RESOLUTION AUTHORIZING THE MAYOR TO SELL THE VILLAGE BARBER SURF RAKE VIA INTERNET AUCTION THROUGH GOVDEALS AT A SALE PRICE OF EIGHT THOUSAND DOLLARS ($8,000.00) AND DECLARING AN EMERGENCY.
WHEREAS, the Model 400hd Barber Surf Rake owned by the Village is obsolete and no longer needed for Village purposes; and
WHEREAS, the Village desires to sell said Barber Surf Rake through an internet auction at a price of Eight Thousand Dollars ($8,000.00), or the highest attainable price if the selling price of Eight Thousand Dollars ($8,000.00) cannot be obtained; and
WHEREAS, GovDeals provides a means by which the Village can sell said Barber Surf Rake through an internet auction; and
WHEREAS, it is the desire of the Village to sell said Barber Surf Rake by utilizing the services of GovDeals.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF NORTH PERRY, COUNTY OF LAKE AND STATE OF OHIO, AS FOLLOWS:
Section 1. The Mayor is hereby authorized to sell by internet auction, after providing public notice pursuant to the provisions of Section 721.15(D) of the Ohio Revised Code, the obsolete Model 400hd Barber Surf Rake owned by the Village pursuant to the following:
a) the selling price of the surf rake shall be Eight Thousand Dollars ($8,000.00), but that the Mayor may sell the surf rake at the highest offered price if the Eight Thousand Dollars ($8,000.00) selling price cannot be obtained;
b) the internet auction shall be conducted by GovDeals, located at www.GovDeals.com and shall be open for bidding for thirty (30) consecutive days;
c) in addition to the above, the general terms and conditions of the sale shall be those normally utilized by GovDeals, and shall include the provisions that the surf rake is being sold “as is,” that the purchaser is obligated to pick up the surf rake from its current location within the Village, that the sale is final, that payment must be made within seven (7) days of notice of successful bid and made prior to pick up, and that payment is to be made with a certified bank check or other similar form of payment acceptable to the Village.
Section 2. That all formal actions of this Council concerning the passage of this Resolution were adopted in an open meeting, and all deliberations of this Council, or any of its Committees, which resulted in such formal actions, were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
Section 3. That this Resolution hereby is declared to be and is passed as an emergency Resolution, the emergency being the need to immediately begin the selling process of the obsolete Model 400hd Barber Surf Rake in order to preserve the public peace, health, safety, and welfare of the inhabitants of the Village of North Perry.
WHEREFORE, This Resolution shall take effect and be in force immediately upon its passage.
