5:30 PM – City Hall

Mayor Thorpe called the meeting to order at 5:30 PM with Council members Reis, Maunu, Schilling, Belmore, Ulmer and Fuher present.

Absent: None

City Employees present were: Building Inspector Kassa, City Attorney Radermacher, Police Chief Frannea and Deputy Auditor Della Pomplun.

Also present: R. Johnson, representing Dickey County Leader, Mickey Thorpe, Bob Bechtold, Peggy Bechtold, Shawn representing M&M Contractors, and Bob Gulke.

Agenda additions: Bob Gulke, land purchase; and stop sign at 5th St N and 3rd Ave N.

Minutes: Motion by Belmore, second by Schilling to approve the minutes of the September 8th Council meeting. All members, aye. Motion approved. Motion by Schilling, second by Maunu to approve the special meeting minutes for September 23rd. All members, aye. Motion approved.

Operating statement: Motion by Fuher, second by Reis to approve operating statement as presented. All members, aye. Motion approved.

Bills: Motion by Belmore, second by Ulmer to approve the bills as presented. All members, aye. Motion approved.

Delinquent accounts: Gene Pettyjohn.

Bechtold 2014 Tax Abatement: The house at 804 2nd St N owned by Bechtold’s will be demolished in 2015. Pictures provided verification house is uninhabitable but secured. Motion by Reis, second by Maunu to grant by Resolution the application of abatement of taxes for Robert and Margaret Bechtold for property at 804 2nd St N, Ellendale ND. Roll call vote: Reis – Yes; Maunu – Yes; Schilling – Yes; Belmore – Yes; Ulmer – Yes; Fuher – Yes. Motion approved.

Raffle Permits: Motion by Schilling, second by Ulmer to approve the raffle permits for Ellendale Area Community Foundation. All members, aye. Motion approved.

Police Chief Frannea reported on the police activity for the month of September. Chief Frannea requested the Council to reconsider the possibility of the Rabies and Hepatitis vaccinations.

6:00 PM – Bid Opening - Main St Buildings:

Veit Specialty Contracting – $162,809; RTS Shearing LLC - $186,000; Dahme Construction Co. Inc. - $234,618; M&M Contractors LLC - $273,985; Dakota Plains Electric, Inc – Non qualifying. Motion by Schilling, Second by Reis to table the approval decision to have a committee review the bids and contact references. All members, aye. Motion approved.

Outlot G Land sale – Bob Gulke was present to explain he was still interested in the purchase of any portion of this property and would like the right of first refusal if the City should ever decide to sell. At this time the City does not plan to pursue the sale of this property, but research will need to be done to see what procedure will need to be followed. He would also like to continue haying this property, auditor will check out the procedure for this also.

Building Inspector Report: BI Kassa discussed a different type of letter to be sent to property owners that have houses that need to be brought up to code. Kassa would like to have the city attorney and the council’s help to evaluate these letters. Council suggested Kassa set up a plan for next meeting to handle these properties.

The house at 104 2nd St S has been removed and the owner will be charged for demo and disposal; 401 5th ST N roof repair has begun; 55 6th Ave S will be removed next year; other properties are pending at this time.

Building Permits: Motion by Schilling, second by Ulmer to approve building permits for Betty Martin – deck; Carl Lee – deck; MDU – warehouse, garage, and shop. Roll call vote: Maunu – Yes; Schilling – Yes; Belmore – Yes; Ulmer – Yes; Fuher – Yes; Reis – Yes. Motion approved.

Motion by Schilling, second by Fuher to approve the building permit and allow a variance to eliminate the requirement of a survey to Chad Pederson for a fence in the backyard, pending stipulations: 1) move the planned fence 1 foot from alley; 2) written permission from Sand’s. Roll call vote: Schilling – Yes, Belmore – Yes; Ulmer – Yes; Fuher – Yes; Reis – Yes; Maunu – Yes. Motion approved.

Motion by Belmore, second by Reis to approve the building permit for Stan Soderstrom to remodel north entrance to house. Roll call vote: Belmore – Yes; Ulmer – Yes; Fuher – Yes; Reis – Yes; Maunu – Yes; Schilling – Yes. Motion approved.

Building permit for Chris Hagen has been tabled to obtain updated details.

Motion by Schilling, second by Belmore to approve a variance to Richard Reis to increase the height of the fence to 9 ft for a distance of 24 ft on the east side yard. Roll call vote: Ulmer – Yes; Fuher – Yes; Reis – Abstained; Maunu – Yes; Schilling – Yes; Belmore – Yes. Motion approved.

Dickey County Mitigation Plan: Motion by Ulmer, second by Schilling to adopt by Resolution the Dickey County Multi-Jurisdictional Multi-Hazard Mitigation Plan. Roll call vote: Fuher – Yes; Reis – Yes; Maunu – Yes; Schilling – Yes; Belmore – Yes; Ulmer – Yes. Motion approved.

Ordinance amendment discussion will continue to be discussed. Also need to discuss zoning procedures.

City Foreman report: PWD Flynn was unable to attend; a report was presented with a list of jobs completed for September, also a list of job that need to be accomplished before freeze up. Discussion about possibly using contract labor to help complete some of these tasks. The bucket truck has passed inspection.

Ellendale Motor Vehicle Branch has been doing fine, the Radermacher Law Firm sign needs to be removed.

Discussion was held concerning the traffic at the corner of 3rd Ave N and 5th St N. A stop sign will replace the yield sign.

Roberta Johnson mentioned that Heidi Heitkamp will be at a roundtable discussion at the Fireside at 2:15 October 16th.

Reis motioned, Ulmer second to adjourn at 7:55 PM.

Next meeting will be November 10th at 5:30 PM.
