MOTION:Augerotmoved to approve the Consent Calendar of May 2, 2017. Jaramilloseconded the motion, which carried 3-0.

V.Proclamations

5.1In the Matter of Proclaiming Asian Pacific American Heritage Month in Benton County – Anne Schuster, Commissioner

MOTION:Augerot moved to approve proclaiming May 2017 as Asian Pacific American Heritage Month in Benton County. Jaramillo seconded the motion, which carried (3-0).

Schuster read the proclamation into the record.

5.2In the Matter of Proclaiming Older Americans Month in Benton County – Fred Abousleman, Oregon Cascades West Council of Governments

Abousleman stated that this is annual proclamation on behalf of Cascades West Council of Governments as the Senior Services Agency for Benton County.

MOTION:Jaramillo moved to approve proclaiming May 2017 as Older Americans Month in Benton County. Augerot seconded the motion, which carried (3-0).

Abousleman read the proclamation into the record.

PH 1In the Matter of a Public Hearing and Potential First Reading Regarding Ordinance No. 2017-0279 to Correct a Zoning Map Error – Linsey Godwin, Community Development

Schuster opened the public hearing at 12:08 p.m.

Staff Report

Godwin reviewed the information contained in the meeting materials. The error was brought to light by Assessment staff due to a farm exemption being applied even though the property was listed on the Zoning Map as residential. After reviewing the record staff determined that the designation of residential was made in error;the property owner was notified twice of the proposed correction and did not provide a response.

Croney stated that because this action is to make a correction this ordinance came straight to the Board rather than through the Planning Commission as is normal; County Code allows a shorter process to correct errors.

MOTION:Augerotmoved to conduct the first reading of Ordinance 2017-0279, approving the Official Zoning map correction requested in File LU-17-018, based on the Findings and Conclusion contained in the ordinance. Jaramillo seconded the motion, which carried 3-0.

Schuster conducted the first reading of the ordinance; the second reading will be held on May 16, 2017.

PH 2In the Matter of a Public Hearing Regarding the Withdrawal of the Barton Property from the Philomath Fire & Rescue and Annexation – Joe Mardis, Public Works

Schuster opened the public hearing at 12:15 p.m.

Staff Report

Mardis reviewed the information contained in the meeting materials. This item is related to the action requested in PH3. These two actions will align this property with neighboring properties as members of the Corvallis Rural Fire Protection District (RFPD); based on the orientation of the property access the Corvallis district has a more direct access and consequently a faster response that the Philomath Fire and Rescue District (PFRD).

MOTION:Jaramillo moved to approve the order of the petition for withdrawal of territory from the Philomath Fire and Rescue District. Augerot seconded the motion, which carried 3-0.

A final hearing is required to allow time for an objection and request for an election on the issue from voters in the district; the hearing will be held on June 6, 2017.

PH 3In the Matter of a Public Hearing for the Approval of a Petition for Annexation of Territory into the Corvallis Rural Fire Protection District –Joe Mardis, Public Works

Schuster opened the public hearing at 12:19 p.m.

Staff Report

Mardis reiterated the information contained in the previous item. The fire district chief has signed the petition and no objections have been received.

MOTION:Augerot moved to approve the order of the petition for annexation of territory in to the Corvallis Rural Fire Protection District. Jaramillo seconded the motion, which carried 3-0.

The final hearing for this action will also be held on June 6, 2017.

PH 4In the Matter of a Public Hearing Transferring Jurisdiction of NE Arnold Avenue to the City of Adair Village – Laurel Byer, Public Works

Schuster opened the public hearing at 12:20 p.m.

Staff Report

Byer stated that the City of Adair Village has requested this transfer to facilitate development in an area intended to become the downtown of the city. Some of the planned development is already underway along this corridor.

Croney added that the order is contingent on the City of Adair Village taking action to accept the road in the coming year.

MOTION:Jaramillo moved to approve the Order to transfer jurisdiction of NE Arnold Avenue, County Road No. 04701, to the City of Adair Village. Augerotseconded the motion, which carried 3-0.

PH 5In the Matter of a Public Hearing and Potential First Reading Ratifying the Intergovernmental Agreement Creating the Oregon Association of County Engineers and Surveyors (OACES) – Laurel Byer, Public Works

Schuster opened the public hearing at 12:23 p.m.

Staff Report

Byer reviewed the history of the organization, which has been operating as an affiliate of the Association of Oregon Counties (AOC); however, they have acquired enough assets and work that they chose to create a formal organization in 2016. This agreement would formalize the County’s participation with OACES.

Croney stated that when a Ch. 190 organization is formed state law requires the participating agency to pass an ordinance, it also adds the organization to the County Code that lists the 190’s that the county participates in.

MOTION:Augerot moved to approve the Ordinance to ratify the Intergovernmental Agreement to create the Oregon Association of County Engineers and Surveyors. Jaramillo seconded the motion, which carried 3-0.

Schuster conducted the first reading of the ordinance, the second reading will be held May 16, 2017.

VI.Other

6.1County Administrator Position – Vance Croney, County Counsel

Croney stated that the Board discussed this position in Executive Session at the Work Session this morning.

MOTION:Jaramillo moved to offer the position of County Administrative Officer to Joe Kerby, contingent upon a satisfactory review of his background and reference checks and, if the reviews are satisfactory, to authorize the county human resources manager and county counsel to negotiate the terms of employment with Mr. Kerby. Augerotseconded the motion, which carried (3-0)

Croney added that Mr. Kerby rose to the top of a very strong pool of candidates.
