1. / SUBJECT: / ESTIMATING THE COST OF UNDOCUMENTED IMMIGRANTS TO THE COUNTY OF SAN DIEGO (DISTRICT: 5)
OVERVIEW:
On May 9, 2006 this Board voted unanimously to investigate the cost of illegal immigration on the County’s budget. A study of that information was completed in September of this year by Dr. John Weeks and Dr. David Eisenberg.
The numbers are astounding. Using methodology similar to that of the 2000 Border Counties Coalition analysis, Dr. Weeks and Dr. Eisenberg were able to give an estimate of the impact that a porous border has on County taxpayers. Approximately $101.5 million was drained from the County budget in fiscal year (FY) 2006-2007. The estimated cost of these services per legal resident is $35.31. In addition to County costs, roughly $155 million was spent for uncompensated care at our community hospitals. While not a direct cost to the County, the hospitals are still a vital part of our communities. Those combined figures bring the total cost to county taxpayers to $89.21.
Today’s action would ask our Congressional Representatives to bring forth legislation on behalf of the County of San Diego to ease the financial burden to taxpayers that a lack of border enforcement has caused.

RECOMMENDATION:
SUPERVISOR HORN
1.  Direct the Chief Administrative Officer to draft a letter, for the signature of the Chairman of the Board of Supervisors, which is addressed to Congressman Brian Bilbray, Chairman of the Immigration Reform Caucus.
2.  The letter will request Congressman Bilbray to work through the Caucus to discuss the possibility of: (a) sharing information between Immigration and Customs Enforcement (ICE) and local law enforcement, (b) directing dollars from the Social Security Administration (SSA) “earning suspense file” to the County of San Diego, and (c) restructuring the guidelines of Section 1011 of the Medicare Modernization Act (MMA) to distribute funding to cover more of the burden of local hospitals.
ACTION:
Adding the following recommendations:
·  Direct the Chief Administrative Officer to send a copy of the study to each member of San Diego County’s Congressional Delegation with a letter from the Chief Administrative Officer;
·  Direct the Chief Administrative Officer to send a copy of the bill and the study to the President of the United States;
·  Direct the Chief Administrative Officer to electronically submit the study to each of the Supervisors in California’s 58 counties and to those in the 24 counties that are part of the U.S./Mexico Border Counties Coalition.

2. / SUBJECT: / DISTRICT ATTORNEY REQUEST FOR RATIFICATION OF OUT OF COUNTY TRAVEL (DISTRICTS: ALL)
OVERVIEW:
In accordance with Board of Supervisors Policy D-7, Out-of-County Business and Related Guidelines and Processes, this is a request to ratify the travel for one (1) Deputy District Attorney III who traveled to Honolulu, Hawaii. This trip occurred July 15, 2007 through July 19, 2007, and was for the purpose of attending the 2007 Ninth Circuit Judicial Conference.
FISCAL IMPACT:
Funds for this request are included in the Fiscal Year 2007-09 Adopted Operational Plan for the District Attorney. This trip resulted in total costs of $2,183 for travel, lodging, and per diem expenses. No overtime was generated as a result of this travel. This trip resulted in no future costs and required the addition of zero staff years.
RECOMMENDATION:
DISTRICT ATTORNEY
1.  Ratify travel and per diem to Honolulu, Hawaii for one (1) Deputy District Attorney III for attendance at the 2007 Ninth Circuit Judicial Conference from July 15, 2007 through July 19, 2007.
2.  Ratify the Chief Administrative Officer’s and District Attorney’s selection of one (1) Deputy District Attorney III to attend the 2007 Ninth Circuit Judicial Conference from July 15, 2007 through July 19, 2007.

3. / SUBJECT: / SHERIFF’S DEPARTMENT REQUEST FOR SOLE SOURCE PROCUREMENT OF BODY ARMOR (DISTRICTS: ALL)
OVERVIEW:
On July 13, 2004 (8) your Board approved the Sheriff’s procurement of National Institute of Justice (NIJ) Standard 0101.03, Threat Level IIIA Body Armor and Level IIIA Raid Style Vests from an authorized vendor of Protective Apparel Corporation of America (P.A.C.A.). The Board authorized the Sheriff to change to a different model from the same manufacturer if an improved model of body armor or raid vest is tested and accepted by the Sheriff’s Department. Based on the manufacturer’s guidelines, body armor vests require personal sizing in order to have the proper protective coverage. Due to this requirement a local authorized dealer is required. The Sheriff’s Department searched authorized dealers of P.A.C.A. and has identified San Diego Police Equipment Company, Inc. as the only authorized dealer within the County of San Diego. No other P.A.C.A. authorized dealer is within the geographical vicinity that would meet the Sheriff’s Department minimum needs for proper sizing of body armor in an economical and efficient manner.
FISCAL IMPACT:
The funds for this request are included in the Sheriff’s Department Fiscal Year 2007-08 Adopted Operational Plan. The funding source is Proposition 172 Revenue. If approved, this request will result in $400,000 current year costs and will require the addition of zero staff years.
RECOMMENDATION:
SHERIFF
1.  Waive the advertising requirements of Board Policy A-87.
2.  In accordance with Board Policy A-87, Competitive Procurement, approve and authorize the Director of the Department of Purchasing and Contracting to contract with San Diego Police Equipment Company, Inc; as the nearest authorized dealer of Protective Apparel Corporation of America (P.A.C.A.); and subject to determination of a fair and reasonable price, award a sole source contract for the purchase of National Institute of Justice (NIJ) Standard 0101.03, Threat Level IIIA Raid Style Tactical Vests, ballistic collar, bicep and groin armor system protection options, Level III & IV Hard Armor Ballistic Plates and Modular Pouches, for a three-year period; in conjunction with the original Board Letter on July 13, 2004 (8) and to amend the contract as needed to reflect changes to services and funding, subject to approval of the Sheriff.

4. / SUBJECT: / PUBLIC DEFENDER - REQUEST FOR APPROVAL OF OUT OF COUNTRY TRAVEL (DISTRICTS: ALL)
OVERVIEW:
In accordance with Board of Supervisors Policy D-7, Out-of-County Business and Related Guidelines and Processes, this is a request to approve the travel of one (1) Deputy Public Defender, to travel to Hagatna, Guam to be an instructor for the District Court of Guam and the Guam Bar Association in their Annual District Conference from October 2 through October 8, 2007.
FISCAL IMPACT:
Funds for this request are included in the Public Defender’s Fiscal Year 2007-08 Operational Plan. All travel and accommodation costs will be paid for by the Guam District Court. The Deputy Public Defender will receive regular salary and benefits and no overtime costs will be incurred as a result of this trip. This request will result in no future cost and will not require the addition of staff years.
RECOMMENDATION:
CHIEF ADMINISTRATIVE OFFICER
1.  Approve salary only travel to Hagatna, Guam for one (1) Deputy Public Defender to participate in the Guam District Court Annual Conference from October 2 through October 8, 2007.
2.  Accept the gift from the Guam District Court for payment of accommodations and meal expenses for one (1) Deputy Public Defender to participate in the Guam District Court Annual Conference, and authorize the Public Defender to select the Deputy Public Defender who will make the trip.

5. / SUBJECT: / PLANNING FOR A NEW RAMONA LIBRARY (DISTRICT: 2)
OVERVIEW:
On September 16, 2003 (5), the Board of Supervisors approved the purchase of 6.78acres in Ramona for a new community library. At the direction of the Board, grant applications were made under the California Library Bond Act (Proposition 14) for a replacement Ramona Library. On January 6, 2004 (3), appropriations were established in the Library Capital Outlay Fund for Capital Project 1000286, Ramona Library Construction, as part of the local match required by Proposition 14. The grant applications were unsuccessful.
Today’s proposed actions would authorize staff to prepare design-build documents and to return to the Board for authority to solicit design-build proposals for a new library. The Board is also requested to authorize staff to enter into negotiations for the acquisition of additional property to assemble a site that allows effective orientation of the library, consistent with the Ramona Intergenerational Community Campus visionary studies.
FISCAL IMPACT:
Funds in the amount of $409,087 are included in the Fiscal Year 2007-2008 Operational Plan for the Ramona Library, Capital Project 1000286. Of this amount $100,000 will be used in Fiscal Year 2007-2008 for the development of the design-build documents, appraisals, and other necessary planning activities. The funding source is General Fund. Staff will return to the Board to request authority to solicit design-build proposals and appropriation of funding for the project. The estimated cost of the project itself is $10.72 million, exclusive of the cost of the additional parcel. Funding for the Ramona Library design-build project and parcel acquisition have been identified from Fiscal Year 06-07 General Fund fund balance and donations from the Friends of the Ramona Library. Since it will be much larger than the current library, the new facility will require additional staff and incur higher operating costs, to be identified later in the planning process. Investments in technology and process reengineering efforts will result in staffing efficiencies systemwide to mitigate the effect of the larger branch.
RECOMMENDATION:
CHIEF ADMINISTRATIVE OFFICER
1.  Find in accordance with Section 15262 of the State of California Environmental Quality Act Guidelines (CEQA), that planning activities are exempt from CEQA in that they consist solely of planning and feasibility studies for possible future actions which currently have not been funded, do not have a legally binding effect on later activities and will not have a significant impact on the environment.
2.  Direct staff to undertake any necessary planning activities relating to the Ramona Library capital project and to return to the Board with appropriate action items.
3.  Authorize the Department of General Services to enter into negotiations for the acquisition of Assessor Parcel Number 28119107 (Zenovich).
4.  Authorize the Department of General Services to conduct appraisals and site due diligence studies as necessary to support the property acquisition.
