IMPORTANT NOTICE REQUIRED BY LAW

THE RULES SET FORTH BELOW GOVERN THE TERMS OF YOUR RENTAL AGREEMENT WITH THIS MOBILEHOMEPARK. THE LAW REQUIRES ALL RULES AND REGULATIONS OF THIS PARK BE REASONABLE. NO RULE OR REGULATION MAY BE CHANGED WITHOUT YOUR CONSENT UNLESS THIS PARK GIVES YOU 90 DAYS NOTICE OF THE CHANGE.

SUBJECT TO THE TERMS OF ANY WRITTEN LEASE AGREEMENT, YOU MAY CONTINUE TO STAY IN THIS PARK AS LONG AS YOU PAY YOUR RENT AND ANY OTHER LAWFUL CHARGES, FOLLOW THE RULES AND REGULATIONS OF THE PARK AND APPLICABLE LOCAL, STATE AND FEDERAL LAW, DO NOT DAMAGE PARK PROPERTY AND DO NOT REPEATEDLY BOTHER OTHER TENANTS IN THE PARK. YOU MAY BE EVICTED FOR NONPAYMENT OF RENT, BUT ONLY IF YOU FAIL TO PAY ALL RENT DUE WITHIN THIRTY DAYS AFTER YOU RECEIVE WRITTEN NOTICE THAT YOU ARE BEHIND IN YOUR RENT.

YOU MAY BE EVICTED FOR NOT FOLLOWING THE RULES AND REGULATIONS OF THIS PARK BUT ONLY IF THE RULES AND REGULATIONS ARE REASONABLE, YOU HAVE BEEN GIVEN WRITTEN NOTICE OF YOUR FAILURE TO FOLLOW THE RULES AND YOU THEN CONTINUE TO BREAK THE RULES. YOU MAY NOT BE EVICTED FOR JOINING A TENANTS ORGANIZATION.

IF THIS PARK WISHES TO EVICT YOU IT MUST GIVE YOU A 60 DAYS ADVANCE NOTICE, EXCEPT IF YOU ARE BEHIND IN YOUR RENT IN WHICH CASE ONLY 30 DAYS NOTICE IS REQUIRED. THE EVICTION NOTICE MUST GIVE YOU THE REASON FOR THE PROPOSED EVICTION.

YOU HAVE THE RIGHT TO SELL YOUR HOME IN PLACE TO ANY ONE AS LONG AS THE BUYER AND HIS HOUSEHOLDMEETS THE RULES OF THIS PARK. YOU MUST NOTIFY THE PARK IF YOU INTEND TO SELL YOUR HOME. FAILURE TO DO SO MAY MEAN THAT THE BUYER WILL BE REQUIRED TO MOVE THE HOME FROM THE PARK.

COPIES OF THE LAW UNDER WHICH THIS NOTICE IS REQUIRED, RSA 205-a, MAY BE OBTAINED FROM THE CONSUMER PROTECTION DIVISION OF THE ATTORNEY GENERAL’S OFFICE, 33 CAPITOL STREET, CONCORD, NEW HAMPSHIRE 03301 OR MAY BE ACCESSED FROM THE GENERAL COURT WEBSITE FOR THE STATE OF NEW HAMPSHIRE.

RULES AND REGULATIONS and PARK STANDARDS

Definitions:

“Resident” or “Household” shall mean persons approved on the original Park Application or any person approved by Park Application thereafter.

“Guest” shall mean any unapproved person visiting any Resident in the park.

“Person” shall mean any natural person, corporation, partnership, or sole

proprietorship.

“Park” shall mean the same as management.

“Residence” shall mean a home located within Merrymeeting River Mobile Home Park.

“Home Owner” shall mean the Resident(s) who owns a home in Merrymeeting River Mobile Home Park by recorded deed at the Belknap County Registry of Deeds, either by name orby Trustee of Trust.

“Merrymeeting” shall mean Merrymeeting River Mobile Home Park.

“Family Unit” shall be a primary social group of parents and their children.

“Park Approval” is the process of being accepted as a Resident/Household of Merrymeeting through the current residency application process.

Residency and Guests

1. This is a Family Community, with each Household consisting of only one Family Unit. Only those persons approved on the original park application are permitted to reside in the park. Any new person(s) added to the home/residence must complete the residency application process andsecure Park Approval.

2. The owner(s) of the home shall also be a Resident(s) of Merrymeeting.

3. No home shall be owned or occupied by more than one Family Unit.

4. The maximum occupancy shall be two persons in the master bedroom and one person per bedroom thereafter. Maximum occupancy varies by site and is dependent upon the septic design and approvals for each site.

5. The addition of a Resident over the occupancy limit of the site shall be reason for eviction. Also, the addition of any person without “Park Approval” shall be reason for eviction.

6. The Home Owner(s) is completely and entirely responsible for any and all action(s) of their Household, Guest(s), dependent(s), person(s), or pet(s), including but not limited to, conduct, damages, and violations of the Park Rules. The same consequences apply to the Home Owner as if the Home Owner had committed the action or violation him/herself. The consequences may be as severe as, but not limited to, eviction, as per the Park Rules.

7. Guests are not allowed unless the Resident is present. However, as a Family Community, we welcome Grandparents, Parents, Children, and Grandchildren of the Home Owner with prior Park permission.

8. Residents having a Guest(s) for more than two nights must notify the office prior to their stay in the park.

9. Any Guest visiting a Resident’s home for a period of more than thirty days must notify the management and secure Park permission prior to the stay. The Park does not encourage visits longer than 30 days and permission may be withheld. Management reserves the right to limit the number of Guests and/or their usage of community facilities and amenities. Any Guest wishing to become a Resident must secure Park Approval to stay beyond 30 days.

10. Management reserves the right to ask any Guest to leave at any time for any reason, including violations of the park rules, regulations, and standards.

Rents, Fees, and Charges

1. Monthly rents are due and payable in advance on the first day of the month. Rents received in the office by 5:30 pm on the 7th day of the month due will earn a discount. Rents received after the 15th day of the month will be assessed a service fee, and will be subject to eviction. The rent discount may not be taken if there are any outstanding bills over 30 days due to the Park. (See current rent letter for rents, fees, and discounts).

2. Rents may be paid at the office during office hours, or mailed to:

3. There will be a fee for each check that is returned, and the discount will not be allowed. A returned check shall then be replaced by cash or money order.

4. A Home Owner and their Household may be evicted for non-payment of rent and/or for other violation(s) of the park rules, regulations, and standards.

5. There is a non-refundable fee for processing the Residency Application. (See the current Residency Application package.)

6. The Park may require the Resident to pay a security deposit of one month’s rent upon acceptance into the park for residency.

Sale, Transfer, or Removal of Homes

1. A Home Owner may sell his/her home while it is situated in the park at a price of their choosing. The Home Owner may place no more than two “For Sale” signs on or in his/her home not to exceed 1’ by 2’.

2. The Park reserves the right to approve the prospective new Home Owner, assignee or equivalent, and their Household as a Resident in the park by thePark Approval process.

3. The purchaser will not be approved as a Resident unless the current owner(s) informs the park of his/her intent to sell. Prior to the closing of the sale, the prospective Home Owner(s) and their Household shall secure Park Approval, which includes, but is not limited to, interview, income verification, credit report, criminal report, and eviction search. There is a non-refundable fee for the Residency Application to be processed.

4. The Park requires a pre-sale inspection of the home. The Park shall provide, within 14 days of receiving written notification from the Home Owner that he or she is going to attempt to sell his or her home in place, a written list of the repairs and improvements required in order to approve the sale. This list is valid for 90 days. If a sale has not been completed, the Park may require additional improvements or repairs, along with the original needed repairs, if there are any other defective conditions which may have arisen since the Park’s initial response. If the pre-sale inspection determines the existence of a structure or fixture which was added to the home by the seller without the permission of the Park, the Park shall require park compliance.

5. The prospective Home Owner(s) and their Household must agree to abide by the park rules, regulations, and standards prior to acceptance for residency in the park.

6. A Home Owner shall not remove a home unless and until the Park receives written notice of the intent to move 30 days prior to the date of removal. The Home Owner must also provide written proof of town taxes paid and rent paid through date of removal. The Park may require additional rent to be paid if a 30 day written notice is not received.

7. Any Home Owner wishing to add another owner to the deed, including a family member, shall make arrangements for a Residency Application to be processed and approved before the deed can be changed. New Hampshire Law requires a recorded deed on the sale of all mobile/manufactured homes, which includes written approval of the sale by the Park Owner.

8. The current Home Owner shall inform the real estate agent and the prospective purchaser of any work that is needed on the home or its structures to meet current park rules, regulations, and standards. If current standards are not met by the current owner prior to sale, the responsibility may, at the Park’s discretion, transfer to the new Home Owner. Park Approval will then be contingent on a written agreement with the Park for the prospective Home Owner to complete all needed work within 30 days of the closing.

9. Should the Home Owner die, and there is an heir wishing to inherit the home at its present location, the decedent grants to the Park the right to approve the heir as Home Owner.

10. Should the Home Owner die and there be no heirs, or should death occur and heirs receive no cash from the estate from which to pay rent, or heirs refuse or otherwise do not pay rent when due, or should the rent otherwise remain unpaid for 45 days from the date of death, the Home Owner grants to the Park any or all or the following:

* the right to purchase the decedent’s home at fair market value minus any and all outstanding debts owed to the Park and any recorded liens against the decedents home,

* the right to remove the home from the park and place it on a sales lot,

* the right to remove the home from the park and place it in a storage area,

* the right to demolish the home.

11. Any and all costs to the Park in dealing with the decedent’s home shall become debts to the estate of the said decedent and due and payable to the Park upon settlement of the decedent’s estate. This obligation of the Home Owner shall bind the heirs, executors, administrators, or assigns. The heirs shall be responsible for any attorney’s fees or other fees necessary to settle this matter.

Park Standards

In order to maintain the general attractiveness of the park, the safety and welfare of all Residents, and reasonable aesthetic values that Residents have been led to expect, the following standards shall apply to all homes.

1. In order to maintain an attractive atmosphere and a sense of quality throughout the park, every home to be placed in the park shall be newly manufactured and conform to park regulations at the Park’s discretion.

2. Any home damaged by fire, vehicle, wind, trees, snow, or by any other means, in a manner whereby it becomes uninhabitable or it appears unsightly shall be removed from the park by the Home Owner at their expense within 30 days of damage, regardless of when their insurance company promises settlement. The Home Owner grants to the Park the right to demolish and remove the damaged home from the park at the Home Owner’s expense after thirty days. The Home Owner also forfeits the lot and Residency in the Park.

3.There shall be no sub-renting or sub-letting of one’s home in the Park. This includes, but is not limited to, bringing in, engaging, enlisting, loaning to, placing, signing on, taking in or on another person(s) into the Resident’s home. Only those person(s) who have gone through the Park Approval process and have been approved shall reside in a Home Owner’s home. This shall apply to all persons who visit longer than 30 days.

4. Commercial enterprises of any kind are not allowed in the park.The Resident shall not conduct any peddling or soliciting of any nature without the written consent of the Park. The Resident shall not use his/her home as a place of business, part time or full time. Baby sitting, child care, taking in of laundry, or animal boarding is not allowed.

5. The Resident shall see that no persons other than established service people shall be permitted on the Resident’s lot during his absence without the express written permission from the Resident and the Park. The Park requires that the Home Owner inform the Park of any and all service work to be done outside the home to be sure that any work done will meet park standards.

Pets

1. No pets are allowed without written approval of the Park. The Park reserves the right to be the sole judge of any pet as to whether it is suitable or unsuitable for park residency.2.Guest pets shall be kept confined and meet all of the criteria of the park rules and regulations. “Pet sitting” or boarding is not allowed.

3. The Resident shall not keep any wild animals as pets, and under no circumstances shall there be cages, houses, or structures of any type for any animal(s) on his lot or anywhere in the park.

4. The Resident shall not keep any farm-type pets within the park, including but not limited to, rabbits, chickens, ducks, pigs, and geese. Park will permit domestic pets such as tropical fish, one bird, one hamster, and one gerbil, provided they remain inside the home and do not disturb their neighbors or other Residents of the park.Any health hazard caused by pets will be the Home Owner’s responsibility and/or lead to eviction. Any inside pets that repeatedly disturb, disrupt, or cause a health hazard to others in the park will have to be permanently removed from the park. If not removed from the park, the Home Owner and theirHousehold will be evicted. The Park shall be the sole judge of what constitutes a health hazard or disturbance to other Residents.

5.The Park allows one indoor cat, neutered or spayed before 6 months old, with all shots, and the Resident shall keep up-to-date veterinary certificates on file in the park office.If the cat is taken outside, it shall be leashed at all times and picked up after.

6. Dogs

a. The Park allows one dog, with advanced Park permission.

b. The dog shall be a breed that does not exceed 35 pounds when full grown.

c. The dog shall be spayed or neutered before allowed in the park or before the dog is 6 months old, and have up-to-date rabies and distemper shots, with veterinary certificates on file with the park office.

d. Dog houses, dog pens, and dog runs are not allowed, and dogs shall not be left unattended outside.

e. Dogs will be leashed at all times, under control at all times, and never left to bark. Droppings will be picked up immediately, and placed in the dumpster in a plastic bag.

f.The Park Owner may require that a dog shall be removed permanently from the park after three complaints of barking,and/or not being picked up after.

g. If the dog bites any person or other animal, the dog owner shall remove it immediately and permanently from the park.

h.Complaints against a Resident about their dog need to be filed in writing at the office. The complaint shall include all issues, times and dates, and be signed by the complainant.

i.Damages by a dog will be the sole responsibility of the owner of the dog, including but not limited to, personal property, liability, attorneys fees, court fees, hospital fees, etc. The Home Owner is responsible for their dog and any dog belonging to a member of their Household or theirGuest.

j. Please be thoughtful about where your dog drops. The well head protection area, the water system faucets and well heads, all buildings and homes, all lawns, play grounds, and the pool area are off limits. Please confine walking to the roads.

k. The Park reserves the right to be the sole judge as to whether a dog is suitable or unsuitable for park residency. Termination of a dog’s residency in the park shall be judged solely by the management.

l. The Resident shall indemnify, defend and save and hold harmless the Park owner and the Park managementfrom any and all damage and liabilities relating to their dog or their Guest’s dog, and/or relating totermination of the dog’s residency.
