920,000cubicyardsofsandfromoneoffshore borrow area. A550footrubblemound segmentedbreakwater willbeconstructedapproximately325feetoffshore fromR-25,andtwo

200footsheetpileT-head groinswillbeconstructedinthevicinityofR-26andapproximately halfwaybetween R-25andR-26,onStateParkProperty. Theactivityincludesa10-year sovereignsubmergedlandspubliceasement fortheerosioncontrolstructuresandtheproposed borrow area. Asmitigation for0.85acresofsurfzonerockhabitatthatwillbeburiedbythis project,0.9acresofhardbottomsubstrate (limestoneboulders)willbeplacednearDEP ReferenceMonumentR-11,directlyoffshore fromtheexisting naturalsurfzonehardbottom,in

8.0to10.0feet(NGVD)depth,witha1.5-foothardbottorilrelief.

metersdowncurrentfromthepointofdischarge,nottoextendintotheGasparillaSound- CharlotteHarborAquaticPreserve(VarianceNumber0174403-002-EV).

OnJune19,2003,theDepartmentissuedModificationNo.0174403-002-JCtoallowexcavation oftheborrowsitetothedepthofdredgingoriginallyrequestedinthepermitapplicationin order toensurethatasufficientamountofsandisavailableforplacementintheapprovedbeach constructiontemplate,andincreasetheoperationalefficiencyofthehydraulicdredge. The primaryborrowsiteforthisprojectcoversapproximately90acreswithintheboundariesofthe originallyapprovedborrowsiteandcontainsapproximately2.2millioncubicyardsofsand, ratherthan1.1millioncubicyardsofsandasapprovedintheoriginalpermit.

OnAugust11,2003,the DepartmentissuedModificationNo.0174403-003-JCtocorrecta discrepancybetweentheprojectdescriptionandtheauthorizedexcavationplan.Theerrorinthe dredgedepthsoftheprojectdescriptionwascorrectedtoreflecttheauthorizedexcavationplan depictedinthepermitdrawing.

JUSTIFICATIONFORMODIFICATION

Thedunefeaturewasaddedtoaccountforerosionallossafterthehurricaneseasonsof2004. A continuousseawallfrontsmostofthisarea,andadunefeaturewilladdprotectionandaidin stabilizingthebeach.Inaddition,theremovalofthederelictstructures,includingdogbone groins,debris,andwoodenpilings,isnecessaryasthesestructuresarenolongerfunctioning,and theirremovalshouldsupersedeanynourishmentactivity.Themitigationreefsiteisbeing relocatedinordertoavoidasmallhardbottomareathatwasrecently discoveredwithinthe originalmitigationreefplacementarea. Theportionofthecontingencyplanthatrequired remediationofanyproject-relatedimpactsatthesouthendof GasparillaIslandisbeingdeleted. ThereasonforthischangeisthatthesouthendofGasparillaIslandissoontobeclassifiedbythe Departmentascriticallyeroded,andthis erosionhasoccurredpriortotheconstruction

authorizedbythispermit. Therefore,thepermitteewillnotbeheldresponsibleforrepairingpre­

existingdamage.

STAFFASSESSMENT

TheDepartmentrecommendsandmaymandatetheremovalofanyderelictstructures,especially thosethatarelocatedseawardoftheECL, priortonourishmentefforts.

Infindingsuitablelocationsformitigationreefs,theDepartmentrequirestheavoidanceof existinghardbottomresources.Theupdatedpermitdrawingsincludedinthispermit modificationshowthemitigationreeflocation.

Thedeletionofaportionoftherequiredcontingencyplan,whichrequiredmitigationforany project-relatedimpactsatthesouthend ofGasparillaIsland,wasrequestedbecausethatareais alreadysignificantlyeroded.Thiserosionisthreateningtheuplandproperty,evenbefore constructionofthepermittedstructures.TheGasparillaIslandshorelineadjacenttoBocaGrande Passisdowndriftofthepermittederosioncontrolstructures. SpecificPermitCondition#5 requiresacontingencyplantomitigateanysignificanterosionto thedowndriftGasparillaIsland shorelineattributabletotheerosioncontrolstructures. However,sincethestructuresdidnot causetheexistingerosionproblem,thepermitteewillnotbeheldresponsibleformitigatingthis lossofsand.

TheDepartmentrecommendsthatLeeCountyshoulddevelopabeachmanagement

strategytoaddressthissignificantlyerodedarea. Furthermore,theDepartmentrecommendsthat thepermitteeshouldevaluatealternativestoaddresstheerosionconditionsalongtheinlet shoreline. Thecontingencyplan requirementforCayoCostawill notbedeletedfromthepermit.

NeithertheDepartmentnortheFloridaFishandWildlifeConservationCommission(FWC) objecttotheduneaddition.TheFWCstatedthat itisimportantthatthedunebeconstructed suchthattherearenolowareas,orswalesonthelandwardsideofthedunethatwouldbe accessibletonestingturtles,asitispossiblethattheymightbeabletoclimboverthedune feature.Thedunemustbeconstructedsothatitdoesnotinadvertentlycreatea"path"forturtles to movefartherlandwardthanthenestingbeach.Somedunereconstructionconditionshave

beenaddedtothepermitinthismodification.

Duringtheirreviewofthisapplicationtomodifythepermit,theFWCrestatedtheirconcernover thesteepbeachprofilebecauseofthepotentialtocausescarping. Theapplicantshouldbe preparedtoimplementappropriateshorebirdmonitoringandprotectionmeasuresifthisprojectis constructedduringthe shorebirdnestingseason,fromFebruarythroughSeptember. Asthe updatedIncidentalTakeAuthorizationandBiologicalOpiniondidnotincludeanyadditional preconstructionmonitoringconditions,noadditionalterms areneededtobeincludedwithinthis permitmodification(Sp. Condition22).

Theprojectdescriptionshallberevisedasfollows(strikethrol:lghsaredeletions,underlinesare additions):

PROJECTDESCRIPTION:

Beachfillwillbe placedbetweenDNRReferencemonumentsR-10andR-26. Theprimaryborrowareaforthisprojectcoversapproximately90acreswithinthe boundariesoftheoriginallyapprovedborrowsiteand containsapproximately2.2million cubicyardsofsand.Theprojectwilluseapproximate920,000cubicyardsofthis material. Theapproveddepthofdredgingwithineachsub-areaoftheborrowsiteis

shownintheattachedpermitdrawing. Thedepthofdredgingforsub-areacuts1through

4is-24.0feet(NGVD)andforcut5is-20.0feet(NGVD).Thebeachconstruction profileswillhaveaseawardslopeof1/10and abermwidthvaryingbetween145to215

feetatelevationsbetween5feet(NGVD)atthelandwardend ofthebermand4.2feetat the seawardendoftheberm. Atwofootdunefeaturewillbeaddedinthenorthernprojectarea,fromR-17northtoapproximatelyR10.5. Asegmentedbreakwaterwillbe locatedapproximately325feetoffshorefromR-25,andtwoT-headgroinswillbe constructedinthevicinityofR-26andapproximatelyhalfwaybetweenR-25andR-26, onStateParkProperty. Thebreakwater,willconsistsof2segmentswithasmallgap, andit willbearubblemoundtypestructure. Thetotallengthofthecombined breakwatersegmentsis550feetwithacrestelevationof3feet(NGVD). TheT-groins aretobeconstructedofsheetpileswitharockapronintheseawardsideoftheT-head

segments. ThelengthofeachT-headis200fthaving acrestelevationof2feet(NGVD). TheaveragesizeoftherockforthebreakwaterarmorandT-groinapronsis5tonsand2 tonsrespectively. Therockwillhaveaminimumdensityof160lb/ft3 forthebreakwater armorand155lb/ft3fortheT-groinaprons.

Thespecificconditionsshallberevisedasfollows:

SPECIFICCONDITIONS:

5.Priortoissuanceofanoticetoproceed,thepermitteeshallsubmitacontingency plantomitigateanysignificanterosiontotheEio:wndriftGasparillaIslaneshorelineattribatabletotheerosioncontrolstrlietlifesortotheCayoCosta shorelineattributabletotheexcavationoftheebbshoalborrowareaasidentified inthemonitoringreports.Thecontingencyplanshallidentifythespecific

shorelinechangesand conditionsbywhichthepermittedactivitieswillbedeemed tohavecausedadverseimpactsthattriggermitigationbythepermittee.Corrective actionsshallincludetheplacementofbeachfillmaterialsufficienttorestoreand maintaintheimpactedshorelinethroughthenextmonitoringperiodand/or adjustmentoftheerosioncontrolstructurestoalleviatetheimpactstothe

impactedshoreline.

22.Priortoinitiatingconstructionofeitherthenearshorebreakwaterorthet-head groins,thepermitteeshallreceiveauthorizationfromtheU.S.FishWildlife Serviceforincidentaltakeduetothesestructures. Alltermsanaconeitionsinclaeee intheFWS'sreviseslfleidentalTaJ(eAathorizationanaBiological Opinionshallbeincorporatesietothispermittflroaghaminormoeification. Any monitoringplansorexperimentalEiesignsformarinetartlesdevelopeeaspartof theIneieentalTakeaHthorizationshallalsobeincorporatesintothispermit throughaminormoeification.

23.Fillmaterialshallbecompatiblewithnativesandbothingrainsizedistributionandcolor.Sandsourcesshallbefreefromclay,marl,cobbleorconstruction debrisandshallnotcontainmorethan5percentfinesbyweight.

24.Plantingofdunevegetationisauthorizedtooccurduringthemarineturtlenestingseason(May1throughOctober31)underthefollowingconditions:

a.Itis theresponsibilityofthepermitteetoensurethattheprojectareaand accesssitesaresurveyedformarineturtlenestingactivity. Allnestsurveys,nest relocations.screeningorcagingactivities,etc.,shallbeconductedonlybypersonswithpriorexperienceandtrainingintheseactivitiesandisdulyauthorizedtoconductsuchactivitiesthroughavalidpermitissuedbyFWCpursuantto FloridaAdministrativeCode68E-l.Forinformationregardingwhethertheprojectbeach issurveyedbyqualifiedpersonnel,contacttheImperiledSpeciesManagementSectionat(561)575-5455.

b.Marineturtlenestsurveysshallbeinitiatedatthebeginningofthenesting seasonor65dayspriortoinstallationofplants(whicheverislater).SurveysshallcontinueuntilcompletionoftheprojectorthroughSeptember15(whicheveris earliest). Surveysshallbeconductedthroughouttheprojectareaandallbeachaccesssites.

c.Anynestsdepositedinanareanotrequiringrelocationforconservationpurposes(asdeterminedbythemarineturtlepermitholder)orfortheauthorized beachnourishmentprojectshallbeleftinsitu. Themarineturtlepermitholdershallinstallanon-beachmarkeratanynestsiteandasecondarymarkerlocatedat a pointasfarlandwardaspossibletoensurethatfuturelocationofthenestwillbepossibleshouldtheon-beachmarkerbelost.Aseriesofstakesandsurveyribbon orstringshallbeinstalledtoestablishanareaof3feetradiussurroundingthe

nest. Noplantingorotheractivityshalloccurwithinthis areanorshallany

activityoccurthatmightcauseindirectimpactswithinthisarea. Nestsitesshallbeinspecteddailytoensurenestmarkershavenotbeenremoved.

d.Theuseofheavyequipment(includingtrucks)isnotauthorizedseaward ofthedunecrestorarmoringstructureexceptduringthebeachnourishment project. Alightweight(ATVstyle)vehicle,withtirepressuresof10p.s.i. orlessmayoperateonthebeach.

e.Anyvegetationplantingorplacementofirrigationmaterialsthatoccur duringmarineturtlenestingseasonshallbeinstalledbyhandlabor/tools.

f.Irrigation(ifproposed)shallbeentrenched1to3inchesbelowgradesoas nottoposeabarrierto hatchlingsandtoallforeasyremoval. Irrigationpiping shallavoidallmarkednestsbyaminimumoften(10)feet.Theirrigationsystem shallbe designedandmaintainedsothatwateringofthe unplantedsandybeachdoesnotoccur. Intheeventamarineturtlenestisdepositedwithinthenewly establishedduneplantingarea,thepermitteeshallmodifytheirrigationsystemso thatwateringwithin10feetofthenest doesnotoccur. Dailyinspectionoftheirrigationsystem shallbeaccomplishedbythepermitteetoensurecompliance

withthis condition.

g.Allactivityshallbeconfinedtodaylighthoursandshallnotoccurpriortothecompletionofallnecessarymarine turtlesurveysand conservationactivities withintheprojectareaduringmarineturtlenestingseason. Nighttimestorageofequipmentormaterialsshallbeoffthebeach(landwardofthedunecrest,existing seawallsorbulkheads).

h. Intheeventanestisdisturbedoruncoveredduringplantingactivity,the permitteeshallceaseallwork andimmediatelycontacttheperson(s)responsibleformarineturtleconservationmeasureswithineprojectarea.Ifanest(s)cannot

besafelyavoidedduringconstruction,allactivitieswithintheaffectedprojectarea

shallbedelayeduntilcompletehatchingandemergenceofthenest.

1.Existingnativedunevegetationshallbedisturbedonlytotheminimumextentnecessary.Onlynativesalttolerantplantspeciesareauthorizedtobeinstalled.

DerelictstructureRemoval

25.Derelictstructuresonthebeachshallberemovedtoaminimumdepthoftwo(2)feetbelowthenaturalbottomcontour,asshownonthedrawings. Whennocontourisshown,elevationsforthenearestprofileatcorrespondingperpendicularrangesshallbeused.

26.TheContractorshallberequiredtoexcavateaminimumoften (10)feet surroundingthehorizontallimits ofthederelictstructures,asdefinedbytheCounty,toaminimumoftwofeetbelowtheelevationofthenaturalbottom contour,asshownonthedrawings. Allderelictstructureswithintheten(10)footradiusshallberemovedinaccordancewiththisspecification. TheContractor shallexcavateanadditionalten(10)feetbeyondanyderelictstructurefound,in accordancewiththisspecification. Excavationsshallbemadein accordancewithallapplicablefederal.stateandlocalrequirements.

27.Theexcavatedstructuresshallbedisposedofatanuplandsite,landwardofthecoastalconstruction controlline.Thebeachshallberestoredtoitsfinalgrade condition uponcompletion ofstructureremoval.

28.Atnotimeshalltheexcavated areabeunattended. Personnel shallbepresenttodirectpedestrian trafficaroundexcavated areas. Signageandwarningsystems shallalsobeusedtoinformbeachusersofpotentialhazardsintheworkarea.

The followingconditionsare requiredtominimizeimpactstoshorebirds.

29.ShorebirdSurveys.Shorebird surveysshallbeconducted bytrained,dedicatedindividuals(Shorebird Monitor)withprovenshorebird identificationskillsand aviansurveyexperience.CredentialsoftheShorebird Monitor willbesubmittedtotheFWCRegionalBiologist forreviewandapproval.Shorebird Monitors will usethefollowingsurveyprotocols:

a.Nesting Season Surveys.Shorebird Monitorsshouldreviewandbecome familiarwiththegeneralinformationanddatacollectionprotocolsoutlinedonthe FWC'sBeach-NestingBirdWebsite( ofwhatdatashouldbecollected,includingdownloadablefielddatasheets,is availableonthewebsite.

1.Thenestingseasonisgenerally1April-1September,butsomenestingmayoccurthroughSeptember.Inaddition,theimperiledsnowyplover(Charadriusalexandrinus)maynestasearlyasFebruary alongthewestcoastandpanhandleofFlorida. NestingseasonsurveysshallbeginonApril1(orFebruary15insnowyploverhabitat)or10days priortoprojectcommencement(including surveyingactivities

andotherpre-constructionpresenceonthebeach),whicheverislater, andbeconducted dailythroughout theconstructionperiodorthrough Augustifnoshorebird nestingactivity isobserved.

n. Nestingseasonsurveysshallbeconducted inallpotentialbeach­nestingbirdhabitatswithintheprojectboundariesthatmaybe impactedbyconstruction orpre-constructionactivities duringthenestingseason. Portionsoftheprojectinwhichthereisnopotentialforproject-relatedactivityduringthenestingseason maybeexcluded.

iii.Surveysfordetectingnewnestingactivityshallbecompletedona dailybasispriortomovementofequipment,operationofvehicles,orotheractivitiesthatcouldpotentiallydisruptnestingbehaviororcause harmtothebirdsortheireggsoryoung.

IV. Surveysshouldbeconductedbywalkingthelengthoftheprojectarea andvisuallyinspecting,usingbinocularsorspottingscope,forthe presenceofshorebirdsexhibitingbreedingbehavior.

v. If anATVorothervehicleisneededtocoverlargeprojectareas,the vehiclemustbeoperatedataspeed<6mph,shallberunatorbelow thehigh-tideline,andtheShorebirdMonitorshallstopatnogreater than200meterintervalstovisuallyinspectfornestingactivity.

VI. Oncebreedingisconfirmedbythepresenceofascrape,eggsoryoung,theBirdMonitorshallnotifytheRegionalNongameBiologistofthe FWCwithin24hours. AllbreedingactivityshallbereportedtotheBeach-NestingBirdwebsitewithinoneweekofdatacollection.

vii.Observationsofnon-breedingshorebirdsshallbereportedtothe

Shorebird-SeabirdOccurrenceDatabase,asdescribedbelow.

b.Non-BreedingShorebirdSurveys.Datacollectedonnon-breedingshorebirdsshouldbecompatiblewith,andreportedto,theShorebird-Seabird OccurrenceDatabase(

1. Surveysfornon-breedingshorebirdsshallbegin14dayspriortoconstructioncommencementandbeconductedonceevery2weeksfor atleastoneyearpost-construction. Datacollectedduringthese

surveysshallprovidevaluableinformationontheuse ofnourishedbeachestoshorebirds.

n. Surveyfornon-breedingshorebirdsshallincludeallpotentialshorebirdhabitatwithintheprojectboundary.

iii.Datashallbeenteredinto thedatabasewithinonemonthofcollection.

30.BufferZonesandTravelCorridors.Withintheprojectarea,thepermitteeshall establisha300ft-widebufferzonearoundanylocationwhereshorebirdshave been engagedinnestingbehavior,includingterritorydefense. Anyandall

constructionactivities,includingmovementofvehicles,shallbeprohibitedinthebufferzone.

a.Thewidthofthebufferzoneshallbeincreasedifbirdsappearagitatedor disturbedbyconstructionorotheractivitiesinadjacentareas.

b.Site-specificbuffersmaybeimplementeduponapprovalbyFWCasneeded. Reasonableandtraditionalpedestrianaccessshouldnotbeblocked

wherenestingbirdswilltoleratepedestriantraffic.Thisisgenerallythecasewithlateralmovementofbeach-goerswalkingparalleltothebeachatorbelowthehighesttideline. Pedestriantrafficmayalsobetoleratedwhennestingwasinitiatedwithin300feet ofanestablishedbeachaccesspathway.ThepermitteeshallworkwithFWCstafftodetermineifpedestrianaccesscanbeaccommodatedwithoutcompromisingnestingsuccess.

iii.Designatedbufferzonesshallbepostedwithclearlymarkedsignsaroundtheperimeter. Ifpedestrianpathwaysareapprovedwithinthe

300-footbufferzone,theseshouldbeclearlymarked. Thesemarkingsshallbe maintaineduntilnestingiscompletedorterminated.Inthe caseofsolitarynesters,nestingisnotconsideredtobecompleteduntil allchickshavefledged.

tv.Noconstructionactivities,movementofvehicles,orstockpilingof equipmentshallbeallowedwithinthebufferarea.

v. FWC-approvedtravelcorridorsshallbedesignatedandmarkedoutsidethebufferareas.Heavvequipment,othervehicles,orpedestriansmay transitpastnestingareasinthesecorridors. However,otheractivitiessuchasstoppingorturning,shallbeprohibitedwithinthedesignatedtravelcorridorsadjacenttothenestingsite.

vt. Wheresuchatravelcorridormustbeestablishedwithintheprojectareaitshouldavoidcriticalareasforshorebirds(knownnestingsites,winteringgrounds,FWC-designatedCriticalWildlifeAreas,and USFWS-designatedcriticalpipingploverhabitat)asmuchaspossible,andbemarkedwithsignsclearlydelineatingthetravelcorridorfrom theshorebirdbufferareasdescribedabove.

vii.Tothedegreepossible,thepermitteeshouldmaintainsomeactivity withinthesecorridorsonadailybasis,withoutdirectlydisturbinganyshorebirdsdocumentedonsiteorinterferingwithseaturtlenesting,

especiallywhenthosecorridorsare establishedpriortocommencementofconstruction. PassivemethodstomodifynestingsitesuitabilitymustbeapprovedbyFWCRegionalNongameBiologistforthatregion.

c.Notification.Ifshorebirdnestingoccurswithintheprojectarea,abulletin boardshallbe placedandmaintainedintheconstructionareawiththelocation mapoftheconstructionsiteshowingthebirdnestingareasandawarning,clearly visible,statingthat"BIRDNESTINGAREASARE PROTECTEDBY THEFLORIDATHREATENEDANDENDANGEREDSPECIESACTANDTHE STATEandFEDERALMIGRATORYBIRDACTS".

d.BeachContours. Alltillingandscarpremovalshouldbedoneoutsidetheshorebirdnestingseason.Itistheresponsibilityofthecontractorstoavoidtilling orscarpremovalin areaswherenestingbirdsarepresent.

1. Arelativelyevensurface,withnodeeprutsorfurrows,shallbecreatedduringtilling.Todothis,chain-linkedfencingorothermaterialshall bedraggedoverthoseareasasnecessaryaftertilling.

11. Theslopebetweenthe meanhighwaterlineandthemeanlowwaterlineshallbemaintainedinsuchamannerastoapproximatenatural slopes.

e.PlacementofEquipmentandSand. Ifitwillbenecessarytoextendconstructionpipespastaknownshorebirdnestingsiteorover-winteringareaforpipingplovers, then wheneverpossiblethosepipesshouldbeplacedlandwardofthesitebeforebirdsareactiveinthatarea. Nopipeorsandshallbeplaced seawardofaknownshorebirdnestingsiteduringtheshorebirdnestingseason.

Afterthoroughreviewofyourapplication,stafffindsthattheproposedmodificationisnot expectedtoadverselyaffectwaterquality orbecontrarytothepublicinterest. Staffhasalso determinedthattheproposedalterationdoesnotincreasethepotentialforadverseimpactonthe coastalsystem,publicbeachaccessseawardofthemeanhighwaterlineornestingseaturtlesand hatchlingsandtheirhabitat,andthattheproposedalterationdoesnotreducethedesignadequacy oftheproject. Sincetheproposedmodificationis notexpectedtoresultinanyadverse environmentalimpactorwaterqualitydegradation,thepermitisherebymodifiedasstated above. Bycopyofthisletterandtheattacheddrawings,wearenotifyingallnecessarypartiesof themodifications.

ThisletterofapprovaldoesnotaltertheMarch15,2012expirationdate,otherSpecificor GeneralConditions,ormonitoringrequirementsofthepermit. Thisletterandtheaccompanying drawingsmustbeattachedtotheoriginalpermit. Allpermitdrawingsaretobereplacedwith

thismodification. The18reviseddrawingsshallbelabeled"Modification0174403-004-EM".

ApersonwhosesubstantialinterestsareaffectedbytheDepartment'sactionmaypetitionforan administrativeproceeding(hearing)underSections120.569and120.57,F.S. Thepetitionmust containtheinformationsetforthbelowandmustbefiled(receivedbytheclerk)intheOfficeof GeneralCounseloftheDepartmentat3900CommonwealthBoulevard,MailStation35, Tallahassee,Florida32399-3000.

Becausetheadministrativehearingprocessisdesignedtoredeterminefinalagencyactiononthe application,thefilingofapetitionforanadministrativehearingmayresultinfurther modification ofthepermitorevenadenialoftheapplication. andtelephonenumberofthepetitioner'srepresentative,if any,whichshallbethe addressforservicepurposesduringthecourseoftheproceeding;andan explanationofhowthepetitioner'ssubstantialinterestsareorwillbeaffectedby theagencydetermination;

(c)Astatementofwhenandhowthepetitionerreceivednoticeoftheagency decision;

(d)Astatementofalldisputedissuesofmaterialfact. Iftherearenone,thepetition

mustsoindicate;

Whentherehasbeenno publicationofnoticeofagencyactionornoticeofproposedagency actionasprescribedinRule62-110.106,F.A.C.,apersonmayrequestacopyoftheagency action.
