Recommended “conditions of approval” for Site Development Plan of Robert Mellinger:

1.  No parking permitted outside of the garage along Cove Avenue.

2.  Business sign – limit size to 18” x 24”, pole mounted or attached to building.

3.  Hours of operation – should they be limited?

4.  Owner must comply with all provisions of Section 3.2.4.1 as they relate to Customary Home Occupations.

5.  No large commercial vehicles to be lettered at this location.

6.  Newville Borough reserves the right to rescind the Customary Home Occupation use approval should operations outgrow the site or if complaints are received from the public or adjoining property owners regarding the business operations.

SUBJ: Conditional Use Application for Day Care Center at

8 Springfield Avenue

I have reviewed with the applicant Rebecca Keck, her application for a child day care center at 8 Springfield Avenue. Based upon the review of our zoning ordinance, I have advised the applicant that since the property is located in an R-2 Zone District, she must make an application to the borough for a conditional use permit. If the planning commission acts on the application at the next meeting, it may be possible for council to schedule a public hearing on this matter in time for their July meeting.

The applicant has been furnished with a Conditional Use Application which she

will bring with her to the meeting.

Some general observations:

1. I have determined that the proposed use of the property requires a conditional use approval since the present residential structure is in an R-2

zone district (section 3.2.3 “Conditional Uses”). Although it is not clearly defined, I consider, and the applicant agrees that a day care center provides a personal service (section 3.2.3.8 “permitted Village District Uses, (3) Personal Services).

2. Off street parking requirements (section 4.3.1.3 see Page 41 Daycare Centers)

are 1 space per employee plus 1 space per every 10 children. The applicant

is proposing three off street spaces to be created on the lot, while using one

off street space existing in front of the building. This may or may not be

enough off street parking. The state must first inspect the property and

determine, based upon a site inspection, the maximum number of children

which shall be allowed at the center. Therefore some provision in the final

approval recommendation should be set forth to require the applicant to

provide sufficient off street parking, pursuant to the occupancy determination

of the state.

3. The applicant has been advised that parking spaces must be 10 foot wide

and 20 feet long (section 4.3.1.4 Design Standards, A, 1). Parking area must

be dust free.

4. Perimeter fencing is required for the child play area. The area should be securely enclosed.

5. A “conservative” sign should be recommended, at a size in keeping with

the character of the residential area.

6. The parking area in front of the home should be designated as a drop off and pick up zone with a time limit for parking.

7. Smoke detectors should be placed on all floors of the home.

Future improvements to the home or property should be made consistent with the residential character of the neighborhood.
