CONDITIONS OF HIRE

THE RISE – SPORTS COURTS AND ROOMS

BEHAVIOUR OF PATRONS

The hirer is responsible for the behaviour of all patrons using the booked courts/rooms.

Antisocial behaviour is not acceptable and patrons displaying antisocial behaviour must vacate the facility when requested.

The behaviour of children will be the responsibility of the parents or carers concerned and must be supervised at all times.

BINS

Bins are provided and are to be used with no exceptions. Please ensure waste that is considered large scale is deposited into the bins located in the basement at the conclusion of the booking.

BOOKINGS

All bookings must be made in writing, excluding one-off casual bookings. The Account Contact Person must make all bookings, amendments and cancellations.

Annual bookings are periodically reviewed and are NOT valid until booking confirmation has been sent in writing from The RISE.

For functions/events a booking request form must be submitted, including details of set up and clean up time. Charges will apply for room hire, set up time and clean up time. Bookings are NOT valid until a confirmation has been sent in writing from The RISE.

BONDS & TARIFFS

A damage bond will apply to bookings scheduled outside of The RISE operational hours.

A tariff will also apply to bookings scheduled outside of The RISE operational hours to cover staffing costs.

Bonds will be refunded by cheque, made out to the name and address on the booking form, subject to compliance with conditions.

BREAKDOWNS

In the event of a breakdown in services, utilities, equipment, etc. no responsibility will be accepted by The RISE or the City of Bayswater but every care and precaution will be taken in this regard.

CANCELLATION, REFUNDS AND TENTATIVE BOOKINGS

The RISE reserves the right to cancel any bookings and any amounts paid will be fully refunded.

Cancellation by the Hirer must be received in writing 28 days prior to the booking date for Major and Minor Events. Where a cancellation is less than 28 days prior to the event, a refund will not be given. All other booking cancellations or amendments must be made in writing with a minimum of 24 hours notice prior to the booking.

Bookings are not secure without confirmation in writing.

CLEANING

Courts, rooms and toilets are required to be left in a clean and tidy condition immediately after use, including the removal of all rubbish and personal belongings. Ensure floors are swept/vacuumed/mopped after use if necessary.

Please note, if the Hirer requires time for cleaning the room after use, the Hirer must request this in the booking request form and will be charged accordingly.

The use of confetti or similar materials is strictly unauthorised.

CROCKERY AND CUTLERY

The RISE will not supply crockery and cutlery. It is the Hirer’s responsibility to provide these items for their function and to remove them after use.

CURFEW

The curfew for The RISE is the regular closing hoursunless prior arrangements have been made with management. Please ensure you have vacated the facility at the designated time as stated on your booking confirmation. Failure to do so may jeopardise future booking requests, and will result in additional charges. Please adhere strictly to booking times as any usage outside the agreed booking time will incur a minimum of one hour court/room hire fee (specific to your booking), along with staff charges if applicable.

Music and refreshments must end at the hire time designated by The RISE.

DAMAGE

The Hirer must inform The RISE Staff if any damage is discovered prior to usage. In the event of damage to the facility resulting from the function the Hirer will be held responsible and will be charged for any repair costs which will be determined by management.

The driving of nails and screws etc. into any part of the building fixtures and fittings is forbidden.

DECORATIONS

ELECTRICAL EQUIPMENT

If a hirer provides any form of electrical equipment it is required to be tagged in accordance with Australian Standard AS/NZS 3760:2001 - In Service Safety Inspection and Testing of Electrical Equipment requires that all electrical equipment such as urns, kettles, stereo systems, extension cords and heaters be inspected, tested and tagged on a regular basis. This equipment is to be identified in the application.

EQUIPMENT

Tables and chairs are supplied for the duration of your booking. Please ensure these are returned to the correct area of storage. Chairs must be clean and stacked in groups of no more than 10. Tables must be cleaned, folded and stored in an upright position. The Function Room holds 400 chairs and 30 round tables. The Community Hall holds 300 chairs and 30 rectangle tables.

FEES & CHARGES

Customers will be quoted on current fees and charges, however charges are subject to change due to the adoption of new fees and charges.

FLOORS

No talcum powder, sawdust or resin is to be used. Plants containing water are not to be placed on floors. If floors are damaged in any way, a charge will be made for restoration for those without consent from management. Use of tape and markings on the sports floor is prohibited. Failure to comply may result in additional charges.

Food and drink, with the exception of water, are not to be consumed on the sports courts floor.

HIRED AREA

People attending functions/bookings are to remain within the area hired. Consideration of others is appreciated. Please DO NOT ENTER the area you have booked before your designated time as other user groups may be using the facility.

HIRER'S POSSESSIONS

Articles and goods left during the hire of the centre's facilities are left at the hirer's/owner's own risk. The City of Bayswater and The RISE accepts no responsibility for any items left on the premises.

LAW AND ORDER

The Hirer of any facility shall comply with the provisions of the Health Act, Liquor Act, Police Act and Criminal Code, or any other Act in force.

LIABILITY

Hirer’s of City Facilities have some cover for their public liability depending on the activities being undertaken. Regular hirers and groups/organisations and the like are encouraged to arrange their own public liability insurance.

LIQUOR

Prior written consent from The RISE must be obtained if alcohol is proposed to be consumed at the event or function. Alcohol on a "BYO basis" for guests to an event will not be permitted. Permission from management must also be obtained when selling liquor prior to applying for an Occasional License

Occasional License: Where a charge for entry or payment for alcohol is involved an Occasional License must be obtained from the Liquor Licensing Division, Hyatt Centre, 1st Floor, 87 Adelaide Terrace, Perth, fourteen (14) days prior to the event. A copy of this Licence must be forwarded to The RISE Management before the event and must be shown on inspection by any authorised person within the licensed premises.

The City of Bayswater and The RISE are not required to hold or obtain liquor licenses for events or functions which are not run or organised by the City of Bayswater or The RISE.

NOISE

The Hirer must ensure that no undue noise whether in the centre or by leaving the venue is created by patrons. Any complaints received from adjacent residents could jeopardise future applications. If noise is excessive, it may result in the booking being shut down and no refund for the remainder of the booking fee given.

Hirers must consider other centre users in regard to noise. If noise is deemed as excessive the Hirer must rectify the problem immediately. Please be aware that the partitions are not sound proof and you may be booked near a group who will be playing music or making noise.

In both the Function Suite and Community Hall balconies are not accessible from 10:00pm onwards. If these balconies are accessed management has the right to shut down the booking and no refund for the remainder of the booking fee given.

PAYMENTS

Annual/Court bookings: An invoice is issued upon confirmation of the booking. Payments can be made in installments prior to the booking date. Alternatively, full payment can be made on the day of the booking.

Casual Functions/Events: An invoice is issued upon confirmation of the booking. The Hirer must finalise their account prior to the event (This includes bond payment).

REFUSAL

The RISE reserves the right to refuse to let the facility or any portion thereof without assigning any reason for refusal.

SEVERAL APPLICATIONS

In the event of two (2) or more applications being received for the hire of any portion of the facility at one time and date, The RISE may without considering priority of application, determine to which applicant the booking shall be granted.

SMOKING

Councils adopted policy prohibits smoking inside any Council owned community facility or within 50 metres of Council owned community facilities.

WARNING - every person shall observe all conditions of the Local Government and Public Property Local Law 1999.
