IV. Introduction

Child protection is the process of protecting individual children identified as either suffering, or likely to suffer, significant harm as a result of abuse or neglect. It involves measures and structures designed to prevent and respond to abuse and neglect.

Child abuse involves acts of commission and omission, which results in harm to the child. The four types of abuse are physical abuse, sexual abuse, emotional abuse and neglect.Althoughchildrendonothaveaconstitutionalrighttoasafehome,apermanent,stablefamily,orqualitycare,significantstrideshavebeenmadetobetterthelivesofchildren.Therightofastatetoensurethewelfareofthechildrenwithinitsboundariesstemsfromtheancientconceptofparenspatriae,whichmeans"thefatherofhiscountry,"andwasusedtodescribetherelationshipbetweenakingandhissubjects.Today,thisrightislimitedbytheparents'legalrighttobefreefromgovernmentintrusionintheraisingandrearingoftheirchildren.Thestate'sinterventionisjustified,however,ifaparentisnotlivinguptohisorherresponsibilitiesorwhenachildisendangered,neglected,orabused.Thecourtsmaythenplacethechildintemporaryfostercareandrequiretheparenttogetassistancetoremedytheproblem,ormayterminatetheparent'srightstothechildifthatisfoundtobeinthebestinterestsofthechild.

V. Scope and Limitation

These policies shall cover all pupils from kindergarten to Grade Six, Teachers, and School Head and to those who were connected in the school.

VI. Definition of Terms

1.  Bullying - refers to any severe or repeated use by one or more students of a written, verbal, or electronic expression or physical act or gesture or any combination hereof, directed at another student that has the effect of actually causing or placing the latter in reasonable fear of physical or emotional harm or damage.

2.  Child – refers to any person below eighteen (18) years of age or those over but are unable to fully take care or protect themselves from abuse, neglect, cruelty disability or condition (R.A. 7610).

3.  Bully – refers to any student who experiences the acts of bullying or retaliation as defined by the Act or this IRR.

4.  Students – refers to a person who attends classes in any level of basic education, and includes a pupil or learner as defined in DepEd Order No. 40, S.2012.

5.  Neglect - occurs when an adult fails to meet the young person’s basic physical and/or psychological needs, to an extent that is likely to result in serious impairment of the child’s health or development. For example, failing to provide adequate food, shelter and clothing, failing to protect from physical harm or danger, or failing to ensure access to appropriate medical care or treatment.

Signs of Abuse

1. Unexplained or suspicious injuries such as bruising, cuts or burns, particularly if situated on a part of the body not normally prone to such injuries.

2. An injury for which an explanation seems inconsistent.

3. The young person describes what appears to be an abusive act involving them.

4. Another young person or adult expresses concern about the welfare of a young person.

5. Unexplained changes in a young person’s behavior e.g. becoming very upset, quiet, withdrawn or displaying sudden outbursts of temper.

6. Distrust of adult’s, particularly those whom a close relationship would normally be expected.

7. Difficulty in making friends.

Signs of bullying include:

1. Behavioural changes such as reduced concentration and/or becoming withdrawn, clingy, depressed, tearful, emotionally up and down, reluctance to go training or competitions

2. An unexplained drop off in performance

VIII. Duties and Responsibilities of Faculty & Staff

1. Ensure the institution of effective child protection policies and procedures and monitor compliance thereof;

2. Ensure that the school adopts a child protection policy, organize and convene Child Protection Committee (CPC) for the school;

3. Conduct the capacity building activities for the members of the CPC and Guidance Counselors/Teachers;

IX. Functions of the School Child Protection Committee

1.  Initiate information dissemination programs and organize activities for the protection of children.

2.  Establish a system for identifying students who may be suffering from significant harm based on any physical, emotional or behavioural signs.

X. Interventions

1. Creation of board signages of the rights of every child based on Presidential Decree No. 603 for public awareness to be posted on different parts of the school/ barangay.

2. Conduct seminar/ workshop on the rights of a child and responsible parenthood to all the parents of Lake Lahit Elementary School for their own welfare and awareness.

3. Integrate small group sessions/ discussions on positive peer relationships among pupils in different subject areas.

4. Call the attention of the Barangay Officials in maintaining safety and security for a peaceful community with the help of education sector.

5. Provide activities promoting collaborative learning and teamwork like scouting for socialization and gaining friends.

XI. Policies

1. No saying of foul or vulgar and bad words with peers.

2. Avoid exaggerated physical contacts with peers.

3. A pupil especially on the higher grade level shall not intimidate, harass, and bully other pupils through words and actions.

4. School Personnel work in an open environment (e.g. avoiding private or unobserved situations and encouraging open communication with no secrets)

5. Go to school regularly to decrease the number of absenteeism cases.

6. School Personnel are not allowed to use sticks in teaching that may lead to physical injuries.

7. Promote healthy competition in the class/ school to avoid misunderstandings and conflicts.

8. Avoid making sexually suggestive comments to a young person, even in fun.

9. Prevent engaging in rough, physical or sexually provocative games, including horseplay or other activities in class/ school.

10. Avoid bringing/ holding sharp objects like barbecue sticks, small knives, nail cutter knives, etc. to prevent physical injuries/ abuse.

Procedures

XII. Referral Mechanism System

The school head or the SCPC and the CODI may refer the victims and the bully first to their classroom adviser, and then if the problem is unresolved refer it to the school guidance. If the case was not solved refer it to the school principal. The school head shall notify the women and the Children’s Protection Desk (WPCD) of the local Philippine National Police, if he believes that appropriate criminal charges may be pursued against the bully or offending pupils.

XIII. Reporting Mechanism

In all cases where a penalty is imposed on the bully or offending pupils the following will follow on reporting mechanism.

a.  The student and the parents and guardians shall be informed of the complaint in writing;

b.  The students shall be given the opportunity to answer the complaint in writing, with the assistance of the parents/guardian.

c.  The decision of the school head shall be in writing, stating the facts and the reasons for the decisions.

d.  The decision of the school head maybe appealed to the District Office as provided in existing rules of the Department.

XIV. Intervention

1.  Programs such as counseling life, skills, training, education and other activities that will enhance the psychological, emotional, psycho-social well - being of both the victim and the bully.

2.  Help the victim, the bully and the bystanders understand the bullying incident and its negative consequences.

3.  Conform to principles of child protection, positive and non-violent discipline.

4.  Conduct seminars about anti – bullying.
