Contract covering waste destined for recovery

Dear Sir,

On the 12th July 07 the new European regulations for the shipment of waste destined for recovery come into force.

From that date onwards you are the person arranging the shipment are required to complete a form, the “consignment information”, for all shipments of waste, including green listed material, in accordance with Annex VII of the above mentioned regulations (see attachment no. 1). Item 12 of this form requires that you may certify that effective written contractual obligations have been entered into with the consignee.

Article 18, paragraph 2 of the regulations (see attachments no.2) stipulates what obligations are to be included in a “green” contract for waste destined for recovery between the person arranging the shipment and the receiver. Our obligations as receiver in such a contract are secondary to ours the person arranging the shipment. This contract must be in place before shipment and available for presentation to the relevant competent authority should they require to see it. It must be kept on record for a minimum of 3 years (Article 20, paragraph 2).

In attachment no.3 you will find such a contract covering waste destined for recovery in duplicate. This covers our future trans-frontier shipments of green listed waste and corresponds to the new regulations.

The consegne

For all trans-frontier shipments of “green” listed wastes destined for recovery according to the European Waste Shipment Regulation EEC 1013/2006 (Annex III, III A and III B)

The parties hereby agree the following obligations for each and every shipment:

1)The person who arranges the shipment agrees

where the shipment of waste or its recovery cannot be completed as intended or where it has been deemed, by a competent authority, to be an illegal shipment, to:

a)take the waste back or ensure its recovery by alternative means; and

b)if necessary provide for its storage until such time as that it possible.

2)The consignee agrees

where the person who arranges the shipment is not in a position to complete the shipment of waste or its recovery (for example, due to insolvency) to:

a)take the waste back or ensure its recovery by alternative means; and

b)if necessary provide for its storage until such time as that it possible.

The parties shall provide a copy of the contract upon request by the competent authority concerned.
