REGULAR MEETING

The Fairbank City Council met in Regular Session on Monday, April 12, 2010. Mayor Welsh called the meeting to order with the Pledge of Allegiance at 6:00 P.M. Members present: Sullivan, Cummings and Mangrich. Absent: Woods and Kayser. Also present: Dave Ryan, Public Works Director; Heather Prendergast, City Attorney; B.J. Sackett, Police Chief and Marlene Strempke, City Clerk.

Motion by Sullivan, second by Mangrich to approve the agenda as presented. Roll call vote—Ayes: Sullivan, Mangrich and Cummings. Nays: None.

Motion by Sullivan, second by Cummings to approve the Minutes of the March 22nd Regular Meeting. Roll call vote—Ayes: Sullivan, Cummings and Mangrich. Nays: None.

Councilman Kayser arrived at 6:04 P.M.

Motion by Mangrich, second by Sullivan to approve the Treasurer’s Report. Receipts for the month of March were: General, $6,130.46; Special Revenue, $14,174.25;

TIF, $2,964.67; Capital Projects, $82.08; Permanent Fund, $52.16 and Proprietary, $182,879.81. Disbursements were: General, $13,623.04; Special Revenue, $3,651.63; TIF, $260.00 and Proprietary, $117,298.37. Balance on hand at close of business on March 31, 2010 was $1,739,010.05. Roll call vote—Ayes: Mangrich, Sullivan, Cummings and Kayser. Nays: None.

Randy Robinson was present to discuss the drainage situation along his property to the city limits. A couple members of the council and the public works director will meet with Mr. Robinson to discuss possible options to alleviate the situation and it will be on the next agenda.

Motion by Sullivan, second by Mangrich to have Speer Financial proceed with the bond sale for refunding and the street project with a six year term. Roll call vote—Ayes: Sullivan, Mangrich and Cummings. Nays: Kayser.

Motion by Mangrich, second by Cummings to request permission from the Iowa Department of Transportation to close part of Main Street for Fairbank Days. Roll call vote—Ayes: Mangrich, Cummings, Sullivan and Kayser. Nays: None.

Motion by Mangrich, second by Kayser to approve the appointment of Ben Wolfe to the Planning & Zoning Commission for another five year term. Roll call vote—Ayes; Mangrich, Kayser, Cummings and Sullivan. Nays: None.

Motion by Mangrich, second by Cummings to keep the second squad car. Roll call vote—Ayes: Mangrich, Cummings, Sullivan and Kayser. Nays: None.

Motion by Mangrich, second by Sullivan to approve the job description for Recreations Director as presented. Roll call vote—Ayes: Mangrich, Sullivan, Cummings and Kayser. Nays: None.

Motion by Kayser, second by Mangrich to appoint Pat Miller as Recreation Director for $1,500 plus the cost of umpires, if any. Roll call vote—Ayes: Kayser, Mangrich, Sullivan and Cummings. Nays: None.

Motion by Mangrich, second by Cummings to approve the request to place a memorial bench in Riverside Park. Roll call vote—Ayes: Mangrich, Cummings, Sullivan and Kayser. Nays: None.

Motion by Kayser, second by Mangrich to approve the request for a tree to be planted in Riverside Park as a memorial subject to approval of the location by the Park Committee and the Public Works Department. Roll call vote—Ayes: Kayser, Mangrich, Sullivan and Cummings. Nays: None.

Motion by Kayser, second by Mangrich not to continue beyond Phase 2 of the IAMWind Project. Roll call vote—Ayes: Kayser. Mangrich, Sullivan and Cummings. Nays: None.

Motion by Cummings, second by Mangrich to not hook up to Iowa Rural Water System. Roll call vote—Ayes: Cummings, Mangrich, Sullivan and Kayser. Nays: None.

The possibility of licensing pets will be explored and more information on ways to deal with feral cats will be investigated.

Motion by Mangrich, second by Kayser to approve the bills as presented with the adjustment of Butler County REC to actual cost when received. Roll call vote—Ayes: Mangrich, Kayser, Cummings and Sullivan. Nays: None.
