NOTICE INVITING LIMITED TENDER FOR SUPPLY OF WOODEN TABLE TOP OF SQUARE TYPE WITH GOLD COLOR PLATED COPPER COIN OF 45 MM DIAMETER

The National Biodiversity Authority (NBA), Chennai, an autonomous and statutory body established under the Biological Diversity Act, 2002, invitessealedtenders for supply of ‘Wooden Table top of square type with Gold color plated Copper Coin of 45mm diameter’ as per the model diagram mentioned in Annexure – I.
TheTenderSchedulecontainingdetailedspecificationsoftheaboveitemwithtermsand conditionsofthetenderisenclosed. TheTenderSchedulecan also bedownloadedfromtheofficial websiteof“”.
NBAreservestherightto modify,expand,restrict,scrap,refloatorcancel in whole/part, thetender processatanystagewithoutassigninganyreason. Responsesreceivedafterthestipulated date / time /period “or”notinaccordancewiththespecifiedformatwillsummarily be rejected. Deliveryoftheresponsesalong with the tender documentsatthe prescribed address/ last date/ time fixed for the receipt of tenderwillbethe soleresponsibilityof the respondingagency.
Interestedagenciesmay fill inthetenderformsandsend intwoseparatecovers– First cover superscribedas“Technicalbid–EnvelopeA”containing AnnexureI, II, IIIIV and other supporting documents and second cover superscribed as “Financial bid – Envelope B”containing AnnexureV. The tenderer shall sign all the pages of the tender document with seal.Further particulars regarding the tender, if any, required may be obtained from the Administrative Officer / Dealing Assistant of the Administrative Section, National Biodiversity Authority, TICEL Biopark, Taramani, Chennai during office hours on all working days.
Thelastdate/timeforthereceiptoftenderdocument shallbe20th November,20133.00PM. Thetechnical proposalswillbeopenedat4.00PMon20th November, 2013at NBAOfficeat theaddressmentionedabove.Further,openingof TechnicalBidswillbedone in thepresence of Tendererswhowishtobe presentat that time.But,the openingof financial bidswillbedoneat alaterdate only for those qualities in the Technical bid, and date will be advised to the qualified bidders. Incase20thNovember,2013 is declaredasaholiday, thenthe tender will be opened atthe sametime /place on the nextworking day.

SECTION I
TERMS AND CONDITIONS OF THE CONTRACT
1. TECHNICAL CRITERIA:-
1. The applicant should be reputed firm/ contractors having an experience in carrying out to make wooden table top works for CentralGovt. Ministries/Departments/PSU/Autonomousbodies/StatutorybodiesofGOI/ International agencies like World Bank, UNDP etc. (Certificate for having performed the work/ services satisfactorily in the said ministry/ dept. /organizationshouldbeattached.)
2. The contractor should have a valid PAN/TAN number/Sales Tax/Service Tax Registration Numbers/ and details thereof should be provided.(Photocopy of the certificate to be enclosed).
3. Copy of IT return filed the last three financial years should be furnished(i.e for the year 2010-11, 2011-12, 2012-13).
4. Copy of work orders/award letters showing the experience of work in the last two years should be provided.
5. Thefirm/agencyshouldnothavebeenblacklistedordebarred byany Government Organization/PSUetc.The firm/agencymayfurnishanundertakingtothiseffectonitsletterheaddulysignedby authorizedpersonofthefirm/agency.
6. The value of the work will be around Rs.2,50,000 (Rupees Two lakh fifty thousand only). Hence, thedesigning/manufacturing frim shallfurnishanEarnestMoneydeposit(EMD) in the form of Demand Draft issued infavourof“NationalBiodiversity Authority”byanyNationalizedBankorbyStateBankofIndiaoritssubsidiariesforanamountofRs.10,000/-(RupeesTen thousand only)atthetimeofsubmissionof proposal which shall be retained as Security Deposit in respect ofthesuccessful bidder. Itshallberefundedwithoutintereston receipt of Performance Guarantee. EMD’swill bereturned to unsuccessful bidders after the finalisation of the contract.
II. Other conditions
7.Thetenderswill beopenedat 4.00 p.m. on20thNovember 2013atO/o NBA, Chennai.The successful bidder would be selected on the basis of technical qualification and lowest quoted amount as per the format enclosed at Annexure – V. The Offer shall remain valid for a period of 120 days from the last date of submission of tender documents.
8. TENDER IS LIABLE TO BE IGNORED IF COMPLETE INFORMATION IS NOT PROVIDED AS REQUIRED. Conditionaloffer /offerswhich arenotinconformitytothe prescribeddocument willbesummarily rejected.
9. However, NBA reserves the right notto acceptthelowesttender or not toassignanyreason forrejectionofanyorallthetenders.NBAreservestheright foracceptingthewholeor anypartof thetendersanddecisionin thematter shall befinal andbinding.
10.Anyfailureonthepartof the tenderertoobservetheprescribedprocedureandany attempt tocanvassfortheworkwillprejudicehis/hertender.Tenders/ratesquotedin other thantheprescribedproformaareliable toberejected.
11.The submission of tender will bind the tenderer to acceptance of all conditions specifiedhereinand inaddition totheconditionsofthecontract.
12.Theratesshouldbementionedinfiguresaswellasinwords.Erasing /overwritingshouldbeavoided/dulyattestedbythetenderer.Taxes, however, shouldbeindicatedseparately.Incase,nothingismentioned,itwillbeassumedthatall taxesareincludedintheratesquoted.
13. ThepartiesherebyirrevocablyconsenttothesolejurisdictionoftheCourtsofChennaionlyinconnectionwithanyactionsorproceedingsarisingoutorinrelationtothisTENDER.
Force Majeure
14. (i)IntheeventofanydisputearisingamongsttheParties,thePartiesagreetousetheirbesteffortstoattempttoresolvealldisputesinprompt,equitableandgoodfaith.IntheeventthePartiesareunabletodoso,thensuch disputeshallbefinallyresolvedbyarbitration.ThearbitrationshallbeconductedintheEnglishlanguageandthevenueofthearbitrationshallbeinChennai.ThesolearbitratorwillbeappointedbyChairman, NBAwhosedecisioninthisregardwillbefinalbinding.
(ii)If,astheresultofFORCEMAJEURE,thecontractor isunabletoperformamaterialportionof thecontractforaperiod ofnot lessthansixty(60)days;or
(iii)IfNBA,initssolediscretion,decidestoterminatethisContract.
(iv) Intheeventofterminationonunsatisfactoryserviceorforviolationofanyofthetermsconditionsof contract,theEMDshallstandforfeited.
15.Aftertheworkhasbeencompletedthebillfortheworkinduplicatepreparedonthe basisoftheacceptedratesshould besubmittedtoNBAfornecessaryactiontogetherwith(i) receipteddeliveryvouchers forthesupplymade(ii)representativespecimenofthework and (iii)other supportof the itemschargedfor in thebill.
16.Ifthesupplierfailstodeliveranyorallofthegoodsortoperformtheserviceswithin the period(s) specifiedinthe Contract/Work Order, NBAshall, without prejudicetoits other remediesunderthecontract,deductfrom thecontractprice,asliquidateddamages,asumof equivalentto0.5%or partthereoffordelayuntilactualdeliveryorperformance,upto maximumdeductionof10%ofthecontractprice. Once themaximumisreached,NBAmayconsider terminationofthecontract. Incaseoffailureofthecontractortosupplythematerialwithinthestipulated timestrictlyconformingtothespecifications,NBAmaygettheworkdonethroughany otherfirmattheContractor’sriskandexpensesbutwithoutprejudicetoanyother rightswhichNBA mayhaveagainst the Contractor.
17.i)Thesuccessfulbidderswillhavetosubmitperformancesecurityfor an amountofRs20,000(RupeesTwenty thousandonly)intheformofanAccountPayeeDemandDraft/Fixed Depositfrom acommercialbank/Bank GuaranteefromacommercialbankinthenameofNationalBiodiversity Authorityasperthe textprovided bythe Authority.
(ii)Theperformancesecuritywillbevalidfora periodof30 daysbeyondthe validity of the contract.
(iii)EarnestMoneywillberefundedtothesuccessfulbidderonreceiptofperformancesecurity.
18.TheWooden table top arerequiredtobe madeasperthespecimenmentioned in the Annexure I & II by NBA.
19.The work related to ‘Table Top’ may be handed over to the officer concerned and if necessary proof may be submitted before the final design is made and approved.
20. Language: The bid, supporting document and all correspondence and documents related to the bid exchanged between the bidder and the firm shall be written in the English language.
21. Late Bids: Any bid received by the firm after the deadline for submission of bids prescribed will be returned unopened to the bidder.
22.TheContractorshallnotgivesub-contract,transfer,assignorotherwise,partofthecontracttoanyother persons,firm,company,directlyorindirectly.
23. After award of the contract, any minor changes in the modus of implementation can be agreed to mutually in writing. Free door delivery of the wooden table top items to be supplied to this office.
24. NBA does not guarantee any volume of business and the requirements shall be need based on NBA requirements only.
25. AllthetermsandconditionsasstatedintheTENDERdocuments,Annexures andacceptanceconveyedby NBAwill constitutethecontractbetweenthefirm selectedandNBA.
NOTWITHSTANDING ANYTHING STATED ABOVE, NBA RESERVES THE RIGHT TO ASSESS BIDDER’S CAPABILITY AND CAPACITY TO PERFORM THE CONTRACT SHOULD THE CIRCUMSTANCES WARRANT SUCH ASSESSMENT IN THE OVERALL INTEREST OF NBA AND DECISION OF NBA IN THIS REGARD SHALL BE FINAL. NBA RESERVES THE RIGHT TO REJECT ANY OR ALL TENDERS OR CANCEL/WITHDRAW THE NOTICE INVITING TENDER IN WHOLE/PART WITHOUT ASSIGNING ANY REASON WHATSOEVER AND IN SUCH CASE NO APPLICANT SHALL HAVE ANY CLAIM ARISING OUT OF SUCH ACTION.

Requirements:
Item – I / : / It is a wooden base of 5.5 cm X 22.5 cm X 1.5 cm size walnut polished, which is having design as shown in the picture.The two ends of the base have curved shape is shown in the model diagram.
Item – II / : / It is a square wooden piece of 13 cm X 13 cm X 1.5 cm walnut polished having space to fix another wooden engraved plate as shown in the picture.
It will be fixed on the wooden base (Item – I)
Item – III / : / It is a square wooden piece of 10 cm X 10 cm in size having NBA name.
The design is engraved one.
It will consist of ‘National Biodiversity Authority’ on the left – top corner of the frame.
It will consist of ‘10th Anniversary 2003-2013 in the middle
The pictures on the place should reflect the activities of National Biodiversity. If required NBA will provide pictures related to this design.
Item – IV / : / It is a round shaped wooden piece having 7.5 cm diameter and 1.5 cm in width. It will also have place to fix gold color copper coin having NBA Logo.
The walnut polish should be of high quality.
Item – V / : / This is a NBA Logo copper coin. It is of 45mm size in diameter.
The weight of the coin is 35 gr. (10% variation on both upper side and lower side in weight is allowed as wastage).
The color of the coin is gold.
When it comes to variation of the size of wooden materials, 10% is allowed against the above mentioned measurements.
The wooden table top with Gold colour plated copper coin will need to execute (as per Diagram at Annexure I).
