INVITATION TO TENDER(AS 4000 – 1997)

Tenders are invited from suitably qualified and experienced persons/companies to undertake the work under the contract (WUC) for the above contract.
(1) Description of Work (WUC) / The separate document entitled “Description of Work” describes the work required to complete the contract. That is the work under the contract (WUC).In summary the WUC covers all work required to reconstruct existing rural roads.
(2) Closing of Tenders / Tenders close at 12pm on Friday30March 2012.
Location for submitting tenders is at the Burdekin Shire Council offices at 145 Young Street, Ayr.
Tenderers must complete the Tender Form provided and lodge it with all required schedules, bills of quantities and accompanying information in a sealed envelope endorsed with “Tender Box” and the Contract name and number at the place and by the time stated.
Fax tenders will NOT be acceptable.

(6) Specifications / The Specifications describe the standard of work required under this contract. The specifications comprise two parts:
1 – Standard Specifications
The Standard Specifications included in this document are the Burdekin Shire Council Specifications/Guidelines for Civil Works, Department of Transport and Main Roads, Austroads and Austab Specifications and standard drawings.
2 – Job Specifications (Civil)
The Job Specifications amend and/or supplement the Standard Specifications to ensure suitability for the type of work under this Project. Insofar as any modified or additional clause in the Job Specifications may conflict or be inconsistent with any provision of the Standard Specifications, the Superintendent shall be notified.
(7) Standards and Codes / Equivalency of Standards and Codes
Wherever reference is made in the Contract to specific standards and codes to be met by the goods and materials to be furnished, and work performed or tested, the provisions of the latest current edition or revision of the relevant standards and codes in effect shall apply, unless otherwise expressly stated in the Contract. Where such standards and codes are national, or relate to a particular country or region, other authoritative standards that ensure a substantially equal or higher quality than the standards and codes specified will be accepted subject to the Superintendent’s prior review and written consent. Differences between the standards specified and the proposed alternative standards shall be fully described in writing by the Contractor and submitted to the Superintendent at least 28 days prior to the date when the Contractor desires the Superintendent’s consent. In the event the Superintendent determines that such proposed deviations do not ensure substantially equal or higher quality, the Contractor shall comply with the standards specified in the documents.

(9) Site Visit: / A formal site visit will be arranged with the date and time to be advised. Tenderers will be allowed to undertake their own independent site visits.
(10) Clarifications, Conditions and Tags / The Principal prefers that the tenders submitted should be free of anyqualifications ie. clarifications, conditions and tags. The Principal however, reserves the right to consider tenders that are submitted with clarifications, conditions or tags.
(11) Adjusted Tender Price / In consideration of a tender that has been submitted with an endorsement or qualification(s), the Principal or its agent may:
- Require the tenderer to withdraw the qualification(s) without any adjustment of the tender price; or
- Require the Tenderer to withdraw the qualification(s) with adjustment of the tender price provided that the adjustment is for an amount that would have been reasonably expected if the tender had been submitted without qualification.
- If in withdrawing any qualification, the Tenderer alters the price and the Principal or its agent considers that the alteration is not an amount that would have been reasonably expected, then the Principal reserves the right to no longer consider that tender.
- If the tender contains any error in extension of unit rates or in summation of items such as to vary the tendered sum, and the Principal or its agent becomes aware of the error prior to acceptance of any tender, then the Principal shall draw the error to the attention of the Tenderer whose tender contains the error.
- The Principal shall invite the Tenderer to confirm the tender price; and
- If the Tenderer alters the price, the Principal or its agent reserves the right to accept the adjusted price provided the adjustment is a correction of the error.
- If the Tenderer alters the price and the Principal or its agent considers that the alteration is not a correction of an error, then the Principal reserves the right to no longer consider that tender.
- No amended tender shall be considered if received after closing time for tenders or if adjusted otherwise than provided for above.
(12) Workplace Health and Safety Plan / The successful Tenderer shall, before work commences, prepare a Workplace, Health and Safety Plan (WHSP) specifically for the project. The WHSP must meet the requirements of the Queensland Workplace Health and Safety Act (and its current amendments) and will require a review by the Principal, the Principal's agent or its Superintendent before work is allowed to commence on site.
By submitting your WHSP the Contractor warrants to the Principal and the Engineer that the plan is appropriate for the works being constructed and meets all of the requirements of the Workplace, Health and Safety Act. If this is not the case then the Contractor is to inform the Engineer immediately and shall not commence work until the plan is amended and complies fully with the Act.
The tendered price shall allow for all costs associated with:
- Preparation of the WHSP.
- Implementing the WHSP and;
- Complying with the QueenslandWorkplace Health and Safety Act.
(13) Workplace, Health and Safety Officer / Tenderers shall submit the name of the Safety Officer appointed for this contract whose responsibility it shall be to manage the site to meet the requirements of theQueensland Workplace Health and Safety Act.
(14) Schedule of Wet Weather Days / Tenderers are required to consider and make due allowance within the contract period and construction programme for days per calendar month expected to be lost due to inclement weather (and the effects of wet weather) as they apply to the critical path of the construction programme.
Tenderers shall specify in the "Schedule of Wet Weather Days" the number of wet day allowances that have been included in their programme (and the contract period) for each calendar month. This covers weather sufficiently inclement to interfere with the progress of the work being greater (warranting an extension) or less (warranting a reduction in the contract period) than the allowances provided in the wet weather schedule nominated in the tender will be reviewed on a monthly basis and recorded in the site minutes.
(15) Quality Assurance / Each tenderer is to provide details of their quality assuranceprocedures.
(16) Non Conforming Tender / A tender is deemed to be non conforming when the requirements of the conditions of tendering are not complied with. That is:
- The tender was not submitted on time or incorrectly submitted.
- The Tender Form was not submitted (signed).
- The required schedules were not submitted.
- The tenderer refuses to remove an endorsement or a tender qualification.
- The tender deposit (if required) was not submitted with the tender.
- Other requirements listed in the Invitation to Tender.

The Tenderer shall make due allowance within the contract period and construction programme for days per calendar month expected to be lost due to inclement wet weather (and the effects of wet weather) as they apply to the critical path of the construction programme.
The Tenderer shall note that wet days are based on a 6 day construction week (Monday - Saturday) and that wet days will be assessed weekly at site meetings and recorded in the Site Minutes.
Should the assessed monthly total of wet days (or the effect of wet days) approved by the Superintendentto have affected the critical programme be greater (warranting an extension) or less than (warranting a reduction) the nominated allowance for that month, then the contract period will be adjusted respectively.
