfully claiming under or in trust for him/them.

(d)  To insure the said premises against loss or damage by fire and to pay all premium thereon

4. Provided always and it is expressly agreed as follows:

(a)  If the rent hereby reserved or any part thereof shall at any time be unpaid for 7 days after becoming payable (whether formally demanded or not) or if any conditions or stipulations herein contained on the Tenant’s part to be performed or observed are not performed or observed or if the Tenant or any other person in whom for the time being the tenancy shall be vested shall become bankrupt or enter into any composition with the Tenant’s creditors or suffer any distress or execution to be levied on the Tenant’s goods or if the Tenant being a company shall go into liquidation whether voluntary (save for the purpose of amalgamation or reconstruction) or compulsorily then and in any of the said cases it shall be lawful for the Landlord at any time thereafter to re-enter upon the said premises or any part thereof in the name of the whole and thereupon this tenancy shall absolutely determine and the said deposit under clause 2 (b) shall be absolutely forfeited by the Landlord but without prejudice to the right of action of the Landlord in respect of any breach of covenant or other terms of this tenancy (including the breach in respect of which the re-entry is made).

(b)  If the premises and effects or any part thereof shall at any time during the tenancy be destroyed or damaged by fire, lighting, riot, explosion or any other inevitable cause so as to become unfit for habitation and use the rent of the premises and the effects hereby reserved or a fair proportion thereof according to the nature and extent of the damage sustained shall be suspended until the premises shall again be rendered fit for habitation less the such destruction or damage is caused by the Tenant, its agents, servants or employees, invitees or licencees.

(c)  Notwithstanding the provisions of the preceding sub-clause the Landlord may, in the event of the premises being destroyed or damaged as mentioned in the said sub-clause be at liberty by notice in writing to determine the tenancy hereby created upon such notice being given to the Tenant(s) the tenancy hereby created shall absolutely cease and determine but without prejudice to any right of action which the Landlord may have against the Tenant(s) in respect of any antecedent breach of the Agreement by the Tenant(s).

(d)  Diplomatic Clause (for Non Singaporean/PR tenants)

i) Notwithstanding anything herein before contained the said term of months from ______to ______at any time after the expiration of the first ______( ) months of the said term be determined on documentary evidence that the immediate occupant, or such other employee of the tenant who may from time to time be in occupation of the said premises has ceased or about to cease to be employed in Singapore or is to be posted out of Singapore permanently during the said term and the Tenant gives to the Landlord ______( ) calendar months’ notice in writing of this intention to determine the tenancy or ______( ) months’ rent and hiring in lieu of such notice.

ii)  If this Agreement should be lawfully terminated by notice in writing by the Tenant before the expiry of the tenancy herein as aforesaid, the Tenant shall refund to the Landlord, pro-rata, the commission of Singapore Dollars ______

______(S$______), paid by the Landlord to his real estate agent (the “Estate Agent”) ______Licence No. ______of ______.

The Landlord shall be entitled to deduct such refund from the deposit held by the Landlord.

(e)  If the Tenant terminates this tenancy agreement prematurely not due to Clause 4(d) or if the Tenant fails to pay the monthly rental punctually or breaches any other term or condition of this tenancy, then the said deposit under clause 2 (b) shall be absolutely forfeited by the innocent party but without prejudice to the right of action of the innocent party in respect of any breach of covenant or other term of this tenancy (including the breach in respect of which the deposit is forfeited). However, if the Landlord terminate this tenancy agreement prematurely, the Landlord shall compensate the Tenant one month gross rental apart from refunding the security deposit held in clause 2 (b).

(f)  Any notice under this lease shall be in writing and any notice to the Tenant shall be sufficiently served if left addressed to the Tenant(s) at the said premises or sent by registered post to the Tenant’s last known address in Singapore and any notice to the Landlord shall be sufficiently served to the Landlord or Landlord’s Agent by registered post to the Landlord’s last known address.

(g)  The Tenant shall bear the stamp fees for stamping this Agreement and such payment shall be paid on the date of signing of this Agreement. The Landlord shall reserve the right to refuse handover of the premises to Tenant should the stamp certificate is not produced earlier or latest by handover date

(h)  This Agreement shall be subject to the laws of the Republic of Singapore and the parties herein submit themselves to the jurisdiction of the Singapore Courts.
