MINUTES OF THE PONTARDDULAIS TOWN COUNCIL MEETING HELD ON THE 7TH JANUARY 2010

Prior to commencement of business the Mayor invited questions from members of the public. Mr Huw Jones, a resident of Pentre Road, Pontarddulais referred to the possible new roadway from the Gwyn Hotel to Pentre Road and expressed concern regarding the accessway. He requested permission for some of the residents of Pentre Road to address a future Council meeting. It was agreed that, subject to the Pontarddulais Agricultural Society addressing the February Council meeting, the residents address the March Council meeting.

92. APOLOGIES FOR ABSENCE:

Apologies for absence were received from Councillors E. Miles, W. Vonk, C. Morgan, R. Waterhouse and P. Waterhouse.

93. TO RECEIVE DECLARATIONS OF PERSONAL INTEREST FROM MEMBERS IN ACCORDANCE WITH THE COUNCIL’S CODE OF CONDUCT:

There were no declarations of personal interest received.

94.  TO RECEIVE AN ADDRESS FROM REPRESENTATIVES FROM PONTARDDULAIS AGRICULTURAL SOCIETY:

The Mayor explained that he had received notification that the Agricultural Society were unable to attend the meeting. It was agreed that they be invited to address the February Council meeting.

95. TO RECEIVE AND CONSIDER THE MINUTES OF THE COUNCIL MEETING HELD ON 3RD DECEMBER 2009:

The above minutes were accepted as a true record.

(a)  Pontarddulais Agricultural Society (Public question time):

Cllr Downing reminded Members that Mr Hamer, Pontarddulais Agricultural Society had stated in the last Council meeting that the Society had no objection in releasing land for the possible new roadway from the Gwyn Hotel to Pentre Road, Pontarddulais.

(b)  Proposed Tesco Development, Pontarddulais (Min No 81):

Cllr Downing queried the Section106 Planning Obligation relating to the above development. It was agreed that the Clerk writes to the City and County of Swansea requesting a copy of the 106 Obligation. Cllr Beynon wished it clarified that the £1 million committed by Tesco was for the possible road link to Pentre Road.

(c)  Handrail, Institute stairs (Min No 82(a)):

The Clerk informed Members that he had purchased the materials and the caretaker would erect the handrail in the next week.

(d)  Bryn Road, Pontarddulais (Min No 84(m)):

The Clerk reported an e-mail reply from the City and County of Swansea’s Planning Departrment to the occupier of 12 Bryn Road, Pontarddulais. Cllr Downing noted that the e-mail emphasised that the possible link road to Pentre Road was not part of the Tesco proposal and would require being subject to the submission of a further planning application which would require further consideration and testing of the new junction onto the A48. Such a proposal would be subject to further publicity/consultation with the local community.

(e)  Western Valleys SRA – Pontarddulais Action Plan (Min No 84(p)):

The Clerk stated that he had been in contact with the City and County of Swansea who had explained that the above was a Welsh Assembly initiative with the County looking at community aspirations and statistical evidence prior to producing a Holistic Area Regeneration Plan. They would be consulting with the Town Council in due course.

(f)  Section 106 Planning Obligation (Min No 84(r)):

The Clerk reported an e-mail response from the City and County of Swansea explaining the Planning Obligations with respect to the Persimmon and Redrow Developments. It was agreed that the Clerk requests further information on the £35,000 allocated towards the improvements of the public transport facility near the Persimmon site.

(g)  Planning applications (Min No 88):

The Clerk referred to the decision to forward copies of planning applications to all Town Councillors and queried his position should only one or two Councillors object to an application. It was agreed that in such cases the Clerk calls a meeting of the Estates and Development Committee to discuss the application/s.

(h)  Hot Water Boiler, Institute Kitchen (Min No 91):

The Clerk informed Members that the new boiler had been ordered and was awaiting a supply and fixing date.

96. TO ANSWER QUESTIONS FROM COUNCILLORS (3 CLEAR DAYS NOTICE OF ANY QUESTION HAVING BEEN GIVEN TO THE PERSON TO WHOM IT IS ADDRESSED):

There were no questions received.

97.  TO RECEIVE AND CONSIDER REPORTS FROM THE CLERK:

A.  CORRESPONDENCE:

The following correspondence was received and noted:

(a)  City and County of Swansea – Planning Obligations Supplementary Guidance – update on the Guidance;

(b)  City and County of Swansea – Local Development Plan Delivery Agreement – approved by the Welsh Assembly Government on the 29th October 2009;

(c)  Mr Alun Cairns AM – further correspondence relating to sand dredging;

(d)  One Voice Wales – summary note following consultation on statutory guidance issued recently by the Welsh Assembly Government;

(e)  Written Statement from Mr B. Gibbons, Minister for Social Justice and Local Government – policy for the development of town and community councils;

(f)  Electricity Alliance – further correspondence relating to the Pembroke – Swansea overhead line refurbishment;

(g)  MUGA lighting:

The Clerk reported an e-mail from Pontarddulais Partnership indicating that the lights to the MUGA would be installed on the 21st December 2009. Due to adverse weather conditions the work had not been undertaken.

(h)  Proposed road from the Gwyn Hotel to Pentre Road, Pontarddulais:

The Clerk reported a letter from Pontarddulais Rugby Football Club expressing certain concerns regarding the above possible proposal.It was agreed to keep the Club informed of any developments.

(i)  One Voice Wales Training Session:

The Clerk reported an e-mail from One Voice Wales inviting Members to attend a training session in the Guildhall, Swansea on the 21st January 2010 on Module 3 – The Council as an Employer. Cllr Rees expressed an interest and agreed to contact the Clerk as soon as possible with her decision.

98.  TO RECEIVE AND CONSIDER REPORTS FROM THE MAYOR:

The Mayor reported on his duties during the past month.

99. TO RECEIVE AND CONSIDER REPORTS FROM REPRESENTATIVES ON OUTSIDE BODIES:

Cllr Bateman reported that she had attended a meeting of One Voice Wales’s Swansea Area Committee. Cllr Beynon reported that he had attended a police meeting in Gorseinon.

100. TO CONSIDER THE CODE OF CONDUCT – DRAFT GUIDANCE FROM THE PUBLIC SERVICES OMBUDSMAN:

The Clerk referred to the fact that he had e-mailed the document to all Councillors with known e-mail addresses and copied it to the remainder. Cllr Downing noted that it was an excellent document which explained the Code in layman terms with many useful examples for differing circumstances.

101. TO AUTHORISE AND APPROVE THE EXPENDITURE FOR THE MONTH OF DECEMBER 2009:

RESOLVED that the above expenditure be authorised and approved.

See Appendix “A”.

102. TO RECEIVE PLANNING APPLICATIONS PREVIOUSLY CIRCULATED TO ALL COUNCILLORS:

(i)  Land part of Llandremor Farm, Pontarddulais – agricultural worker’s dwelling (outline)(appeal);

(ii)  Unit A, Lye Industrial Estate, Pontarddulais – single storey side extension;

(iii)  Mynydd y Gwair, Swansea – installation of 19 wind turbines (Max ht. to blade tip of 127m with a hub height of 80m), with associated tracks and ancillary infrastructure (including 80m high anemometer mast, electrical substation compound, hardstandings, transformers and underground cabling) and construction of new access track from A48 (Bolgoed Road) (approx 13.8km in length) with improvements to 3.0km of existing road across Mynydd Pysgodin (appeal against the failure of the City and County of Swansea to give its decision within the appropriate period);

(iv)  24 Dulais Road, Pontarddulais – change of use of printer’s shop (Class B1) to doctor’s surgery (Class D1) – renewal of planning permission 2004/2256 granted 13 December 2004.

The Clerk reported two additional applications which he had copied to Councillors:

(v)  40 Alltiago Road, Pontarddulais – construction of garage below external decking level;

(vi)  120 Bolgoed Road, Pontarddulais – formation of habitable room in roofspace with rear dormer.

The Clerk advised Members that he had written to the City and County of Swansea confirming the Council’s original objection with respect to (iii) above.
