REGULAR MEETING APRIL 19, 2016

PRESENT: Chairman Kathleen Jasinski, Members Paul Marchese, Paul McCullough, Jeremy Liles, Don Partridge, Gordon Offhaus, and Lou Paganello

ALSO ATTENDING: Bruce Gerould, Steven Mountain, Secretary Brittany Witkop, Dale Banfield for the Waggin Wheel Restaurant, and Megan Hensel for Eric Biscaro - Biscon Corp.

ABSENT: Members Jon Long

Alternate member absent. Full board present.

MINUTES OF MARCH 15, 2016 MEETING

Paul McCullough made a motion to approve the minutes as submitted. Seconded by Paul Marchese. Vote unanimous for approval.

RANDY BEBOUT, TYLIN INTERNATIONAL

Applicant cancelled for tonight, but is expected to meet with our board at a later date regarding a Special Use Permit to allow for a drive thru for a proposed ARBY'S restaurant at 8364 Lewiston Road and site plan review.

ERIC BISCARO/BISCON CORP. - REQUEST TO AMEND SITE PLAN DUE TO NEW CONFIGURATION OF BUILDINGS FOR APARTMENT PROJECT AT 5220 CLINTON STREET ROAD

Megan Hensel reviewed the site plan for Biscon Corp as Mr. Eric Biscaro was not present. The site would be next to the church on Clinton Street Road that was renovated into apartments. Biscon Corp. would like to change the build to patio homes similar to the ones at Clinton Crossings. She referenced the need for handicap accessibility and that tenants want attached garages to park in. These two homes would each have two apartments. Bruce Gerould said the build is in conformance. Steve Mountain did note that the sewer line must be left accessible. Donald Partridge made a motion to approve the site plan keeping the sewer line accessible. Seconded by Gordon Offhaus. Vote unanimous for approval.

DALE BANFIELD/WAGGIN WHEEL RESTAURANT - SITE PLAN AMENDMENT TO INCLUDE OUTDOOR COOKING AT EXISTING RESTAURANT ON 8282 PARK RD.

Mr. Banfield is opening the Waggin Wheel Restaurant to provide Texas-style barbeque. He is asking to have outdoor cooking, but notes the smoke will be well controlled. He has a small charcoal pit for barbecue and a portable smoker. Jeremy Liles made motion to approve outdoor cooking at the Waggin Wheel Restaurant. Seconded by Paul McCullough. Vote unanimous for approval.

TRACY BELLERDINE/GENESEE COUNTY CHAMBER OF COMMERCE - SITE PLAN REVIEW AND SEQR FOR ADDITION TO EXISTING BUILDING AT 8276 PARK ROAD FOR A VISITOR'S CENTER

The Town Planning Board tabled this request to wait for the applicant to be present and review their site plan so that if we have questions there will be opportunity to ask. Jeremy Liles made a motion to table the site plan review and SEQR. Seconded by Gordon Offhaus. Vote unanimous for approval.

LAND SEPARATION FOR PROPERTY OWNED BY ELIZABETH FENTON ON PRATT ROAD

Elizabeth Fenton would like to separate two parcels that lie between Pratt Road and Stegman Road. The first parcel is 16.061 acres (Tax Map #6-1-12.1), which will go to Paul Fenton (son) and the second parcel is 3.113 acres (Tax Map #6-1-13), which is being separated for family purposes. Lou Paganello made a motion to approve separation of the first parcel. Seconded by Paul Marchese. Paul McCullough made a motion to approve separation of the second parcel. Seconded by Jeremy Liles. Vote unanimous for approval of both.

LAND SEPARATION FOR PROPERTY OWNED BY GARY JOHNSON ON ROSE ROAD

Mr. Johnson is requesting to separate two small parcels. The two parcels will be sold and merged with Mr. John Lawrence's parcel (Tax Map #18.-1-90). Donald Partridge made a motion to approve the separations contingent that they be merge into respective conforming lots. Seconded by Paul Marchese. Vote unanimous for approval.

ZONING ENFORCEMENT OFFICER REPORT – BRUCE GEROULD

JEFF PRICE/FAIRGROUNDS OUTDOOR 4-WHEEL OBSTACLE COURSE

Bruce noted that Mr. Jeff Price would like to continue a 4-wheel obstacle course this summer at the fairgrounds. Kathy Jasinski said she will contact him and ask him to present this to our board.

DALE BANFIELD/WAGGIN WHEEL RESTAURANT

Mr. Banfield may request to have outdoor live music which will require a permit.

VERIZON CELL PHONE ANTENNA

Bruce received a call from Mr. Michael Valle on Rollin Circle who noted that although the Verizon Cell Phone Tower is a mile away it is too bright. Bruce will let him know that we can not remedy this situation and he needs to contact Verizon.

TOWN PLANNING BOARD PICTURE

Come prepared on May 3, 2016, for a group picture, so that Teressa Morasco can update the Town of Batavia website.

CHAIRMAN REPORT

Kathy Jasinski reports that tomorrow evening, 4/20/16, at the Town Hall there will be a Comprehensive Plan Meeting from 3 - 5 p.m. and board members are welcome to attend. Our next meeting will be on May 3, 2016, at 6 p.m. and we will be focusing on the Comprehensive Plan.

Gordon Offhaus made a motion to adjourn the meeting at 8:10 p.m. Seconded by Lou Paganello. Vote unanimous for adjournment.
