TUSKEGEE UNIVERSITY TAILGATING AGREEMENT

Tuskegee University is referred to as “TU”
1. Tailgating Fee. Licensee shall pay the sum specified, in full, upon the signing of this Agreement, are applicable thereto.
RV – Homecoming 200.00 Regular Tailgater – Homecoming 150.00
RV- Other Home games 125.00 Regular Tailgater – Other Home games 100.00
RV – Season 400.00 Regular Tailgater – Season 300.00 (parking incl.)
2. Tailgating Rights. Licensee shall be entitled to the use of a designated space in the Stadium during “Game Periods” only. “GamePeriods” shall mean the time period commencing 5 hours prior to and terminating 3 hours following the conclusion of each homefootball game. Licensee shall have no right to enter orremain in the stadium at any other times. Exception: Homecoming RV’s shall be permitted to arrive the Wednesday prior to the game after 7:00pm and shall depart on the Monday after the game by 9:00 am.
3. Permitted Vehicles. The parking rights granted herein shall be restricted to the use of an automobile, minivan, conversion van, pickup truckor utility truck not greater than 18 feet long, 10 feet high and 8 feet wide (a “Permitted Vehicle”).
4. Tailgating Spaces. Prior to the commencement of the Game Period, Licensee shall be provided with a “Permit”, which shall allow tailgating for the Licensee. No vehicle shall be permitted to enter the stadium without a Permit, which shall be clearly displayed. Tailgaters shall park in the designated parking lot.TU may tow away, or cause to betowed away, at the expense of the licensee, any permitted vehicle parked in a space other thanthat designated by TU. Any permitted vehicleremaining in the stadium after a Game Period may be towed away at the expense of the Licensee.
5. Rules and RegulationsNo signs shall be placed on or near aspace without the prior approval of TU. Trash shall be deposited in dumpsters provided at the stadium or shall be removed from the stadium by Licensee. Licensee agrees to abide by such other rules and regulations asmay be established from time to time by TU relating to the use of the Permit and the stadium.
· Tailgaters are responsible for their own supplies: including table, chairs, and generators.
· Tailgaters must have a fire extinguisher.
· All tailgaters must pre-purchase game tickets before entering the stadium.
· Tailgaters are allowed to have one tent no larger than 12’x12’.
· Tailgating parties shall observe the University’s no alcohol and drug policies.
· Golf carts and ATV’s are not permitted on campus.
· No tailgaters are permitted to sale unauthorized merchandise or food.
6. Termination of Tailgating Rights. TU reserves the right to terminate this Agreement, and Licensee’s right to the use of the stadium, if the behavior of Licensee, or Licensee’s guests, is deemed to be unacceptable by TU, in its sole discretion. In the event ofsuch termination, the tailgating fee is non-refundable.
7. Property Damage or Personal Injury. Licensee acknowledges that its use of the stadium shall be at its sole risk without any obligationor responsibility on the part of TUother than to make the designated tailgating space available to Licensee as provided for in this Agreement.
TU, shall not be liable for loss of or damage to a vehicle, or its contents, by reason of fire, theft,collision or other cause, or for death of or injury to Licensee or Licensee’s guests. TU assumes no responsibility for the security of Licensee’svehicle, or for the conduct of any other person using the stadium. Licensee agrees to indemnify and save harmless TU
from and against all loss, damage or injury to any person (including loss of life) or property which may arise or be claimed to have arisen asa result of or in connection with the use of the stadium by Licensee.
8. Entire Agreement. This Agreement constitutes the entire agreement between TU and the Licensee, and there are noagreements, conditions or understanding, either oral or written, between them other than those set forth herein.
9. Binding Effect. Upon signature of this Agreement by Licensee, together with payment of the balance of the parking fee provided for inSection 1 above, and upon the counter-signature of TU, this Agreement shall become effective and binding upon the parties, their legal
representatives, heirs, successors and assigns.
