MINUTES OF THE JANUARY MONTHLY MEETING OF NAVAN TOWN COUNCIL WHICH TOOK PLACE ON TUESDAY 11TH JANUARY 2011 AT 7.00PM IN THE COUNCIL CHAMBER, TOWN HALL, WATERGATE STREET, NAVAN, CO. MEATH.

Confirmation of Minutes

Confirmation of Minutes of the December Monthly Meeting of Navan Town Council held on 7th December 2010 at 7pm in the Town Council Chamber, Townhall, Watergate St, Navan, Co Meath.

The Town Clerk advised the Members that the Minutes that had been circulated were in fact the November Minutes and he suggested that the item be deferred until the February Monthly Meeting for consideration.

The Members agreed to the Town Clerks request.

Correspondence and Reports

Meath Arts Group:

The Members received and noted correspondence from the Meath Arts Group thanking the Council for their recent contribution to the group. The Group confirmed that they intended to highlight Navan and the Arts in the coming year.

An Post

The Members received and noted correspondence from An Post in relation to the condition of the Navan Post Office

To consider and if thought fit to grant Planning Permission in material contravention of the Navan Development Plan 2009 - 2015 in respect of Planning Application Reference NT100032 by Grandbrind Athlumney Ltd for a development as follows:

“construction of a primary school with capacity for c.960 pupils, together with ancillary works, on lands at Athlumney, Navan, Co Meath. The primary school is to be constructed in a 2-storey building of c.5,763sq.m containing 32no. general purpose classrooms and associated backup areas including staff offices, and meeting rooms; Libraries, resource rooms, a divisible multipurpose halls; toilets, stair wells and circulation areas. Vehicular access to the school grounds from the west is provided from a new 6m wide distributor road (c.365m in length) which connects to the constructed distributor road to the south of Birch Lawn, Athlumney Hall, Navan, Co. Meath. A footpath and a cycle path are provided alongside the new road. This new road is also intended to serve the future development of other zoned lands adjacent to the application site. 88 no. car parking spaces (46 Staff and 42 visitor spaces) are provided with additional over-flow car parking of 26 spaces being accommodated on the multiuse basketball court to the south of the school buildings. (114 spaces in total). Site development and landscape works are also proposed, including the provision of 4no. ball courts (2 for the senior school and 2 for the junior school) and 2no. hard play area (one each for the junior and senior schools). An attenuation tank of 70 cu. m is also to be provided in association with the surface water drainage works. All on a site of c.2.79ha on lands bounded generally by the Navan and Duleek Road (R153) to the North, St Martha's College to the South, The Alexander Reid Johnstown Road to the east; and the Athlumney Hall Housing Development to the West;” in the townland of Alexander Reid, Navan, Co Meath.

The proposed development would materially contravene the following policy of the Navan Development Plan 2009-2015:

i) Settlement Strategy OBJ 16 Page 43 of the NDP which seeks:

“To Prepare Local Area Plans for lands designated LAP 1 in cooperation with relevant stakeholders , and to actively secure the implementation of these plans and the achievement of the specific objectives indicated below. Development of these lands shall only proceed on the basis of an adopted Local Area Plan, the availability of water and waste water services associated infrastructure including the phased provision of these services and the timely provision of the relevant sections of the Local Distributor road network , where applicable.” LAP 1 relates to lands adjoining and including St. Martha’s College, Johnstown. This area is intended for general development, primarily to provide for community, education, residential and recreational facilities, and shall also provide for inter alia the following:

1. The reservation of an 11 acre site for the provision of 1 no.

primary school and 1 no. special school provided in educational campus

The Members received and noted a presentation in respect of the item which was delivered to them by Ms Fiona Redmond, Senior Executive Planner.

The Town Clerk advised the Members that in accordance with Section 34.(6) (b) of the Planning & Development Act 2000 as amended, in order to pass a resolution to materially contravene the Navan Development Plan 2009-2015, the number of the members of the planning authority voting in favour of the resolution shall be not less that three –quarters of the total number of members of the planning authority or where the number so obtained is not a whole number , the whole number next below the number so obtained shall be sufficient. Therefore in this case, at least 6 members of Navan Town Council were required to vote in favour of the resolution, in order that the material contravention be passed.

To consider the proposed development and the Manager’s Report thereon in accordance with Section 179(3) of the Planning and Development Act 2000-2010 as amended, Part VIII of the Local Government(Planning and Development) Regulations 2001-2009 as amended in respect of the LAP3 Distributor Road – Trim Rd to Commons Road ( as outlined in the said report).

The Members received and noted the Manager’s Report thereon in accordance with Section 179(3) of the Planning and Development Act 2000-2010 as amended, Part VIII of the Local Government(Planning and Development) Regulations 2001-2009 as amended in respect of the LAP3 Distributor Road – Trim Rd to Commons Road ( as outlined in the said report) which was presented to them by Fergal O’Bric, Executive Planner.

The Executive Planner and Senior Executive Engineer responded to any queries raised by the Members.

On the proposal of Cllr S Cassells, seconded by Cllr J Reilly, it was resolved by the Members to adopt the Manager’s Report thereon in accordance with Section 179(3) of the Planning and Development Act 2000-2010 as amended, Part VIII of the Local Government(Planning and Development) Regulations 2001-2009 as amended in respect of the LAP3 Distributor Road – Trim Rd to Commons Road ( as outlined in the said report)

Notice of Question

Question to the Manager – Cllr Jim Holloway

“What is the current situation in relation to commissioning the new Reservoir at Carn Hill Navan and the operation of the extraction/treatment plant at Kilcarn in respect of a number of issues :

1.  a reason why Carn Hill Reservoir is not operational considering that the structural work is complete,

2.  the reason for the delay in the joint operation the reservoir and the extraction/treatment plant at Kilcarn as intended in delivering capacity to Navan and guaranteeing water supply to the surrounding area and villages

3.  apart altogether from the problems associated with the recent weather conditions but considering the fact that residents in parts of Navan, particularly Johnstown, and those living in the wider area and villages have for years not enjoyed the benefit of a secure public water supply, what is the timeframe for the full commissioning of the Carn Hill Reservoir?”
