ORDER APPOINTING EMERGENCY TEMPORARY GUARDIAN

On the petition of ______for the appointment of an emergency temporary guardian (“ETG”)for the above-named Alleged Incapacitated Person (“AIP”), who is represented by counsel in these proceedings, and it appearing to the Court that unless immediate action is taken, there is an imminent danger that the AIP’s physical or mental health or safety will be seriously impaired or that the AIP’s property is in danger of being wasted, misappropriated, or lost; and the Court having jurisdiction and being fully advised; it is

ADJUDGED that:

  1. ______is qualified to serve and is hereby appointed as the AIP’s ETG of the (person) / (property) / (person and property).
  1. Upon taking the prescribed oath, filing designation of resident agent and acceptance and entering into a bond in the amount of $______payable to the Governor of the State of Florida and to all successors in office, conditioned on the ETG’s faithful performance of all duties, letters of emergency temporary guardianship shall be issued granting the ETG the following powers and duties:

  1. The ETG shall place all of the AIP’s liquid assets in a depository designated by the Court per Section 69.031, Florida Statutes (“Depository”). This is a frozen account. No funds shall be withdrawn without a court order.
  1. All monies payable to the Emergency Temporary Guardianship shall be paid jointly to the ETG and the Depository.
  1. The Court is not aware that the AIP has executed any valid advance directive per Chapter 765, Florida Statutes. If any such directive exists, the ETG shall exercise no authority until further order of this Court.
  1. There shall be no sale, encumbrance, borrowing, or gifting of any assets without a special court order.
  1. Unless further extended by court order, the ETG’s authority shall expire ninety (90) days from the date of this Order, or when a guardian is appointed, whichever occurs first.
  1. The AIP may not have a license to carry a firearm and/or own or possess a weapon or firearm.
  1. Initial guardianship report shall be filed in 60 days.
