ENTERPRISE BARGAINING AGREEMENT 1996

1. - TITLE

This Agreement shall be known as the “Festive Poultry Limited Enterprise Bargaining Agreement 1996”, No. AG139 of 1996.

3. - AREA AND SCOPE

(1)The Area and Scope of this Agreement shall be that prescribed in the Food Industry (Food Manufacturing or Processing) Award, No. A20 of 1990 (“the Award”), as amended from time to time, insofar as it applies to employees of Festive Poultry Limited, employed at the production centre at Canning Vale, Western Australia.

(2)This Agreement shall regulate the conditions of employment of approximately 60 employees.

4. - PARTIES BOUND

This Agreement shall apply to and be binding on Steggles Ltd trading as Festive Poultry Limited (“the Company”), theFood Preservers’ Union of WesternAustralia, Union of Workers (“FPU”) and all employees employed at the Company’s operation in Canning Vale, who are members or are eligible to be members of the FPU and who are covered by the Award or any successor thereto.

5. - TERM OF AGREEMENT

(1)This Agreement shall operate from 1 March 1996 and shall expire on 28February 1998.

(2)The parties to this Agreement shall begin negotiations for a new Agreement at least 3 months prior to the expiration of this Agreement.

(3)Following its expiry, the Agreement shall continue to operate until varied by the parties or replaced by another Agreement.

6. - RELATIONSHIP TO AWARD

(1)This Agreement shall be read and interpreted wholly in conjunction with the Award, identified in Clause 3. - Area and Scope, of this Agreement, as varied from time to time.

(2)Where there is any inconsistency between this Agreement and the Award, this Agreement shall prevail to the extent of that inconsistency. Where this Agreement is silent, Award provisions shall apply.

7. - SINGLE BARGAINING UNIT

The parties to this Agreement have formed a Single Bargaining Unit to reach agreement on the terms of this Enterprise Bargaining Agreement.

8. - WAGES

(1)Full Time Employees

The following wage rates are for 38 ordinary hours per week, and shall come into effect on the first full pay period on or after the dates listed below.

(2)Part Time Employees

Part time employees shall receive payment for ordinary hours of work at an hourly rate of one thirty eighth of the appropriate rate prescribed by subclause (1) hereof.

(3)Casual Employees

A casual employee employed by the Company under the terms and conditions of the Food Industry (Food Manufacturing or Processing) Award, No. A20 of 1990, shall be paid one thirty eighth of the appropriate rate prescribed in subclause (1) hereof, and in addition a loading of 20% for all ordinary hours of work.

(4)This Agreement shall not operate to cause any employee to suffer a reduction in an over award payment.

9. - FORTNIGHTLY PAY

The parties have agreed that the payment of wages will be changed from the current weekly pay system to a fortnightly pay system during the life of the Agreement. In order to avoid any hardship, employees shall receive one week’s pay in advance for the final pay period before the implementation of fortnightly pays if so desired. The advance payment will be deducted in equal instalments over the following five fortnights, until the repayment is made in full.

10. - EARLY FINISHING DAY

(1)The early day finish, Friday, will be changed to Thursday. This will ensure a ready supply of fresh product will be available for the beginning of the following week.

(2)(a)The company agrees that in not less than 90% of weeks it will ensure that employees finish on time on the early finishing day, Thursday.

(b)Should this not be achievable consistently, steps will be taken to ensure the early finish is achieved consistently.

11. - GRIEVANCE PROCEDURE

(1)Any question, dispute or difficulty arising from this Agreement shall be dealt with in accordance with the following procedure:

(a)The matter shall first be discussed between the employee affected and the appropriate supervisor. The employee may choose to be represented by the union delegate.

(b)If not settled the matter shall be discussed between the employee, an accredited representative of the union and the appropriate representative of the Company.

(c)If not settled the matter shall be discussed between an official of the union and an appropriate representative of the Company.

(2)While the matter in dispute is being discussed in accordance with the procedure, as prescribed in subclause (1) hereof, work shall continue and the status quo as applying before the dispute shall be maintained. No party shall be prejudiced in relation to the final settlement by the continuance of work in accordance with this clause.

(3)It is open to either party at any time to seek the assistance of the Western Australian Industrial Relations Commission in resolving any dispute.

Provided that with effect from 22 November, 1997 it is required that persons involved in the question, dispute or difficulty shall confer among themselves and make reasonable attempts to resolve questions, disputes or difficulties before taking those matters to the Commission.
