12TH AMENDMENT OF DECLARATION

OF

HAMLETS OF GLENMOOR CONDOMINIUM II ASSOCIATION

This 12th Amendment to the Declaration of Hamlets II of Glenmoor Condominium Association is made this _____ day of July, 2005, by the undersigned Unit Owners exercising not less than seventy-five percent (75%) of the voting power of Unit Owners and those holders of first mortgages on units to which at least fifty-one percent (51%) of the votes of Units subject to mortgages appertain (hereinafter referred to as “Unit Owners” and “Mortgagees”) pursuant to the provisions of Chapter 5311 of the Revised Code of Ohio and Article XV of the Declaration of Condominium Ownership of Hamlets II of Glenmoor Condominium Association.

WITNESSETH:

WHEREAS, There has heretofore been filed Declaration of Condominium Ownership dated August 5th, 1999, known as The Hamlets of Glenmoor Condominium No. II, which was filed for record with the Stark County, Ohio Auditor on August 5, 1999, and is recorded as Official Records Reception Number Vol. ____, Page ______of the Stark County Records, and included in said Declaration is a description of the Condominium Property along with a Plot Plan of said property; and which is recorded in Vol. ___, Pg. ___ of the Condominium Plat Book; and

WHEREAS, Declarant has heretofore executed several previous Amendments to the Declaration of Condominium Ownership, which have been filed for record with the Stark County, Ohio, Auditor’s Office and recorded as Official Records of the Stark County Records with the most recent ____ Amendment being filed and recorded as of ______, 200___; and

WHEREAS, pursuant to Article XII Section A of the Declaration, the Unit Owner’s have the right to amend the original Declaration for the purposes set forth herein; and

WHEREAS, the Unit Owner’s have now determined to expand the current leasing policy of units at Hamlets of Glenmoor Condominium II Association and restrict the percentage of units that may be rented by unit owners; and

NOW, THEREFORE, the following changes are hereby made to the Declaration:

1. Article XV, Section F (1) (k), “Leasing of Units,” is hereby amended to include the following language:

“No unit owner may offer his unit or units for rent to the general public after ten percent (10%) or five (5) units have been previously rented out by all Hamlets of Glenmoor Condominium II Association Unit Owners. The Board of Trustees shall not grant authority to lease a unit pursuant to the provisions herein unless or until currently leased units are sold and/or become owner occupied units.”

2. The original Declaration, the By-Laws attached thereto, the original Drawings and other Exhibits to the Declaration as each of the foregoing are hereby amended and supplemented shall remain in full force and effect and all reference thereto in the Declaration shall include amendments thereto.

CERTIFICATION

The undersigned, being the President, Vice President and Treasurer of Hamlets of Glenmoor Condominium II Association do hereby certify that the attached 12th Amendment to Declaration of Hamlets of Glenmoor Condominium II Association has been duly adopted by seventy-five percent (75%) of the voting percentage held by unit owners of Hamlets of Glenmoor Condominium II Association and further consented to by eligible holders of first mortgages on units to which at least fifty-one percent (51%) of the votes of the units subject to mortgages appertain. Having obtained the necessary approval of unit owners and first mortgages, the President, Vice President and Treasurer have duly executed that the amendment with full power and authority as required by Article XII, Section A of the Declaration.

We do hereby set out hands on this document attesting to the truth of the above-referenced provisions.
