CONSUMPTION OF LIQUOR ON CITY PROPERTY

GENERAL STATEMENT

The City of Castlegar has a responsibility and a duty to ensure the work place is safe. The consumption of alcohol on City premises is contradictory to this responsibility and duty and is therefore strictly forbidden except under the terms and conditions specified in this policy.

Policy:

That there will be no consumption of alcoholic beverages by employees or visitors on City property or within City owned buildings. This policy is applicable to the following City owned buildings:

a)City Hall

b)Public Works

c)R.C.M. Police Station

d)Library

e)Airport Buildings (except restaurant within terminal building if licensed)

f)Museum

g)Art Gallery

h)Doukhobor Village Buildings (except restaurant if licensed)

i)and any other buildings that the City owns, constructs, acquires, rents or leases from time to time.

Liquor consumption as the Castlegar Fire Hall is covered by the Castlegar Fire Department Liquor Policy.

Definitions:

Employees are defined as person (in both paid and voluntary positions) required by the City of Castlegar to carry out its duties and functions.

Special occasions and staff functions are defined as extraordinary events which are not held on a regularly scheduled basis.

Exemptions:

Employee Functions

Employees will be permitted to consume alcohol in City facilities during functions which have received prior approval by the City Administrator. Employees consuming alcohol at such events shall not return to work that day. As is required by law no person shall drive while in an impaired condition, and the City of Castlegar supports the policy of “Don’t Drink and Drive”.

Permission from the City Administrator to allow alcohol may be granted provided that all of the following conditions are met:

·the area of the building used for the event is not visible to the public

·the nature and size of the event is such that it will not draw the attention of the public through excessive noise or other disturbances

·members of the public cannot enter

·attendance is by prior invitation only

·the liquor is not sold

·the function is attended only by the employer and their employees and guests

·no fee is charged for entry or entertainment and no fee is charged for services related to the service of liquor (e.g. fees for mix, ice and glass)

·the function occurs in the space normally occupied by the employees hosting the function

·“Serving it Right” and “Safe Ride Home” programs shall be fully supported by the employees.

If any of the above conditions are not met a Special Occasion License is required.

Special Occasion Licenses (SOL):

Notwithstanding those events defined as “staff functions” a Special Occasion License is required for all events in a public place where alcohol is provided or sold for consumption. For events not held in a public place, a SOL is still required if liquor is sold or if a fee is charged as a condition of attending an event where alcohol is available.

Administration of Special Occasion License is the responsibility of the Liquor Control Branch with prior approval received from the RCMP and the City of Castlegar.

In order for approval to be obtained from the City, the sponsoring organization is required to provide the City Administrator the following:

1.Name of the hosting organization as well as the name, mailing address and phone number of the contact person.

2.The date, time and location that the event will be in operation.

3.Proof of $2 million insurance.

4.Participation in the “Safe Ride Home Program”.

Frequency of Special Occasion Licenses:

Because SOLs are to be used for special and infrequent events, the maximum number of SOLs granted to any department or organization is 6 per year.
