Cooling Tower and Evaporative Condenser Regulations

As we will be installing a new evaporative condenser on your <site reference> site, you are required to inform your local authority Environmental Health Departmentthat this new condenser will soon be operational. This will meet the requirements of The Notification of Cooling Towers and Evaporative Condensers Regulations 1992 and is the first step to ensuring compliance with the HSC Approved Code of Practice on the control of Legionella bacteria in water systems. The code calls for those who have control of the premises to do this so unfortunately we cannot do it on your behalf.

We recommend that you send a letter to the local authority and include details of the “notifiable device” which in the case of the new equipment we are supplying for yourselves is:

A web search including the name of your local authority and the term “notification of cooling towers” will usually locate a notification form you can complete and the address to send it to.

For your guidance please find enclosed a copy of the approved code of practice.

Emergency Drench Shower

The emergency drench shower and your hot and cold water system must also be treated and maintained to control Legionella bacteria in accordance with the HSC Approved Code of Practice on the control of Legionella bacteria in water systems and the shower manufacturers’ recommendations.

Emergency showers are a particular risk as they are seldom used, often installed so that the water in some of the piping can be stagnant, areat an ideal temperature for the legionella bacteria to grow and showers produce an aerosol that can be breathed in when in use or during maintenance.

DSEAR for Ammonia Plant Rooms

As your refrigeration plant room is designated as a hazardous area in case an ammonia leak occurs then it has to comply with the DSEAR (Dangerous Substances & Explosive Atmospheres Regulations, 2002) & EPS Regulations (The Equipment & Protective Systems for use in Potentially Explosive Atmospheres Regulations, 1996). This requires that you as the “Employer” have a suitable risk assessment for the risks arising from the use of ammonia. Refer to HSC Approved Codes of Practice L136 and L138.
