RELEASE AND WAIVER OF LIABILITY FOR MINORS

KARATE MINISTRY, Broadneck EP Church

PLEASE READ CAREFULLY: THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS !

This Release and Waiver of Liability (the ‘Release’) executed on this ______day of ______, 200__, by______, a minor child (the ’volunteer/participant’) ______, the parent having legal custody and/or the legal guardian of the volunteer/participant (the ’guardian’) in favor of Broadneck Evangelical Presbyterian Church, (‘BEP’), a non profit corporation.

The Volunteer/Participant and Guardian desire that the Volunteer/Participant engage in the Karate Ministry related to the Broadneck Evangelical Presbyterian Church understanding that the Karate Ministry may include all activities associated with training in karate by the Ministry Director of Karate at Broadneck Evangelical Presbyterian Church.

The Volunteer/Participant and Guardian do hereby freely voluntarily, and without duress execute this Release and Hold Harmless Broadneck EP Church under the following terms.

Release and Waiver: The Volunteer/Participant and Guardian do hereby release and forever discharge and hold harmless BEP and it’s successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or equity, which arise or may hereafter arise from Volunteer/Participant’s Activities with the Karate Ministry at BEP.

Volunteer/Participant and Guardian understand that this Release discharges BEP from any liability or claim that the Volunteer/Participant or Guardian may have against BEP with respect to any bodily injury, personal injury, illness, death or property damage that may result from Volunteer/Participant’s Activities with BEP and/or the Karate Ministry of BEP whether caused by the negligence of BEP or it’s officers, directors, employees, agents or otherwise. Volunteer/Participant and Guardian also understand that BEP does not assume any responsibility for or obligation to provide financial assistance or other assistance, but not limited to medical, health, or disability insurance in the event of injury or illness.

Medical Treatment: Volunteer/Participant and Guardian do hereby release and forever discharge BEP from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Volunteer/Participant’s Activities with BEP Karate Ministry or with the decision by any representative or agent of BEP Karate Ministry to exercise the power to consent to medical or dental treatment as such power may be granted and authorized in the Parental Authorization for Treatment of a Minor Child.

Assumption of the Risk: The Volunteer/Participant and Guardian understand that the Activities may include training that may be hazardous to the Volunteer/Participant including, but not limited to all activities involved in training for the Karate Ministry.

Volunteer/Participant and Guardian hereby expressly and specifically assume the risk of injury or harm in the Activities related to the Karate Ministry and release BEP from all liability for injury, illness, death or property damage resulting from this Activity.

Insurance: The Volunteer/Participant and Guardian understand that, except as otherwise agreed to by BEP in writing, BEP does not carry or maintain health, medical or disability insurance coverage for any Volunteer/Participant.

Each Volunteer/Participant is expected to provide proof of medical or health insurance coverage as well as provide a copy of health insurance card and a signed release to consent to medical treatment in the event a parent/guardian cannot be reached.

Photographic Release: Volunteer/Participant and Guardian do hereby grant and convey unto BEP all rights, title and interest in any and all photographic images and video or audio recordings made by BEP during the Volunteer/Participant’s Activities with BEP and/or the Karate Ministry of BEP, including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.

Other: Volunteer/Participant and Guardian expressly agree that the Release is intended to be as broad and inclusive as permitted by the laws of the State of Maryland and that this Release shall be governed by and interpreted in accordance with the laws of the State of Maryland. Volunteer/Participant agrees that in the event that any clause or provision of the Release shall beheld to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
