TERMS AND CONDITIONS : - The blank tender forms are available at the mahadiscom site at during the sale period. Same should be down loaded from the site. The EMD & cost of Tender will be accepted in cash up to 13.00 Hrs. on15.10.07 or by Demand draft drawn in favor of the Superintending Engineer MSEDCL Dhule payable at Dhule. Tender submitted without EMD & cost of Tender will not be considered. The cheque will not be accepted.. Cost of blank tender form (non-refundable):-Rs.1000/-(Rs. One Thousand) should be paid in cash at Circle Office Dhule or by DD drawn infavor of the Superintending Engineer MSEDCL Dhule payable at Dhule. The photo stat copy of money receipt or Original DD should be attached to the Tender form at the time of submission of Tender form. 2) Date of Sale: From 01-10-07 to 15-10-07 3) Last date of submission 15-10-07Up to 13.00 Hrs. 4) Date of opening: 15-10-07 @ 15.00 Hrs. if possible. INSTRUCTIONS TO TENDRER.

  1. Sealed and super-scribed tenders are invited from reputed experienced registered Electrical Contractors of the Central, State, Public Works Department Military Engineer Services, Housing and State Electricity MSEDCL etc. and from those who have executed works of like nature. The prevailing scheduled of rate for Erection, Testing and Commissioning of 11 KV bays along with breaker errection is attached herewith. The rates are to be quoted on percentage basis of this schedule rates. The overall percentage should be quoted and not on separate items. The tender documents should be submitted in two envelopes. The envelope No.1 will contain the required documents for qualifying the tender. The list is attached separately. The envelope No.2 will contain tender document quoting the rate. The envelope No.2 will not be opened if tender is not qualified and as per documents submitted in envelope No.1.
  1. The scope of work covered under this tender shall comprise of Erection, Testing and Commissioning of 11 KV breakers, bays under DHULE O&M Circle.
  1. The Tenderer will have to deposit an amount 1 % of tender estimated amount towards Earnest Money Deposit (EMD) by Demand Draft of any Nationalised Bank payable at Dhule in the name of the Superintending Engineer, MSEDCL, O&M Circle, DHULE or in cash before submission. Cash for EMD will be accepted during office hour and no interest will be paid on EMD. Tender submitted without EMD will not be considered.
  1. Tenderer must return the Tender form together with the specifications and the rates duly filled in and other schedule duly signed. Any tender not bearing the signature of tenderer on all the documents accompanying the tender is liable to be rejected. The tenderers shall also duly filled in the ‘PARTICULAS OF TENDERS’ and submit the connected documents with their tenders.
  1. The tender duly completed, sealed and super scribed with the Tender No. and EMD details on the face of cover will be accepted up to15.10.07 up to 13.00 Hrs.. and will be opened on the same day at 15.00 Hrs. if possible in the said office in presence of tenderer or their representative who wish to remain present.
  1. It shall be definitely understood that the MSEDCL does not accept any responsibility for the correctness or completeness of the schedule for given part and this schedule is liable to alterations by omissions, deductions or addition in the item or quantities at the discretion of the Superintending Engineer or his authorized representative and the contractor would be bound to execute all the quantities actually ordered / encountered during execution at the corresponding tender prices.
  1. All corrections and insertions should be initiated by the tenderer.
  2. Tenders documents which do not fulfill any or all the conditions or are found incomplete in any respect are liable for rejection.
  1. The undersigned reserve the right to accept or reject any part or all tenders without assigning any reasons. Further, the undersigned reserve the right to bifurcate the tender orders and work to more than one contractor.
  1. No tender will be considered for acceptance unless it accompanied by the copy of latest income Tax Return submitted.
  1. The MVAT tax on material or on transfer of property in goods involved in the execution of work contract or any other tax on raw material or on furnished and fabricated material or works shall not be separately paid as an addition to tender rates by the MSEDCL. The rates for the several terms of work indicated in attached schedule are deemed to include all local and general taxes, MVAT service tax, excise duty etc. royalties and any other incidental charges payable by the contractors at any instant of works. The contractor will be responsible for payment of such taxes and / or filing their returns.
  1. Income tax will be deducted from the contractor’s bill at the prevailing to applicable surcharge thereon of the gross value of the bill as per instructions laid down in Govt. of India’s notification unless the necessary exemption certificate from the Income Tax Department Authorised for the purpose is produced well in time.
  1. Tenderer must have been registered with provident fund department and P.F. Registration No. and attested copy of the same must be produced. If he is not liable for P.F. registration then such certificate from concern authority should be attached.
  1. Any government taxes as per rules / status should be borne by contractor such as work contract tax etc. No payment should be made by MSEDCL.
  1. These instructions to Tenderer shall also form part of the contract.
  1. The contractor shall make his own arrangement for the water required for constructions.
  1. The MSEDCL’s material will be supplied at the working site maximum up to the radial circumference of 5 Km. From the work site. Contactor on his own shall carry out transportation of other material required for constructions.
  1. The contractor will have to pay the electricity duty for the electrical energy consumed for Erection, Testing and Commissioning of sub station.

GENERAL CONDITIONS OF CONTRACT

  1. The original tender booklet downloaded from mahadiscom site shall alone be accepted as a valid tender forsubmission.
  1. All works shall be measured net by the standard measurements and according to the rules and customs and usual method used in MSEDCL and more particularly as mentioned in the item-wise detailed technical specifications contained in these tender documents.
  1. While placing order for Erection, Testing and Commissioning of 11 KV breakers, bay at various substations preference will be given to those who have wide experience of the work. The contractor who have already been allotted the work of Erection, Testing and Commissioning of bays, sub station works from this office, have not completed so far may not be considered.
  1. All tenderers except and unless exempted in writing by Superintending Engineer concerned shall accompany a solvency certificates from the Revenue department concerned within those justification and tenders resides or a bankers certificates of his financial stability.
  1. The work should be carried out within 3 (Three) months from the date of handing over of site and material.
  1. If it is found that quality of work as well as performance is found unsatisfactory the contract is liable for termination without giving any notice and at the entire risk of contractor the security deposit paid in case shall be forfeited.
  1. The contractor should not entrust the work on sub contract transfer or assign the contract or any part thereof to third party, in case if it is not followed, it will be treated as breach of contract and will be terminated at contractor’s risk and cost.
  1. The materials to be supplied by the MSEDCL are specified in respective schedule attached to tender documents. The rest of material shall be arranged by the contractor and it should be as per IS Standard and should get approved from MSEDCL’s authorized representative, before its use, with submitted necessary documents e.g. such as test certificate of material wherever applicable required at the discretion of S.E.(DHL), DHULE.
  1. The contractor should have his workman, tools and tackles required to carryout the job. The workers employed for the job should be well conversant with the work. In case of any accident to workers or outsiders the total responsibility lies with the contractor.
  1. In case of the damages / loss to the MSEDCL’s material, receipts an appropriate cost of the same will be recovered from the contractor.
  1. BILLS :-The bills should submitted in triplicate to the concerned Engineer in charge of Division for recording measurements and for onward transmission to Superintending Engineer for payment. The first bill will be paid after completion of 50% or more work & Second (final) bill will be paid after completion of work in all respect.
  1. In case work is not fully carried out by the contractor the MSEDCL will get work done through some other parties and the expenditure incurred; plus 15 % supervision charges and rate in difference for which will be recorded from the contractor’s bill / security deposit that failed to execute the work order.
  1. In case the contractor failed to carry out the work in stipulated time penalty at the rate 1% per delayed week or part thereof subject to maximum 10 % of the contract value of work order will be recovered from the bill.
  1. The contract or any part thereof shall not be subject to change without the permission of accepting authority.
  1. The contractor shall be responsible for and shall pay all compensation to his Workman payable under the workman compensation Act 1923 (vii of 1923) (herein after called the said Act for injuries caused to workman). The company will not accept any liability in this regard.
  1. The contractor shall comply with all the laws and statutory regulations dealing with employment of labour such as payment of wages Act 1936, the minimum wages Act. 1038. The workman compensation Act. 1923, the contractor labour (Regulation and abolition) Act ) 1970, the employee liability Act 1938, the Industrial dispute Act 1947, the maturity benefit Acts 1961 etc. in the employment of this labour and obtain license, wherever required and maintain all the required and prescribed records in this connections. And will be responsible for any matter whatsoever with Govt. judicial authorities.
  1. Orders executed should be attached with performance certificate.
  1. Material and equipment used should be of very high quality assuring total reliability after completion of work.
  1. List of equipment and T & P owned by Contractor should be attached.
  1. They should quote their MVAT Registration under Works Contract, PAN No. and P.F. code account No. allotted by P.F. Commissioner.
  1. They should submit solvency certificate of tender estimated amount from their banks.

TERMS AND CONDITIONS.

I)WORKS :

a) The detailed work order/s will be issued by the concerned Executive Engineer including specific time limit for the execution of work order.

b)The contractor has to pay 10 % of the contract value towards security deposit.

c) The location will be decided and shown by the representative of concerned Executive Engineer / Sub Divisional Officer and the work should be executed as per the MSEDCL’s approved method of construction and approved drawings only.

d) The inspection fee for inspection of the lines by the Govt. Authorities will be borne by MSEDCL, however, the defects pointed out by the Electrical Inspector are to be rectified by contractor. No extra payment will be allowed for the said rectification.

e)The rate of extra item, not incorporated in the schedule of rates, executed by the contractor due to exigency of work, on the demand of Executive Engineer / Sub Divisional Officer will be decided by Superintending Engineer of concerned Circle.

f) Any Govt. taxes as per rules / status should be borne by the contractor.No payment should be made by the MSEDCL. Only income tax at source will be deducted by the MSEDCL and arranged to be paid to the Income Tax Authorities. Also filling of returns of taxes to respective authorities will be carried out by contractor.

II)BILLS, MEASUREMENTS, PAYMENTS :

a)The authorized representative of the MSEDCL and the Contractor shall take measurement of work completed jointly. The MSEDCL will give one week advance intimation to the contractor for taking the measurements and if the contractor of has representative fails to join the informer, he will take measurements as correct and will be binding on the contractor.The measurements should be recorded in the measurement book by the concerned engineer in his own hand writing on the spot. First bill shall be submitted after completion of 50% or more work of order value for payment.

b) The work is to be carried out as per sanctioned estimate / work order. If there is any change in quantities, the reason for the same should be mentioned and estimate should be revised accordingly with approval of the Competent Authority.

c)No concreting should be made in absence of MSEDCL’s representatives. The account for cement supplied by the contractor shall tally at the time of final bill. The MSEDCL’s representative should certify the account of Cement and other material at the time of settlement of Bill.
