Procedure for Enforcing the Declaration

Pursuant to Article III, §1 of the Articles of Incorporation and Article V, §§11-12 of the By-Laws, the Board of Trustees hereby creates the following Rules of Procedure in order to enforce the covenants, conditions, and restrictions set forth in the Declaration of Covenants and Restrictions and Reservation of Easements for Keehner Meadows Subdivision (“Declaration”).

1.  Homeowners may submit a written, signed complaint regarding alleged violations of the Declaration to the Board at any time.

  2. Complaints can be mailed to the Keehner Meadows Community Association at P.O. Box 1215, West Chester, Ohio 45071-1215 or
  3. Complaints can be sent via email to .
  4. The complaint must include
  5. The address of the homeowner who is committing the alleged violation;
  6. The nature of the alleged violation;
  7. The signature of the homeowner making the complaint; (Emailed complaints will be deemed signed if the first and last name of the complaining homeowner is included.) and
  8. Contact information (address, phone number, and email address) for the complaining homeowner so that the Board can respond.
  9. The Board shall not respond to oral complaints regarding alleged violations of the Declaration.

2.  Upon receiving a complaint, the Board will review the complaint to ensure that the above requirements have been met and that the complaining homeowner is in good standing with the Community Association.

3.  The Board will then investigate the complaint and determine if there is a violation of the Declaration.

  1. If the Board determines that there is no violation, then it will notify the complaining homeowner that no violation has occurred.
  2. If the Board determines that a violation has occurred, then the Board may consider whether a variance exists or should be granted pursuant to Article VII, § 7.2 of the Declaration. The Declaration does NOT allow for variances regarding Use Restrictions and Maintenance listed in Article VIII.
  3. If the Board finds that a violation has occurred and no variance exists or is granted, then it will issue a Notice of Violation (“NOV”) to the homeowners in violation as follows:
  4. The Board will deliver a written NOV to the homeowners in violation and allow ten (10) days for corrective action.
  5. If corrective action is not taken after ten (10) days, then the Board will deliver a second written NOV and allow seven (7) additional days for corrective action.
  6. If corrective action is not taken after seventeen (17) days, then the Board will deliver a third written NOV, impose a fifty dollar ($50) fine, and allow three (3) additional days for corrective action.
  7. If corrective action is not taken after twenty (20) days, then the Board will seek to enforce the Declaration in a court proceeding. The homeowners in violation will be charged with court costs and attorneys’ fees incurred by the Board and the Community Association in any legal action seeking to enforce the Declaration.
  8. The Board will notify the complaining homeowner of the resolution.
