ABOUT THIS STANDARD PRICING TABLE

(a)  This standard pricing table, together with:

(i)  your application;

(ii)  the Consumer terms or SMB terms as applicable to you;

(iii)  the service description; and

(iv)  the appendices,

forms your agreement.

(b)  You may obtain a copy of the latest version of the above documents on our website: www.optus.com.au/standardagreements or from us on request.

(c)  Where you may be charged a fee, then this fee is set out in this standard pricing table. Please check this standard pricing table carefully to see what fees apply to your use of the service.

(d)  The meaning of the words printed like this is set out at the end of the service description or in the Consumer terms or SMB terms as applicable to you.

OPTUS MOBILE BROADBAND AND BUSINESS MOBILE BROADBAND SERVICE OPTIONS

2.1  Optus Mobile Broadband

(a)  The Optus Mobile Broadband service will also be referred to as the Optus Wireless Broadband service.

(b)  You can access the service via an approved modem device (such as a USB modemOR WiFi modem) and the Optus software loaded onto your computer in any location covered by our 4G or 3G dual band networks depending on the compatibility of your modem. Optus dual band service refers to our 2100MHz/900MHz network. Optus dual band devices can provide access to 3G services in the Optus dual band coverage area. Optus 3G service refers to our 2100MHz network. Optus 3G devices can provide access to 3G services only in the Optus 3G coverage area.

Equipment and equipment charges

3.1  Equipment required to access the services

(a)  You may:

(i)  depending on the terms of the pricing plans available when you connect to the service, be able to:

(A)  use an approved Roamer modem or InZone modem supplied by us on a rental basis to access the service; or

(B)  purchase an approved Roamer modem or InZone modem from us to access the service; or

(C)  purchase an approved computer or tablet with an dual band (2100/900MHz) embedded modem from us to access the service; or

(ii)  use your own Mobile Broadband modem or embedded device approved by Optus for use on our dual band (2100/900MHz) or 3G (2100MHz) Network to access the service.

(b)  If you choose to use your own Mobile Broadband modem or embedded device to access the service:

(i)  your Mobile Broadband modem or embedded device must be an approved modem;

(ii)  the operation of your Mobile Broadband modem or embedded device, and any repairs to it, is your responsibility; and

(iii)  subject to your statutory rights, Optus does not make any warranty regarding the software or data provided to you as it operates on your device and interacts with your other applications.

3.2  Delivery fee

A $9.95 delivery fee may apply if your device is delivered to you

3.3  Rental equipment charges on yes’ Starter, ‘yes’ Classic, ‘’yes’ Everyday, ‘yes’ Business Starter or ‘yes’ Business Classic or ‘yes’ Business Everyday pricing plan

The following terms apply if you have connected to the service on the ‘yes’ Starter, ‘yes’ Classic, ‘’yes’ Everyday, ‘yes’ Business Starter or ‘yes’ Business Classic or ‘yes’ Business Everyday pricing plan and you have chosen to rent an approved roamer modem or InZone modem from us:

(a)  we may charge you an upfront fee and/or a monthly line rental fee for use of the roamer modem or InZone modem, depending on the pricing plan you have selected as follows:

(b)  we retain ownership of the modem;

(c)  if you move premises to a serviceable area, and we consent, you may relocate the rental modem to that new address;

(d)  you agree to take reasonable care of the modem

(e)  if the modem is damaged, unless in our opinion the damage is caused by fair wear and tear, we may charge you for the cost of repair or the cost of replacing it (see clause 5.2 below);

(f)  if you lose your modem, we may charge you the cost of replacing it (see replacement costs at clause 5.2).

(g)  we will request you to return modem if we supply you with a replacement or if we no longer supply the service to you (including on cancellation of the service). We will charge you a fee if you do not return the modem within 14 days of our request (see clause 5.2 below).

3.4  Equipment charges on the Wireless, ‘yes’ Wireless, ‘yes’ Everyday 5GB, Business Wireless, ‘yes’ Biz Wireless or ‘yes’ Business Everyday 5GB and the ‘yes’ Business Share Wireless Broadband Plan

The terms set out below apply if you connect to the service between 20 February 2008 and 31 August 2008 on a Wireless, ‘yes’ Wireless, ‘yes’ Everyday 5GB, Business Wireless, ‘yes’ Biz Wireless or ‘yes’ Business Everyday 5GB pricing plan, or you connect to the service on the ‘yes’ Business Share Wireless Broadband Plan; and you purchase an approved Roamer modem or InZone modem from us for use with the service.

(a)  When you purchase the Roamer modem or InZone modem from us the terms of the mobile equipment payment plan (see Appendix D) apply.

(b)  You may choose to:

(i)  pay the entire amount upfront, in which case we will bill you for the purchase price in your first bill, or
