RULES AND REGULATIONS

General

  1. Owners are responsible for checking their units regularly and reporting any exterior or common area problems to the Broad Street Trails management company.
  2. A current owner’s information sheet must be on file with the management company for emergency purposes. Owners are also encouraged to leave a key with a neighbor or the management company in case of emergencies if they do not have a property manager who can provide access.
  3. Owners are responsible for the actions of their renters. Rental agents should be provided a copy of the Rules and Regulations for distribution with rental contracts.
  4. Vacant units should have water turned off to prevent leaks and the thermostat should be kept no lower than 65 degrees in the summer and 55 degrees in the winter. This will help reduce mildew growth during high humidity and freezing pipes during extreme cold weather. Hot water heaters should be turned off if vacant for longer than one week.
  5. Residents should avoid making or permitting loud or objectionable noises and shall not operate musical instruments, radios, television sets, etc after 10:00pm in a manner that disturbs other occupants. Noise disturbances should be reported to the local police department. Community quiet hours are considered 11:00 pm to 7:00 am.
  6. Firearms may not be displayed or discharged on common property other than to transport lawfully owned firearms to and from vehicles. Fireworks are prohibited within the community.
  7. No solicitation within the community.
  8. All trash shall be put in plastic bags, securely tied, and placed in the available dumpster. All rubbish, trash, and garbage shall be regularly removed from the unit and not allowed to accumulate. No items may be stored for removal for any length of time on patios or common areas. Boxes should be flattened. All bulk items or those not fitting within the container are the responsibility of the residentto remove the items from the premises.

Building Exterior

  1. All windows should have window treatments which are to be kept in good condition.
  2. Patios should not be used for storage at any time. Acceptable front porch items are potted plants that are maintained throughout the year by the resident or a small bench/chair that does not prohibit safe ingress/egress in the event of an emergency. Indoor furniture is prohibited from either patio.
  3. Clothes lines are permitted as long as they are not visible for any view from another unit, street, or adjacent property. Laundry hung must be lower than the back porch wall.
  4. Signs are prohibited, excluding a profession security sign not to exceed one foot by one foot in size or a professional “for rent” or “for lease” sign not to exceed two feet by two feet in size. A political sign is permitted in accordance with state law, but must be removed within 24 hours of the given election. Each unit is limited to ONE sign per lot at any given time and it must be located within two feet of the building or it will be discarded at the owner’s expense.
  5. There will be no construction which changes the exterior appearance or erection of outdoor modifications such as fences without first requesting and obtaining written approval of the Board of Directors. All approved modifications are the responsibility of the owners to maintain.
  6. No linens, cloths, clothing, curtains, rugs, mops, brooms, or any other articles shall be shaken, hung, or displayed from windows, doors, fences, or other common areas.
  7. Holiday decorations shall be removed within 1 week of the holiday. Winter holiday decorations must be removed by the 1st week in January of the following year. No decorations may be placed on common property or be mounted to the building structure in any way.
  8. Owners are responsible for the upkeep of all glass surfaces and storm doors as well as rear maintenance of the landscaping in the rear of the unit. The Board, at its discretion, is able to determine what is an “eye sore” and require compliance of the owner.
  9. Satellite dishes must be placed behind the unit and not visible from the front of the unit. Dishes may not be attached to the building in any way. Antennas are prohibited.

Common Area

  1. Personal property except for vehicles, is strictly prohibited from being stored, kept, or allowed to remain on any portion of the common property. Items will be discarded at the owner’s expense.
  2. Open common areas may not be used for games such as baseball, football, and soccer. Roller and board skating and scooters are not to be used within the community. Basketball hoops are not permitted.
  3. Landscaping changes in the front require written approval from the Board and are the responsibility of the owner to maintain.
  4. Yard sales, flea markets, or similar activities are not permitted.

Safety

  1. The use of gas grills is strictly PROHIBITTED and may not be kept anywhere on the premises. Charcoal and electric grills are allowed providing charcoal grills are used 10 feet from the building. Grill are only allowed in the rear of the units and should not be used on sidewalks or parking areas. No open flames or bon fires are permitted.
  2. NO flammable materials are to be stored within the premises. Examples of prohibited items are, but not limited to: gasoline, kerosene lamps, charcoal, lighter fluid, and paint cans. Electric space heaters should only be used under careful observation.
  3. All units should have working smoke detectors.

Vehicles

  1. Each unit has two assigned parking spaces in front of the unit. Owners are required to park in their assigned spaces only and not in another resident’s space or in guest parking.
  2. No car shall be left in guest parking for longer than three days without the written consent of the Board.
  3. No double-parking or parking in unmarked areas at any time.
  4. Boats, trailers, trucks over ¾ tons, campers, buses, or any other recreational vehicles not mentioned here may not be parked within the community. Vehicles with tools/ladders protruding and any over 20 feet in length pose a safety hazard and are also prohibited. Violators are subject to tow.
  5. Unlicensed or inoperable vehicles are prohibited on the premises at all times, along with oversized, unconventional, loud, or unsightly vehicles. Violators are subject to tow.
  6. Commercial vehicles are not to be kept on the property by residents. Maintenance vehicles are permitted by hired contractors only and may not be stored onsite for any length of time.
  7. Car washing and vehicle maintenance is prohibited. Tire changes and battery charges are the only exception to this policy.
  8. Moving vans are permitted to park for a maximum of 24 hours to load and unload furniture, but must adhere to all other restrictions.

Pets

  1. Ownersmay keep no more than 2 “ordinary” house pets within the unit. Ordinary is defined as dogs, cats, caged domestic birds, hamsters, gerbils, and guinea pics, aquarium fish, small turtles/tortoises, domesticated rabbits, and creatures normally maintained in an aquarium or terrarium. “Unusual” pets includeany animals not listed above.
  2. Pets are permitted only as long as they are NOT kept, bred, or maintained for commercial purposes.
  3. Pets must be kept within the confines of the owner’s lot.
  4. All animal waste must be picked up immediately and properly disposed of. Animals should be walked away from shrubs and buildings.
  5. Pets may not be tethered nor enclosed in any outdoor container for any length of time, other than for transport purposes to and from the vehicle.
  6. When outdoors, animals must remain on a leash.
  7. The feeding of stray animals is prohibited.
  8. Excessive animal noises creating a nuisance are not permitted.
  9. Dog houses are permitted only on the back porch when the property is fully enclosed by a fence.
  10. All pets must have and display, as appropriate, evidence of all required registration and inoculations.
  11. Pet owners are responsible for any property damage, injury, or disturbance their pet may cause or inflict.
  12. No owner shall inflict or cause cruelty in connection with any pet.

Damages

  1. Any damages to the common elements or property caused by a unit owner, renter, or guest shall be repaired at the expense of the unit owner involved. All air conditioning, plumbing, and water leaks must be repaired immediately to avoid damages to other units.
  2. Broad Street Trails maintains a master insurance policy on all buildings and common areas. Any applicable insurance deductible will be the responsibility of the party liable for damages. It is the owner’s responsibility to ensure their unit is properly insured for all personal property, appliances (including heating and air systems), and unit upgrades, and any other general liability they may see fit.

Complaints

Complaints should be sent in writing whenever possible. Nuisance complaints such as noise or animals will not be accepted unless in writing.

Resolution

The Association shall have the power, acting through its Board of Directors, to assess charges against any unit owner for any violation of the Declaration, By-Laws, or Rules and Regulations. Before any such charge may be assessed, the unit owner shall be given the opportunity to be heard and to be represented by counsel before the Board of Directors. Notice of such hearing shall be at least 14 days in advance thereof, be hand-delivered or mailed by registered mail or United States mail, return receipt requested, to such unit owner at the address which the unit owner has designated in writing; if no such aggress has been so designated, at the address of the unit of such owner.

Notice of Right to Voluntary Mediation

Pursuant to Section 7A-38.3F of the North Carolina General Statutes, all members are hereby informed that you have a right to initiate mediation pursuant to the terms of the statutes to try to resolve a dispute with the Association. Both the homeowner and the Association must agree to mediate the dispute, and each side is responsible for splitting the cost of the mediation, including payment of a professional mediator. The mediation process is an opportunity to reach an agreement to resolve a dispute- neither side gives up there right to go to court to have a judge resolve the dispute if the parties are not able to reach an agreement through mediation. The specific process to initiate voluntary mediation is outlined in Section 7A-38.3F of the North Carolina General Statutes.
