Dormitory contract for residence

made between, on the one hand, the John von Neumann University, hereinafter:University(10 Izsáki Street, H-6000 Kecskemét, institutional identification: FI 96377, registration number: 834478, taxation number: 15834474-2-03, bank account identification: Hungarian State Treasury 10025004-00336114-00000000, represented by: MrsZita Finta, Chancellor and Mrs Ildikó Borics-Józsa, Head of Dormitories, contact person: Ms Marianna Varga,Dormitory referent), and on the other hand[1]

as tenant residing in the dormitory, hereinafter: dormitory resident, together as contracting parties on the place and at the time indicated below on the following terms and conditions:

  1. Universityensures a place for the dormitory resident in the Student Dormitory in the room No. … from the start of the academic year of 2017/18 (from actually moving in)till the last day of the examination period following the said academic year.The dormitory resident is not allowed to transfer the right for the place and the related services to another person without previous permission and must not sublet the bed provided for his/her use.The dormitory resident is obliged to pay the agreed dormitory fee from the start to the expiry date of the present contract.
  2. The dormitory resident is obliged to facilitate payment for the place and the related basic services – unless the legal regulations require it otherwise – by a set date every month in the amount stipulated for him/her. From the point of payment every month that is begun counts as a full month except when a resident is allowed to move in after the 15th day of a given month. In this case, he/she is required to pay only a half-month’s fee. The dormitory fee for dormitory premises and provided basic services is determined by the University Senate. Dormitory fee for students continuing their education in full-time, state-financed form in the University is HUF 17,500/month, for self-financed, partial state-financed students of the University is HUF 25,000/month, for other higher educational institution and mobility students is 33,000 Ft/month. The monthly dormitory fee must be paid until the 20th day of the given month the latest (except the dormitory fee for September what need to be paid until the 15th day of the given month) through the Neptun Student Administration System. In case a dormitory resident does not meet the payment requirements by the above date, his/her rights as dormitory resident – in line with the Joint Rules of Operation of the dormitories of University (hereinafter: JRO) – can be terminated.Further rules of tuition are detailed in Organizational and Operational Regulations / Academic Regulations for Students / Rules on allowances and fees in Chapter 3, subsection 28-29.
  3. In its dormitories, University provides a general, standard residence place in double rooms. Any other arrangement is possible only by an advance written permission of the dormitory director and the payment of a special procedural fee.

  1. The dormitory resident is required to familiarise him/herself and observe the rules and regulations of the University, with special regard to the JRO and Dormitory Policy as well as the fire, work safety and public hygiene regulations in effect. Any type of fine or penalty levied by the authorities resulting from the violation of the relevant regulations must be paid by the dormitory resident and, at the same time, is interpreted as a breach of the present contract.

  1. The dormitory resident is obliged to regularly clean the room of his/her residence and deliver the rubbish to the designated dump areas.

  1. It is strictly forbidden to draw, paint, scratch with any instrument and pin or stick any decorations on the walls, ceiling, doors and windows or any piece of furniture in the rooms causing them damage. Decorations can be attached to the lattice frames on the walls though.

  1. Any alterations in the rooms are forbidden without previous permission.Damages occurring in the rooms during the time of residence must be compensated by the occupants. Any objects missing must be supplied before the first occupant moves out of the room.

  1. In case of damages caused out of neglect, the compensation payment requested cannot exceed the bimonthly normative support of students.In case of wanton damage the resident is expected to pay the full cost of the repairs. For objects received on accountability the dormitory resident bears full compensation obligation.

  1. When the interests of the University make it necessary, the Chancellor is entitled to call for a compulsory leave for home meaning a temporary vacation of the dormitory. In such a situation the dormitory resident is obliged to vacate his/her room cleaned with personal belongings locked up and give it to the disposal of the University.

  1. The dormitory resident endorses the rights and obligations defined in the JRO including the one which reserves the right for the Chancellor and the Dormitory Student Committee (hereinafter: DSC) to make further obligations affecting all dormitory residents that presently are not included in the dormitory contract.

  1. The cost of external services (TV connection fee, royalty fees, etc.) ordered by the dormitory resident are not taken over by the University.

  1. The present contract does not enter into effect:
a)If the dormitory resident does not sign it when moving in;
b)If the resident does not take his/her place within 8 days following the date set for the start of move-ins (this deadline can be extended on written request but the fee for the given month must be paid all the same);
c)If the dormitory resident has overdue payments on dormitory fees or damage compensation from the previous academic year and by the time of the movein they have not been paid.
13. The present contract becomes void:
a)on its expiry date (article 1);
b)by ordinary terminationdetailed in article 15;
c)if the dormitory residence of the student is terminated due to back-pay after an inefficient notification and investigation of the social situation. The date of dormitory contract termination concurs with the day when the termination decision becomes final;
d)on the day when the decision of the Disciplinary Board becomes final to excludethe student from the use of Dormitory premises,
e)on the day when the dormitory resident is accepted by an another higher education institution’s dormitory;
f)in the event of other cases detailed in state regulations for renting. The date is determined by the cases regulated in the law.
14. The dormitory resident has the right to initiate termination of his/her contract any time during the academic year with a 15-day notice.The dormitory fee must be paid for the time of the notice period as well.
15. The University may terminate the contract with 15 days' notice by ordinary termination
a)for operational reasons;
b)in case of serious breach of other obligations undertaken in the dormitory contract.
16. The decision on termination of the contract can be appealed within 8 days of its receipt with the Chancellor. The appeal submitted has a postponing effect on the vacation of the dormitory building.
17. In case of residence termination the dormitory resident is obliged to move out of the room of dormitory residence within three working days regardless of any further appeal. The dormitory resident must to remove the personal belongings from the room within three working days and settle his/her backlog of debts.
18. For issues not regulated in this contract, the guidelines are found in legal regulations in effect on dormitory residence, the Organisational and Operational Regulations of the University, the JRO and the Dormitory Policy. Judgement of any other dispute arising under the contract will be made by the Court of Justice being assigned according to the University's headquarter based on the decision of the contracting parties.

An annex to this contract is formed by policy and list of furnishings of the room designated for the dormitory resident in question.

The parties agree to sign this contract after due reading and deliberation as one fully expressing their wishes and desires.
