H. CHECKPOINT PROCEEDURE:

The checkpoint will be conducted on US 51 (milepost 35.5) in Tangipahoa Parish. US 51 at this point, is a two lane roadway with improved paved shoulders for both the north and southbound lanes. Cones, signs, and electronic flares will be used to direct all traffic as it enters the screening area. Both northbound and southbound traffic will be screened. Emphasis will placed on avoiding traffic becoming congested in either direction. This area also has adequate space that is suitable for conducting standardized field sobriety tests. There is sufficient space to park vehicles if arrested subjects wish to have their vehicles parked and locked.

DWI Checkpoint signs will be placed north and south of the detail location as per procedural order. Orange traffic cones, and electronic flares will be utilized to guide motorists through the checkpoint area. Troopers and assigned officers will be stationed to safely direct and assist traffic through the area.

All vehicles entering the checkpoint area will be screened. If traffic volume or other unexpected circumstances prevent screening of all vehicles the on-scene supervisor may direct an alternate screening sequence. If an alternate screening sequence becomes necessary the on-scene supervisor will notify the troop desk sergeant who will note the change in screening sequence in the desk log.

If a driver is found to be under the influence of alcohol or drugs, that driver will be asked to exit the vehicle. A trooper will escort the driver to the designated SFST area, and another trooper will move the vehicle from the roadway to a safe parking location. If the driver of a selected vehicle is found not to be impaired, he/she will be safely directed back onto US 51. If an arrest is made, an Intoxilyzer 5000 will be available on location. In the event the driver refuses to submit to a breath test, the trooper will initiate the No Refusal blood warrant process. Upon receiving the blood warrant authorization from the respective Judicial District, EMS will take the proscribed blood sample which will be processed for packaging by the trooper who witnessed the blood draw so that the sample can be forwarded to the LSP Crime Lab for analysis. All arrested persons will be transported to the Tangipahoa Parish Jail. The checkpoint supervisor will assign one trooper to keep pertinent data as per procedure order.

While the checkpoint is in operation, an observation unit shall standby near the point where vehicles exit the screening area. (If traffic is being screened in both directions, observation units shall be in place to monitor traffic in both directions.) The observation unit shall be responsible for ensuring vehicles move through the checkpoint in a safe manner and provide enforcement support for vehicles that fail to stop as directed at the checkpoint. If a motorist entering the checkpoint refuses to engage officers in conversation, for example by not complying with the officer’s request to roll down his window but communicate by a written message through the closed window, the officer should ensure by cursory visual inspection that the motorist is not in violation of any laws nor is demonstrating signs of impairment. If none of these conditions exist, the motorist shall be instructed to proceed through the checkpoint. The observation unit shall follow the motorist for a short distance as he exits the checkpoint to ensure the driver does not demonstrate any erratic driving conditions that could suggest impairment issues on the part of the driver.

UNDER NO CIRCUMSTANCES WILL ANY DRIVER, WHO IS SUSPECTED TO BE UNDER THE INFLUENCE, BE ALLOWED TO PARK HIS/HER OWN VEHICLE, NOR WILL THEY BE ALLOWED TO DRIVE AWAY FROM THE CHECKPOINT IF THEY ARE OVER THE LEGAL LIMIT (.08g%).
