Receipt is acknowledged of the October 6, 2014 Petitions of Verizon Pennsylvania LLC and Verizon North LLC pursuant to 66 Pa. C.S. § 3016(a) wherein the Verizon companies petition the Commission to declare as competitive all protected or noncompetitive retail services offered by the Verizon companies within their Philadelphia, Erie, Scranton-Wilkes Barre, Harrisburg, Pittsburgh, Allentown, and York service area regions. The petitions also request waivers of Commission regulations for competitive services.

Pursuant to 52 Pa. Code § 5.14, the Commission will proceed with publishing the attached notice in the Pennsylvania Bulletin. This notice will appear in the Saturday, October 11, 2014 issue. In accord with 66 Pa. C.S. § 501(a), the Commission has determined to establish a ten (10) day period for formal protests. Parties wishing to file formal protests, answers, or as applicable, petitions to intervene, must actually file either electronically or in-hand with the Office of the Secretary no later than close of business (4:30 p.m. EDT) on Tuesday, October 21, 2014.

You are directed upon receipt of this letter to publish the enclosed notice once in a newspaper having a general circulation in each geographic region of the Commonwealth of Pennsylvania affected by the Petition involved on or before Saturday, October 11, 2014, and to file proof of publication with the Commission on or before Tuesday, October 21, 2014. The newspapers of general circulation located in the geographic areas affected by the Petition are: Pittsburgh Post-Gazette, Erie Mirror Times, Harrisburg Patriot News, York Dispatch, Allentown Morning Call, Scranton Times Tribune, Wilkes-Barre Times Leader, and both the Philadelphia Daily News and the Philadelphia Inquirer.

This matter has been assigned to the Office of Administrative Law Judge for expedited process, which will result in a certification of the record to the full Commission after the submission of main and reply briefs. A pre-hearing conference has been scheduled for Thursday, October 23, 2014.

NOTICE TO BE PUBLISHED

On October 6, 2014, Verizon Pennsylvania LLC and Verizon North LLC (Verizon Companies) filed petitions pursuant to 66 Pa. C.S. § 3016(a) wherein the Verizon companies request that the Pennsylvania Public Utility Commission (PUC) declare all protected or noncompetitive retail services offered by the Verizon companies as competitive services within the Philadelphia, Erie, Scranton, Harrisburg, Pittsburgh, Allentown and York regions. The petitions also request waivers of PUC regulations for competitive telecommunications services. For the PUC to approve the petitions, the Verizon companies must demonstrate the availability of like or substitute services for the protected or noncompetitive services offered by the Verizon companies in these geographic regions and other relevant information in accordance with the statutory criteria as provided in 66 Pa. Pursuant to 66 Pa. C.S. § 501(a), the PUC has determined to establish a ten (10) day period for the timing of formal protests from the October 11, 2014 publication date in the Pennsylvania Bulletin. The PUC will consider as timely filed formal protests, answers, and petitions to intervene, as applicable, physically received by the Office of the Secretary either via the PUC’s e-Filing system or hard copy no later than the close of business (4:30 p.m. EDT) on Tuesday, October 21, 2014. No extensions will be given for postal or overnight delivery. All filings must otherwise conform to the requirements of 52 Pa. Code § 1.1 et seq.
