AN ACT relating to airports.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

Section 1. KRS 183.8811 is amended to read as follows:

(1)An air board may utilize electronic equipment or such techniques and procedures as it determines necessary to insure the safety of the public on airplanes and on airport property from persons using or attempting to use bombs, explosives, firearms or other deadly weapons. When a bomb, explosive or other deadly weapon is detected on airport property, or there is good reason to suspect that an individual may have such a device or weapon that he is attempting to conceal from proper authorities, a law enforcement officer, airline employee or air board agent or employee may take prudent and necessary precautionary measures to protect individual lives and property.

(2)An air board shall not use subsection (1) of this section to prohibit, regulate, control, or attempt to prohibit, regulate, or control:

(a)A peace officer from carrying a firearm, whether loaded or unloaded, or other concealed deadly weapon as permitted pursuant to KRS 527.020;

(b)A person who holds a concealed deadly weapon license issued pursuant to KRS 237.110 from carrying a firearm, whether loaded or unloaded, or concealed deadly weapon in any area authorized by KRS 237.110 or 527.020;

(c)A person from carrying a firearm, whether loaded or unloaded, or other deadly weapon openly on airport property;

(d)A person from possessing a firearm, whether loaded or unloaded, or other deadly weapon in a vehicle as authorized by KRS 237.106 or 527.020;

(e)A person from using a firearm or other deadly weapon in lawful self-defense or defense of another person as authorized by KRS Chapter 503; or

(f)A person from carrying an unloaded firearm encased in a locked case for transport on an aircraft in compliance with federal law.

(3)An air board may prohibit the carrying or possession of firearms or other deadly weapons only in an area of the airport in which federal law or federal regulation prohibits the possession or carrying of a firearm or other deadly weapon.

(4)With regard to matters specified in subsection (2) of this section an air board shall be subject to the provisions of KRS 65.870.
