MAHONING TOWNSHIP BOARD OF SUPERVISOR’S MEETING

CALL TO ORDER:

John Wieczorek called the meeting to order at 6:00 p.m. at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

ROLL CALL:

PRESENT:

John Wieczorek, Chairman; Bruce Steigerwalt, Supervisor; Linda Benner, Supervisor; Franklin Ruch, Supervisor; Todd Weaver, Supervisor; Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

PUBLIC COMMENT:

Ed and Toni Everett, 284 Dead End Lane, Lehighton, PA: They are requesting to construct a new home on a sixteen acre parcel on Dead End Lane. The issue is that an existing residence on the property which is being occupied by their mother. Our ordinance does not permit two residences on one parcel. The Everett’s intention is to build the new house and then tear down old or possibly convert old into a pole barn.

MOTION

Franklin Ruch made a motion to take the Planning Commission’s recommendation and to scratch tear down in six months and change to the stipulation to make building inhabitable by removing all utilities services with ninety days of occupancy of new home. Seconded by Todd Weaver. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried.

APPROVAL OF MINUTES:

MOTION

Bruce Steigerwalt made a motion to approve the minutes of the September 10, 2012 Board of Supervisors Meeting. Seconded by Linda Benner. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried.

OLD BUSINESS:

Lowe’s Traffic Signal Maintenance Agreement

Supervisor’s added clarification of maintenance. Additions to be made to agreement are road markings, paint and signs, including signals, support posts, foundations, control boxes, signs, pavement markings and detection devices Establish escrow at $10,000 instead of $5000.00. Tom Nanovic will reach out to Attorney Grey with clarifications.

Super Walmart Traffic Signal Agreement

Tom Nanovic shared that upon receipt of Tim Edinger's review comments then we will proceed forward. Frank Ruch commented on perhaps including a generator.

Mahoning Medical Campus Extension Request

MOTION

Bruce Steigerwalt made a motion granting an extension to December 31, 2012 to Mahoning Medical Campus Land Development. Seconded by Franklin Ruch. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried. Also, requesting their presence at the next Planning Commission Meeting to provide and update of viable progress to said land development.

NEW BUSINESS

Resolution 2012-13 Police Pension Plan MMO Contribution Requirement of $46,683.00

MOTION

Bruce Steigerwalt made a motion to approve Resolution 2012-13 Police Pension Contribution for 2013 of $46,683.00. Seconded by Linda Benner. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Resolution 2012-14 Non-Uniform Pension Plan MMO Contribution Requirement of $24,151.00

MOTION

John Wieczorek made a motion to approve Resolution 2012-14 Non-Uniform Pension Contribution for 2013 of $24,151.00. Seconded by Todd Weaver. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Jim Thorpe National Bank Proposal of Financing $150,000 at 2.49%

MOTION

Franklin Ruch made a motion to accept Jim Thorpe National Bank Proposal of Financing $150,000 at 2.49% for pole building project. Seconded by Bruce Steigerwalt. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Franklin Ruch, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Road Committee:

Bruce Steigerwalt shared an email received from PPL with regards to relocation of electric service. Cost of $4,503.05 for new service. Frank will investigate the questions that are regarding additional costs.

Road Department hauled shale to the lower south side of future pole building site. However the shale on hand is bony. They laid some but will need to dress with modify.

Police Committee

Linda Benner commented on monthly reports and over time. Repair reports show expenses are high on vehicles in 2012
