AN AMENDMENT TO ORDINANCE 5 OF WRIGHT COUNTY, IOWA TO PROVIDE FOR A CHANGE IN THE PERMITTED USES OF REAL PROPERTY IN AGRICULTURAL DISTRICTS
Be It Enacted by the Board of Supervisors of Wright County, Iowa:
SECTION 1. Purpose. The purpose of this ordinance is to amend Ordinance Number 5, the zoning ordinance for the unincorporated portion of Wright County, Iowa, to provide for a change in the permitted uses of real property in agricultural districts and to promote the public health, safety, comfort, order and general welfare to conserve and protect the natural and man made environment, to secure and provide the social and economic advantages resulting from an orderly, planned uses of land resources, and to facilitate adequate but economical provisions for public improvements, all in accordance with the Wright County comprehensive plan and as permitted by the provisions of Chapter 358A of the Code of Iowa, as amended.
SECTION 2. Amendment. Article VII, Section 700 of Ordinance 5 is hereby amended to add the following, to wit:
.7 Public utility structures and equipment necessary for the operation thereof;
(a) Wind Energy Farms constitute a public utility, if they are connected to a power grid;
(i) The Wright County Board of Adjustment may adopt such provisions and regulations as it deems necessary in regards to any requirements necessary for the issuance of a zoning permit to an applicant proposing a Wind Energy Farm.
SECTION 3. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.
SECTION 4. Severablility Clause. If any Section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any Section, provision or part thereof not adjudged invalid or unconstitutional.
