SUPPRESSION HEARING DEMONSTRATION

FACT SCENARIO

ON SEPTEMBER 1, 2015 R’YL D’YL MCCOY [*YES, THIS IS A REAL FIRST AND MIDDLE NAME], JUVENILE RESPONDENT, WAS IN ATTENDANCE AT SCHOOL APPEARING TO STAFF TO BE UNDER THE INFLUENCE OF SOMETHING. HIS LOCKER WAS SEARCHED BY SCHOOL PERSONNEL AND THEY FOUND A PIECE OF PAPER APPEARING TO BE A CONTROLLED SUBSTANCE, BUT WERE UNABLE TO DETERMINE EXACTLY WHAT IT WAS AND IF IT WAS AN ILLEGAL SUBSTANCE AT THE TIME. UPON LEARNING THAT THE SCHOOL AUTHORITIES WERE HOT ON HIS TRAIL, THE RESPONDENT LEFT SCHOOL DURING SCHOOL HOURS AND DROVE HIS AUTOMOBILE HOMEAT A HIGH RATE OF SPEED FROM CAMPUS. OFFICER GLICK WAS QUICK TO TRACK R’YL D’YL AND WAS ABLE TO FOLLOW HIM TO HIS HOME ARRIVING JUST AS HERAN FROM HIS CAR INTO HIS RESIDENCE LEAVING THE FRONT DOOR OPEN. THE RESPONDENT RAN INTO HIS ROOM AND LOCKED THE BEDROOM DOOR BEHIND HIM. WHEN OFFICER GLICK EXITS HIS PATROL CAR HE HEARS THE RESPONDENT’S MOTHER YELLING AT THE RESPONDENT. OFFICER GLICK HEARS THE RESPONDENT’S MOTHER YELLING AT HIM FOR BEING TRUANT, BEING “ON DRUGS,” AND STATING “I KNOW YOU HAVE YOUR STASH IN YOUR ROOM AGAIN AND THIS OFFICER IS GOING TO FIND IT.” OFFICER GLICK DOES NOT OBTAIN SPECIFIC CONSENT TO ENTER THE HOUSE, BUT UPON HEARING THE WORDS THE MOTHER IS USING ENTERS. OFFICER GLICK FORCIBLY OPEN THE RESPONDENTS LOCKED BEDROOM DOOR, TAKES HIM INTO CUSTODY, SEARCHES THE BEDROOM AND FINDSADDITIONAL ILLEGAL DRUGS (RITALIN, ADDERALL, VYVANSE, INTUNIV, STRATERA PILLS, AND MARIHUANA).AS OFFICER GLICK ESCORTS HER SON OUT IN HANDCUFFS THE RESPONDENT’S MOTHER THANKS HIM FOR TAKING HER SON INTO CUSTODY AS SHE CAN NOW HAVE A FEW NIGHTS OUT ON THE TOWN AND NOT WORRY ABOUT CHILDCARE. AS LITTLE R’YL D’YL IS BEING TRANSPORTED TO THE JUVENILE PROCESSING OFFICE AND AFTER THEY GO THROUGH THE BURGER KING DRIVE-THRU FOR A BURGER, OFFICER GLICK SAYS TO THE RESPONDENT “WHAT WERE YOU THINKING HAVING THOSE DRUGS IN YOUR ROOM?” THE JUVENILE RESPONDS “I DIDN’T THINK ANYONE WOULD FIND THEM SINCE I ONLY HAD THE LSD AT SCHOOL.” THE JUVENILE IS CHARGED BY A HARD-AT-WORK PROSECUTOR TAKING THE CALL FROM OFFICER GLICK AT 2:30AM WHILE HE IS WORKING AN EXTRA JOB. R’YL D’YL IS CHARGED WITH POSSESSION OF A CONTROLLED SUBSTANCE FOR THE PAPER IN THE LOCKER, POSSESSION OF DANGEROUS DRUGS, AND POSSESSION OF MARIHUANA. THE JUVENILES ATTORNEY FILED A MOTION TO SUPPRESS THE EVIDENCE AND THIS HEARING COMMENCES.
