PERMITTED DEVELOPMENT ENQUIRY DECLARATION – PART 9 Class A
Part 9 Class A of the Town and Country (General Permitted Development) Order 2015 – Development relating to Roads, permits:
The carrying out by a Highway Authority—
(a)on land within the boundaries of a road, of any works required for the maintenance or improvement of the road, where such works involve development by virtue of section 55(2)(b) of the Act[1]; or
(b)on land outside but adjoining the boundary of an existing highway of works required for or incidental to the maintenance or improvement of the highway.
I am of the opinion that the development would be permitted development in accordance with Part 9 Class A of the Town and Country (General Permitted Development) Order 2015 and would therefore not require an application for planning permission.
In relation to the above I confirm that:
  • the proposed works are on land within the boundaries of a road and are required for the maintenance or improvement of the road, where such works involve development by virtue of section 55(2)(b) of the Act; or
  • the proposed works are on land outside, but adjoining the boundary of an existing highway, and required for or incidental to the maintenance or improvement of the highway.
Please could Essex County Council as County Planning Authority confirm whether or not the proposed development would be permitted under the terms of the General Permitted Development Order 2015, without the need for express planning permission. I understand that any view received would be an officer opinion only and that any formal decision would be required to be made by the relevant Local Planning Authority, through an application for a Certificate of Lawfulness of Proposed Use or Development
