Special Provisions for Design of Stormwater Pollution Prevention Plan

Stormwater Pollution Prevention Program

Services to be provided include:

Preparation of stormwater pollution prevention plans for city capital improvement projects that are subject to the State General Construction NPDES Permit (GCP) Order 09-0009-DWQ. Applicant shall possess necessary qualifications identified in the GCP. Contractor shall be responsible for working closely with the project’s design engineer in developing the SWPPP and required erosion and sediment controls plans. Contractor shall[ak1] also be required to be certified as a Qualified SWPPP Practitioner and responsible for the direct supervision of construction site employees that implement the SWPPP. For a detailed list of the required components of the SWPPP see Attachment 1. The following is a brief summary of those requirements.

  1. SWPPP Requirements
  1. Introduction – must include required documents on project location and owner including certification statements. The objectives of the SWPPP as identified in the GCP must be included.
  1. Permit Registration Documents (PRDs) – Contractor shall be responsible for developing the Permit Registration Documents for electronic submittal by the City Manager. These documents include:
  2. Notice of Intent application
  3. Risk Assessment
  4. Site Map that includes:

1.Project surrounding area (vicinity)

2.Site layout

3.Construction site boundaries

4.Drainage areas

5.Discharge locations

6.Sampling locations

7.Areas of soil disturbance (temporary or permanent)

8.Active areas of soil disturbance (cut of fill)

9.Location of all runoff BMPs

10.Location of all erosion control BMPs

11.Location of all sediment control BMPs

12.Location of sensitive habitats, watercourses or other features which area not to be disturbed

13.Location of all post-construction BMPs

14.Location of storage areas for waste, vehicles, service loading/unloading of materials, access (entrance/exits) points to construction site, fueling, and water storage, water transfer for dust control and compaction practices.

City will be responsible for obtaining/submitting the fee and the signed certification statement for City Manager signature.

  1. SWPPP Availability & Implementation, Amendments, Retention of Records, Required Non-Compliance Reporting – Inclusion of required certification statements for SWPPP availability, implementation, amendment, retention of records, non-compliance reporting, annual report, changes to permit coverage.
  2. Annual Report – Contractor will be responsible for preparing the annual report and submitting electronically to the City by August 1. City will electronically submit the annual report by due date of Sept. 1 to SWRCB.
  3. Changes to Permit Coverage – Contractor shall be required to provide any required documentation for changes to the project’s permit coverage area.
  4. Notice of Termination – Contractor will be responsible for preparing the Notice of Termination and submitting it electronically to the City within 90 days of meeting all GCP requirements for termination and final stabilization.
  1. Project Information
  1. Project & Site Description – Contractor shall be responsible of including a description of the project site and construction activities, existing site conditions and relevant prior land use per GCP guidelines. This shall include Total Maximum Daily Loads and/or 303(d) listings and any Environmentally Sensitive Area designations.
  2. Stormwater Run-on From Offsite Areas – Contractor shall include calculations and design details as well as BMP controls for site run-on per GCP requirements.
  3. Findings of Construction Site Sediment and Receiving Water Risk Determination – Contractor shall summarize the assumptions and input parameters and findings of the sediment and receiving water risk assessment, including the resulting site risk level from the Site Risk determination.
  4. Construction Schedule – Contractor shall identify and reference the project construction schedule and include the schedule as an Appendix in the SWPPP.
  5. Potential Construction Site Pollutant Sources – Contractor shall identify construction materials that will be usedand activities to be performed that have the potential to contribute pollutants other than sediment to stormwater runoff.
  6. Identification of Non-Stormwater Discharges – Contractor shall identify non-stormwater discharges that apply to the site and provide detail on how discharges will be eliminated, controlled or treated.
  1. Best Management Practices
  1. Schedule – Contractor shall identify schedule for deployment of BMPs. BMPs must be implemented, modified, and maintained to reflect the phases of construction and weather conditions. Contractor will be required to develop working relationship with Project Designer to develop the BMPs.
  2. Erosion and Sediment Control – Contractor shall identify a system of erosion and sediment control BMPs to meet the GCP requirement of providing site BMPs that are effective and result in the reduction or elimination of sediment related pollutants in stormwater discharges and authorized non-stormwater discharges from construction activity to the Best Available Technology standards. Further, stabilization BMPs shall be identified to reduce or eliminate pollutants after construction. The BMPs shall also b e identified on a project site map for each construction phase.
  3. Non-Stormwater & Material Management – Contractor shall identify the non-stormwater BMps to effectively reduce pollutants associated with material storage, material use, waste management, and reduce/properly manage “non-stormwater” that is used or generated on site. These BMPs shall also be identified on a project site map for each construction phase.
  4. Post Construction Stormwater Management Measures – Contractor shall include information in the SWPPP on the project’s post-construction BMPs that are required per the Ventura county Municipal Stormwater NPDES Permit (Order 2010-0108). These BMPs shall be identified on the Project Design plans.

Contractor shall be required to comply with the State General Construction National Pollutant Discharge Elimination System (NPDES) Permit, Order No. 2009-0009-DWQ, as well as the conditions and requirements of the Ventura Countywide Stormwater Quality Management Program, National Pollutant Discharge Elimination System (NPDES) Permit No. CAS004002, Order No. 2010-0108 (MS4 Permit).

B.Specific GCP Requirements

  1. Stormwater Pollution Prevention Plan (SWPPP) (see more details for SWPPPs below).
  1. Risk Level 1 Requirements – Contractor shall be responsible for complying[ak2] with the specific requirements as identified in “Attachment C – Risk Level 1 Requirements” of the State GCP Order 2009-0009-DWQ (see appendix ???? in this spec.). These requirements include sampling and monitoring for non-visible pollutants.

3.Stormwater Pollution Prevention Plan (SWPPP) Requirements

Contractor shall submit two hard copies of a site-specific SWPPP for review by the city. Once the City’s Stormwater Program Manager has approved the SWPPP, Contractor shall be responsible for making any required changes and re-submitting to the city an electronic copy and providing an original hard copy of the SWPPP for the job site. Contractor shall insure and provide documentation that the SWPPP is developed and amended by a Qualified SWPPP Developer (QSD). See GCP Order 2009-0009-DWQ for a list of qualifications. The SWPPP must be approved by the City before construction can start on the project. Contractor shall be responsible for submitting an electronic copy of any amendments made to the SWPPP by their QSD to the City. The City will be responsible for submitting an electronic copy of the SWPPP and any amendments to the State Water Resources Control Board.

Per the State GCP, the SWPPP must be designed to address the following objectives:

A.All pollutants and their sources, including sources of sediment associated with construction, construction site erosion and all other activities associated with construction activity are controlled;

B.All non-storm water discharges are identified and either eliminated, controlled, or treated.

C.Site BMPs are effective and result in the reduction or elimination of pollutants in storm water discharges and authorized nonstorm water discharges from construction activity to the Best Available Technology (BAT) standard.

D.Calculations and design details as well as BMP controls from site run-on are complete and correct.

E.Stabilization BMPs are installed to reduce or eliminate pollutants afterconstruction is completed.

F.To demonstrate compliance with the requirements of the State General Permit, the QSD shall include information in the SWPPP that supports the conclusion, selections, use, and maintenance of BMPs.

G.The SWPPP must be available at the construction site during working hours while construction is occurring and shall be made available upon request by a State or City inspector. When the original SWPPP is retained by a crewmember in a construction vehicle and is not currently at the construction site, current copies of the BMPs and map/drawing will be left with the field crew and the original SWPPP shall be made available via a request by radio/telephone.

H. The SWPPP shall incorporate all requirements listed in Attachment C – Risk Level 1 Requirements” of[ak3] the State GCP Order 2009-0009-DWQ (see appendix ????). These requirements include the following (see Attachment C for more details):

For assistance in developing the SWPPP, contractor shall refer to the State GCP Order 2009-0009-DWQ. Contractor shall be responsible for including in the site copy of the SWPPP the fact sheets of all BMPs listed in the SWPPP which can be obtained from the California Stormwater Construction Best Management Practice (BMP) Handbook Portal available at cost at or

SWPPP Certification Requirements – Contractor shall ensure that the SWPPP is written, amended and certified by a Qualified SWPPP Developer (QSD). If this project is still in construction after September 2, 2011 the Contractor shall ensure that all BMPs required by the GCP are implemented by a Qualified SWPPP Practitioner (QSP) (see p. 33-34 of GCP Order 2009-0009-DWQ). In addition the QSD and QSP must attend a State Water Board-sponsored or approved Qualified SWPPP Developer and Qualified SWPPP Practitioner training course by September 2, 2011.

SWPPP BMP Selection & Implementation & Erosion/Sediment Control Plan

The SWPPP must contain an erosion and sediment control plan sheet that details the location of all erosion and sediment control BMPs (including location of the material, equipment, vehicle storage areas and concrete washout areas, as applicable). Contractor shall be responsible for updating the SWPPP and erosion and sediment control sheet throughout the life of the project.

The Contractor shall provide continuously at the jobsite all of the tools, equipment, and materials necessary to implement the SWPPP at all times from project initiation through completion, including any punch list or warranty work on the project. Contractor shall ensure that all inspection, maintenance. repair and sampling activities at the project location shall be performed or supervised by a Qualified SWPPP Practitioner (QSP). The QSP may delegate any or all of these activities to an employee appropriately trained to do the tasks; however, training documentation must be included in the SWPPP. Contractor shall update the SWPPP via its QSD as necessary during the work to prevent contamination of the stormwater collection system. In the event circumstances during the course of construction require changes to the original SWPPP, a revised plan shall be promptly submitted to the City’s Stormwater Program Manager in each instance. No responsibility shall accrue to the City as a result of the plan or as a result of knowledge of the plan. All work installed by the contractor in connection with the SWPPP but not specified to become a permanent part of the project shall be removed and the site restored in so far as practical to its original condition prior to completion of construction or when directed by the City’s representative. See additional requirements for the SWPPP on p. 38 of GCP Order 2009-0009-DWQ.

In addition to the requirements listed in the State GCP, the SWPPP must contain all required documents as outlined in the Ventura County Municipal Stormwater NPDES Permit.

  1. Annual Compliance

By August 1 of each year, Contractor shall electronically prepare the Annual report for submittal to City who will electronically submit it to the State via the Stormwater Multi-Application Reporting and Tracking System (SMARTS) by September 1. The annual report must include a summary and evaluation of all sampling and analysis results, original laboratory reports, chain of custody forms, a summary of all corrective actions taken during the compliance year, and identification of any compliance activities or corrective actions that were not implemented. For required elements of the annual report see p. 40-41 of GCP Order 2009-0009-DWQ.

  1. Project Completion

Upon completion of the project, including landscaping and site cleanup, and in a timely manner, contractor shall complete, sign and submit to the City Stormwater Program Manager the Notice of Termination of coverage under the GCP, including preparation of the required site map and photos.

II.VenturaCounty Municipal Stormwater NPDES Permit, Order 2010-0108 Requirements

Development shall also be undertaken in accordance with conditions and requirements of the Ventura Countywide Stormwater Quality Management Program, National Pollutant Discharge Elimination System (NPDES) Permit No. CAS004002, Order No. 2010-0108 (MS4 Permit).

Required SWPPP Signatures/Certifications – The City’s approval signature shall be contained within the first pages of the SWPPP. The City shall not approve any SWPPP unless it contains appropriate site-specific construction site BMPs, specific locations, and maintenance schedules. The SWPPP must also include the rationale used for selecting or rejecting BMPs for various construction phases and weather conditions. The contractor or authorized qualified designee must sign a statement on the Local SWPPP to the effect:

“As the architect/ engineer of record, I have selected appropriate BMPs to effectively minimize the negative impacts of this project’s construction activities on storm water quality. The project owner and contractor are aware that the selected BMPs must be installed, monitored, and maintained to ensure their effectiveness. The BMPs not selected for implementation are redundant or deemed not applicable to the proposed construction activity.”

The SWPPP must also contain a certification statement for the City’s signature that reads:

“I certify that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to ensure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system or those persons directly responsible for gathering the information, to the best of my knowledge and belief, the information submitted is true, accurate, and complete. I am aware that submitting false and/ or inaccurate information, failing to update the Local SWPPP to reflect current conditions, or failing to properly and/ or adequately implement the Local SWPPP may result in revocation of grading and/ or other permits or other sanctions provided by law.”

In addition to controls required in the State GCP, Contractor shall be responsible for implementation of the following minimum BMPs as required under the MS4 Permit:

High Risk Sites BMP Implementation[ak4]

Contractor shall implementenhanced practices that preclude impacts to water quality posed by all construction sites on hillsides as defined in the MS4 Permit and construction sites that directly discharge to a waterbody listed on the CWA § 303 (d) list for siltation or sediment, or that occur within or directly adjacent to an Environmentally Sensitive Area (ESAs). Construction sites located on hillsides, adjacent to CWA 303(d) listed waters for siltation or sediment, and directly adjacent to ESAs are termed “High risk sites.”
