When an evidence rule is assigned, read both the Hawaii and the Federal rule and skim the HRE Commentary. On the syllabus, sometimes the page numbers of Emanuel’s have a “t” “m” or “b” – that means “top” “middle” or “bottom” of the page.
Reading assignments in HO2 and HO3 frequently include very short case notes from Goode & Wellborn’s Courtroom Evidence Handbook which are designed to give you a flavor of cases decided under specific FREs.
You will be askedto do one court observationand oneCALI computer exercise. More information about these assignments is at the end of this syllabus.These requirements (court observationand CALI exercise) are credit/no credit.

DIRECT AND CROSS EXAMINATION OF OFFICER BIER
HO2:66-72. Key facts are from HI Liquor Comm. v. Jones, HO2:71-72. Do NOT use HO2:73 for this exercise. You will not be allowed to introduce the investigator's report or the diagram for this exercise.
Each student should prepare to play Officer Bier and prepare both direct examination of Bier for the Corporation Counsel and cross examination of Bier for Cut Rate Liquor Store. Anyone can object to any improper question or answer. The exercise will be done in small groups with various lawyers acting as judges and critquers.

COURT OBSERVATION. You are asked to do one court observation (or viewing) to watch direct and cross examination during the semester. You may visit Circuit Court (777 Punchbowl St.), Federal Court (300 Ala Moana Blvd.), or District Court (1111 Alakea St.), or court TV or a video of a trial. Your best chance to see witness examinations may be at Circuit Court. A one-page “Court Observation Form” is included at HO2: 149. Please complete your observation by Thanksgiving.
CALI COMPUTER EXERCISE. You are also asked to complete one CALI computer exercise on the topic of evidence. Once you try one, you may like it enough that you will want to do others for self-study. You should have your copy of the CD with the CALI exercises on it, or it will be available to you in the Law Library or at the CALI web site, www.cali.org.
Both the court observation and the CALI exercises are graded “credit/no credit.” In other words they are not graded, but you are required to complete them. You can do both the observation and the CALI exercise with a friend(s), but each person must turn in his or her own report form.
