INVITATION TO BID: Sealed bids for the sale of the 1st Ward School Property located at 701 S Fourth St in Towanda Borough.

DATE OF BID OPENING: November 14, 2013 at 11:00 AM in the Towanda Area School District Business Office, 410 State Street, Towanda PA 18848.

The Towanda Area School District is soliciting sealed bids for the sale of the 1st Ward School Property. Sealed bids will be received in the Business Office at 410 State Street Towanda PA 18848, no later than the date and time set forth above.

STANDARD INSTRUCTIONS

The Board of Education may delete, supersede, or modify any of these standard instructions for a particular proposal by indicating such change in the section:Special Instructions to Bidders.”

  1. Return bid in sealed envelope.
  2. Submit bid in an envelope marked with the bidder’s name and address in the upper left-hand corner.
  3. Bids should be addressed to: Towanda Area School District, Doreen Secor, Business Manager 410 State Street, Towanda PA 18848. Clearly mark envelope with the title of the bid, date and time of opening as shown above: “Invitation to Bid –Sale of 1st WardSchool Property.”
  4. Bids received later than the time specified will not be considered. Amendments to, or withdrawals of bids received later than the time and date set for bid opening will not be considered.
  5. Bidders may be present at the opening of bids.
  6. All bidders must submit a non-collusion affidavit in accordance with the provisions of the Pennsylvania Antibid-Rigging Act of 1963, as attached.
  7. The TowandaAreaSchool District is not responsible for injuries of prospective bidders when inspecting the property.
  8. The Board of Education reserves the right to reject any and all bids.
  9. Building inspection will be held on request by any interested party by calling Ron Cook at 570-268-2083.
  10. Inquiries concerning this bid should be directed to Doreen Secor at 570-265-9154.
  11. The successful bidder will be notified within 30 days of the bid opening.

Special Instructions

  1. No proposal may be withdrawn for a period of thirty (30) days following the opening of the proposals without consent of the Board of Education.
  1. The property and all improvements thereon will be sold in “as is” condition.
  1. The Towanda Area School District will retainall of the oil, gas and mineral rights to the property including the right to receive all current and future rights in any leases of the oil, gas and mineral rights.
  1. The bidder shall include one price for the purchase. The purchase price will include the buyer paying all closing costs, including, but not limited to, cost of title examination. Title insurance or certification of title, transfer taxes, recording fees and buyer’s attorney’s fees.
  1. The bidder must transfer and settle on the sale of the building within 60 days of the school district approval of the bid. The purchase will be by cash or certified check.
  1. The property will be sold subject to a restrictive covenant to run with the land that at no time shall the property be owned by any person or entity or used for a purpose that would exempt the property from payment of real property taxes.
  1. It is zoned under the Towanda Borough zoning ordinance as residential (R-1 zoning district).
  1. The school district intends to rely on §707(2) of the Pennsylvania School Code of 1949 which states:

Upon sealed bids requested by the school board, notice of the request for sealed bids to be given as provided in clause (1) of this section. Terms and conditions of sale shall be fixed by the board in the motion or resolution authorizing the request for sealed bids.

  1. Attached is a copy of the deed for the 1st Ward School Property.
  1. The property description is as follows:

Parcel number 47-086.06-126-000-000. It is situated on 1.38 acres, more or less, in Towanda Borough, First Ward with a building that is approximately 5,200 square feet and built in 1916. The property is located in a residential neighborhood R-1 surrounded by three streets. There is off street parking; brick exterior walls; a basement and 2 stories above ground; asphalt shingle roof; 200 amp, single phase electrical service, carpet, wood, ceramic and tile flooring; drywall and paneling interior walls. The heating system is oil fired hot water. Windows are vinyl replacement. There is no known asbestos in the building based on a recent report by Asbestos Management. The property is mainly level with municipal water source and sewage removal.
