REGULAR SESSION

April 22, 2014

The Lyman County Commissioners met in regular session in the Conference Room in the Courthouse at Kennebec, South Dakota, April 22, 2014, at 8:30 a.m. with the following members present: Chairman Kim Halverson, Leroy Choal, Ryan Huffman, Steve Perry and Auditor Pam Michalek. Absent: Adam Ehlers.

CALL TO ORDER:

Chairman Halverson called the meeting to order with the pledge to the flag.

APPROVE MINUTES:

Motion by Huffman, seconded by Choal to approve the minutes of March 18, 2014. All voting aye.

CLERK OF COURTS FEES:

Motion by Perry, seconded by Huffman to approve the Clerk of Courts fee report for March 2014 in the amount of $9,979.03 less $5,482.49 forwarded to Lyman School District and $34.01 to Chamberlain School District. All voting aye.

COMBINED ELECTION AGREEMENT:

Motion by Choal, seconded by Huffman to approve a combined election agreement with the Chamberlain School District for the 2014 Primary Election, June 3rd. All voting aye. The agreement is on file in the Auditor’s Office.

APPROVE BUILDING PERMIT:

Motion by Choal, seconded by Perry to approve a building permit submitted by Mueller Lumber Company (David & Brenda Reis, 33538 252nd St, Oacoma SD) for two additions to current residence. All voting aye.

APPROVE PLAT:

Motion by Huffman, seconded by Perry to approve a plat, submitted by SD Wheat Growers of Lot 1 South Dakota Wheat Growers Addition in the W½ of the NE¼ and in the W½ of the SE¼ of Section 20, Township 105 North, Range 74 West of the 5th P.M., Lyman County, South Dakota. All voting aye. South Region Operation Manager Jeff Tiede and Kennebec Elevator Manager Todd Longville were present to address any questions the Commission may have.

LIQUOR LICENSE HEARING:

Motion by Perry, seconded by Choal to approve the following Special Event Liquor & Malt Beverage License. All voting aye.

Supt. Tim Long informed the Commission that the Hwy. Dept. is continuing culvert replacements and they have also done some tree removal with the help of West Central Electric staff. The plan, weather permitting, is to mag water CO RD 22 west of Presho May 7th. Supt. Long reported on equipment repairs and various departmental issues. The County will receive a $7,000.00 weed grant from the National Grasslands. Capital Industries will provide a demonstration of a sod mulcher April 30 or May 1, 2014.

RURAL ATTORNEY RECRUITMENT PROGRAM:

Attorney Herb Sundall, SD Bar Association Strategic Plan Coordinator Francey Foral, UJS Representatives Szanne Kappas and Wayne Venhuizen and Rural Attorney Recruit Amy Jo Janssen met with the Commission to discuss the Rural Attorney Recruitment Program. The bill passed by the Legislature only runs for five years and is limited to participation by 16 counties of which Lyman County qualifies. Realizing that rural attorneys contribute in many ways to the county and the communities within the county, motion by Choal, seconded by Perry to participate in the program. All voting aye.

CHAIRMAN HALVERSON ADJOURNED THE BOARD OF COUNTY COMMISSIONERS AND CONVENED THE LYMAN COUNTY BOARD OF EQUALIZATION

10:30 a.m. Motion by Perry, seconded by Choal to take no action on Appeal #1) Mark Kenzy, Record #18, which was the recommendation of the Local Board and Director Sundall. All voting aye. The County uses highest and best use based on productivity and soil survey provided by SDSU, not actual land usage.

Appeal #2) No action taken as per SDCL 10-11-23. The appeal was not received or postmarked by the 1st Tuesday in April.

There being no further equalization business CHAIRMAN HALVERSON ADJOURNED THE BOARD OF EQUALIZATION AND RECOVENED THE BOARD OF COUNTY COMMISSIONERS.
