2018 Garden Lease

In consideration of the sum paid to the Cuba City Community Garden, the City of Cuba City (City) makes the following lease with the undersigned lessee:

  1. City agrees to lease and the lessee agrees to accept the following: The property leased is approximately a 10 foot by 12 foot parcel, designated and identified as Plot Number ______, located on Palmer Street, Cuba City, WI (the property).
  2. The lease shall commence with the growing season in the year 2018 but no earlier than April 28th, 2018, and terminate at the end of the growing season, but no later than October 15, 2018.Plot must be cleaned out by October 15th.
  3. The leased property is to be used for gardening purposes only.
  4. No one will be permitted to use the leased parcel except the lessee, members of the lessee family, or members of an organization or group if the lessee is executing this lease for such. All persons coming onto the property must have a release of liability signed and on file with the City of Cuba City.
  5. The lessee shall keep the parcel free of debris and weeds. Growth should be properly maintained during the lease. If the lessee must abandon a plot for any reason, he/she will notify Bob Jones at608-744-2152. Plots unattended for more than 28 days shall become the property of the City.
  6. At the end of the lease, the lessee shall remove all non-plant material from the parcel, to allow the parcels to be tilled, as well as participate in the fall clean-off of plant materialatthe plot site.
  7. The City shall decide any dispute or disagreement between lessees or with any other lessee of parcels and the decision of the City of Cuba City shall be final.
  8. The lessee agrees that the City of Cuba City shall have no obligation other than to designate the leased parcel. The Cuba City Community Garden members shall not be obligated to preserve or protect any individual lessee’s property. The City shall provide a source of water. The water source will be available at the certain time. Those times will be published in the newsletter. Any loss or damage to products or property or any other loss sustained by the lessee in connection with the use of the leased property shall be the responsibility of the lessee.
  9. Lessee agrees not to plant tall crops where they will shade neighboring plots.
  10. Lessee agrees to pick only their own crops unless given permission by another plot user.
  11. Lessee agrees not to bring pets to the garden.
  12. Lessee shall only tend the garden between dawn and dusk.
  13. Lessee agrees to follow all garden rules and regulations included in the Community Garden Guidelines.
  14. The lessee shall indemnify and hold harmless the City of Cuba City, the property owner, the Cuba City Community Garden and its members, against any liability and expense for any and all claims for injury or damage which may arise in connection with the leased property, or with the use thereof, by any person or organization.
  15. Any violation of the terms of this lease by the lessee shall entitle the City of Cuba City Community Garden to cancel the lease upon three days written notice to the lessee, either delivered or mailed to the address stated; that under such circumstances the lessee will forfeit to the communal garden any produce or products located on the leased parcel; that any equipment or property not removed in said three day period will be considered abandoned and forfeited to the City of Cuba City.
