Sample Insurance Language for Landlords to include in lease

A.  Insurance Policies and Limits of insurance Tenant must carry:

1.  General Liability - minimum limit $1,000,000/2,000,000

2.  Tenant’s Legal Liability (Special Perils Form) with limits equal to or greater than the Replacement Cost Value of the Real Property leased to the Tenant

3.  Umbrella Liability - minimum limit $5,000,000

4. Business Automobile Liability, Including Hired & Non-owned Automobiles - minimum limit $1,000,000

5. Workers Compensation (as required by Statute, and if applicable, an endorsement covering the tenant’s liability under the Federal US Longshoremen & Harbor Workers Act, Jones Act, and Defense Base Act) - minimum limit $1,000,000/1,000,000/$1,000,000 Employers Liability

6. Property Insurance covering the Replacement Cost of Tenant’s personal property, and including Business Income/Extra Expense coverage

B. The above policies should include the following:

1. **Landlord, its owners, trustees, officers, directors, members, agents employees, etc** should be added as Additional Insured to all policies (except Workers Compensation)

2. All Policies should include a Waiver of Subrogation in favor of **Landlord, its owners, trustees, officers, directors, members, agents employees, etc**

3. All policies (except Workers Compensation) are written on a Primary and Non-Contributory basis, and any insurance carried by the **Landlord** are non-contributing with these policies"

4. All policies must be written by a carrier with a minimum A.M. Best rating of A - or better, a financial size classification of X or higher, and must be acceptable to **Landlord**

C. Other

1.  There should be hold harmless and indemnification language in the lease in Landlord’s favor only

2.  Certificates of Insurance:

a.  Tenant shall provide to Landlord certificates of insurance complying with all items above, including copies of Waiver of Subrogation and Additional Insured endorsements for Landlord’s review and approval

b.  Certificate of insurance must state not less than thirty (30) days prior notification will be provided to **Landlord** in the event of cancellation, non-renewal or material change in policies

c.  Copies of complete policies may be requested at any time by **Landlord** for review and approval
