F.O.B.ORIGIN,GOVERNMENTARRANGEDTRANSPORTATION(OCT2013)

(a)Definitions.

(1)"GovernmentArrangedTransportation"meanstheGovernment isresponsiblefor transportation costs,providingthecarrier,andschedulingtheshipmentpickupcontingentupon correctContractornotificationinVSM.

(2)"VendorShipmentModule(VSM),"formerly knownastheDistribution Planningand· ManagementSystem(DPMS),isaDefenseLogisticsAgency(DLA)web-baseddistributionand transportationsystemavailabletoDLAContractorsforthepurposeofobtainingcurrent shipping addresses,two-dimensionalbarcodedshippinglabelsinaccordancewithMilitaryStandard (MIL­ STD)129P,billsoflading,packinglists,andothershippingdocumentation.VSMreplacestheneed fortheContractortocontacttheDLAtransportation officepriortoshipping,whendirectedin DLAcontracts. Referto47.305-8-90andclause52.247-9011forVSMpolicy.

(b)TheContractorshall –

(1)NotifytheGovernmentwhenreadytoshipmaterial. TheContractorshallusetheVendor ShipmentModule(VSM)tonotifytheGovernmentoftheavailabilityofitemstoship.The Governmentcantakeuptotwo fullbusinessdaystoscheduletheshipment,andpick-upshould occurwithinfivebusinessdaysoftheContractor'snotification. TheContractorshallplanfor sufficienttimeforschedulingtheshipment andstandardground transportationforitsmaterial to arriveatthedestination by theCDD.

(2)Addressspecialaccommodations –

(i)Orderspecifiedcarrierequipment whenrequestedbytheGovernment;or

(ii) If not specified,orderappropriatecarrierequipment notinexcessofcapacityto accommodateshipment;

(3)Delivertheshipment ingoodorder andconditiontothecarrier,andload,stow,trim,block, and/orbracecarloadortruckload shipment (whenloadedbytheContractor)onorinthecarrier's conveyanceasrequired bycarrierrulesandregulations;

(c)Responsibilityforsupplies-

(1)Contractorisresponsibleforanylossand/ordamagetothegoods:

(i)Occurringbeforedeliverytothecarrier;

(ii)Resultingfromimproperloading,stowing,trimming,blocking,and/or bracingofthe shipment,ifloadedbytheContractoronorinthecarrier'sconveyance.

(2)PerFAR 52.246-16-Responsibility forSupplies,titletothesupplies underthiscontract shallpasstotheGovernment uponformalacceptance,regardlessofwhenorwherethe Governmenttakesphysicalpossession,unlessthecontract specificallyprovidesforearlier passageoftitle. TheContractorshallnotbeliableforlossordamagetosuppliescausedbythenegligenceof officers,agents,oremployeesoftheGovernment,includingbutnotlimitedtotheGovernment's designatedcarrier,actingwithinthescopeoftheiremployment.

(3)Paragraph(c)(2)aboveshallnotapplytosuppliesthatsofailtoconformtocontract requirementsastogivearightofrejection. Theriskoflossofordamageremainswiththe Contractorforallnon-conformingsuppliesreceivedatthefirst-destinationlocationuntilcureor acceptance. If instructedbytheContractingOfficer,theContractorshallreplace,repair,or correct thosesuppliespromptlyattheContractor'sexpense,includingbutnotlimitedtoshipping coststoretrieve thenon-conformingsuppliesandcoststoshipconformingsupplies.
