VILLAGE OF MANNVILLE
UTILITY BYLAW

ABYLAWOFTHEVILLAGEOFMANNVILLEINTHEPROVINCEOFALBERTATOESTABLISH THE TERMSAND CONDITIONSFORTHESUPPLY, MAINTENANCE AND CONSTRUCTION OFTHEWATER,SEWERANDGARBAGESERVICES.

WHEREAS, Sections 7 and 8 of the Municipal Government Act, Chapter M-26, R.S.A. 2000, give authorization to the Village; and

WHEREAS, Council has previously passed Bylaw 2012-777 to establish the regulations of the Village utilities;

WHEREAS, The Village provides water supply and distribution, sanitary sewage collection and disposal system, and a waste disposal service;

WHEREAS, Council deems it necessary to outline the roles and responsibilities of the consumer and authorized personnel;

NOW THEREFORE, the Council of the Village of Mannville enacts as follows:

  1. ThisBylawshall be knownasthe"UtilityBylaw".
  1. In this Bylaw, unless the context otherwise requires:

“Authorized Person/Personnel”: any person employed by the Village ofMannville.

“Back Flow”:thereversalofflowofanywater,wastewateroranyotherliquid,chemicalorsubstancebackinto the water supplysystem.

“CC Valve”: the device on a water service line used to interrupt or discontinue the supply of water.

“Consumer”:theownerofthe landsandpremises inwhichanyVillagewaterand/orsewerservicesare installed.

“CrossConnection”: anactualorpotentialconnectionfromtheVillage'swatersystemtoanysourceofpollutionorcontaminationthatcouldrendertheVillage'swaternon-potableorlethal.

“Cross Connection Control Device”:a device or method that preventsback flow.

  1. The Village shall:

3.1Supply theutilityservicesso farasthere issufficientcapacity,uponsuchterms, costsorcharges asestablishedbyCouncil, toanyconsumerwheretheproperty issituatedalongawatermainand sewermain.

3.2So far as is reasonably possible, endeavor to provide regular and uninterrupted operation ofthe utility services. However,breakstowatermains,sewermainsandotherfacilitiesare inherentto thenormaloperationofautilityandmayresult in interruptionstotheutilityservice.

3.3TheVillage ortheir agentsshallnotbeliableforanydamagesofanykindduetochangesinwaterpressure,theshuttingoffofwater,orbyreasonofthewatercontainingsediments, deposits or other foreignmatter.

3.4Doesnotguaranteethepressureofthewaterutilitynorthecontinuoussupplyofwater.

3.5Reservestherightatanytime,withoutnotice,tochangetheoperatingwaterpressureofthewater utility and to shut off the waterutility.

  1. Governing the use of water:

4.1Incaseofmakingrepairsorin constructionofnewworksor inconnectingorrepairingservice pipes,theVillageshallhavethe righttoshutoffthewaterfromanyconsumerwithoutnoticeand keep itoffaslongas it is necessary.

4.2However, theVillageshallendeavortoprovidenoticetocustomersofsuchinterruptionofservicesandshallseektominimizetheinconveniencetoconsumers.

  1. Each existing lot or parcel and each principal building or occupant, shall be provided with aseparatewater and sewer service wherefeasible.
  1. TheVillageofMannvilleowns, operatesandisresponsibleformaintenanceofallwatersystemcomponents onpublicproperty.
  1. NopersonexceptthoseauthorizedbytheVillageshallmakeanyconnectionwithanyofthepublicpipesormainsonpublicproperty.
  1. Noconsumer,withoutfirsthavingobtainedapplicableprovincialpermitsandaVillagedevelopment permit,willmakeconnectionwithany ofthepublicwater linesormains. Theconsumersoauthorized isfullyliableforanydamagecausedwhilemakingsuchconnectionandwillalsoprovideadequatesafety provisionsduringtheconnection.
  1. Allwaterservicelines,laiddownonprivateproperty,betweenthepropertylineandthemeter, willbeconstructed of CSA approved materialofequalqualitytoandcompatiblewith,theservicelinesinthestreet betweenthestreetmainandthepropertyline.
  1. Thepropertyownerowns,operatesand isresponsibleformaintenanceofwaterservice linesonprivate property. Allpropertyownersshallkeepandmaintainservicepiping inproperworking conditionsand freefrom leaks. Property owners are also responsible to ensure other utilities such as gas for heating purposes are utilized when the Village services are running, should the gas be turned off it is the responsibility of the property owner/tenant to contact the Village so the water can be turned off to prevent the lines from freezing and breaking.
  1. Allwaterusersrequiremetersandwatermetersealstobeinstalledontheirpremises, whichare owned, suppliedandmaintainedbytheVillage. Installationrequiresanopenareaofapproximately18” squareabovethemaincontrolvalveandthisareamustbe leftaccessible.Theownermustdosuch workentirelyathisorherowncostandtothespecificationrequiredbytheVillage.
  1. TheVillagewillreplaceanymeterthatstopsworkingduetonormalwearandtearatnocosttotheowner.
  1. Nopersonshalldisconnectameterordoanythingwhichmaypreventorimpedetheflowofwaterthroughameterortherecordingoftheflowofwaterthroughthemeter,orwhichmayaffecttheproperoperationofthewatermeter.
  1. Nopersonshallinterferewith, cutorremovethewiresealonameterorvalve,exceptinthecaseofanemergency.
  1. Intheeventapersonbreaksasealonavalve inordertoobtainasupplyofwaterforemergency purposes, thatpersonshallnotifytheVillagewithintwenty-four(24)hoursduring regularbusinesshours.
  1. Theownershallinstallacontrolvalve intheservicepipebeforethemetersetting.Themetersettingandcontrolvalveshallbepositionednearthepointwheretheprivateserviceenterstheowner'sbuilding.Theownershallmaintainthecontrolvalveinsoundworkingorder.
  1. Theowners, occupantsortenantsshallberesponsibleforprotectingthemeterfrominterferenceor injuryorfrostorany typeofdefacementandshallbeliableforanydamagethatmayoccurtothe meter. Intheeventthatameteris damaged,theownershallberesponsibleforallreplacementcosts.
  1. The owners, occupants or tenants shall allow access to the premises for the authorized personchargedwith:

18.1The installation,removal,inspection,repair,readingandotherwisedealingwiththewatermeterorwatermetersealforthecheckingofservicepiping, fixturesconnectedtoanddrawingwaterfromtheVillage'ssystem.

18.2IntheeventtheVillageinitiatesawatermeterchange-outproject,thepropertyownermustensurethatanappointmentis madetochangeouttheoldmeteringequipmentwiththenewmeteringequipment.Failuretocomplywithbookingsuchanappointmentcouldresultinutilityservicecancellation,reconnectionchargesandthefullcostofthemeterreplacementlaborcharges.

  1. TheVillageshallhavetherighttorestrictorrationtheamountofwaterusedduringperiodsofheavydemand,upon24hours’ notice,conditionspermitting, orinterrupttheservicefornecessarymaintenance, repairs or firefighting or any other possibleemergencies.
  1. WhenwaterrestrictionsaresetbytheVillagethroughadvertisingviausualcommunicationmethods, anyonefoundwateringwithanoutsidehose will receiveonewarningandthenexttimetheywillbe fined inanamountasset in Masters Rate Bylaw. If thefine isnotpaidwithin21days,thefinewillbeaddedto theirutilitybill.
  1. Exceptashereinafterprovided,nopersonsotherthanthoseauthorizedbytheVillagewillopenorcloseoroperateorinterferewith anyvalve,hydrantorfireplugordrawwaterthere from.

21.1In the case of new construction or reconstructed premises, proof of a plumbing permit mayberequired before the water service valve will be turnedon.

  1. Noperson will inanymannerobstructthefreeaccesstoanyhydrantorvalve.
  1. Nopersonshall interferewith,damageormake inaccessibleanyCC valveduetotheconstructionof sidewalks,pathways,drivewaysoranysimilarconstruction. Theownerwillberequiredtopayallcosts, inadditiontothepenalties in Master RatesBylaw,involved inrepairoforchangestoaCC valvedueto inaccessibilitytoordamagetotheCC valvebytheowner.
  1. Nopersonshallconnect,causetobeconnected, orallowtoremainconnectedtothewatersystemany piping,fixture,fitting, containerorappliance,in a mannerwhich,underanycircumstances,mayallow water,wastewateroranyother liquid, chemicalorsubstancetoenterthewatersystem.
  1. Governing the use of the Sanitary Sewer:

25.1TheVillageofMannville,asownerandoperatorofasanitarysewagesystem,recognizesaresponsibilitytomaintain that piped system. This responsibility extends to all trunk sanitary sewers, sanitary sewer mainsandsanitary sewer services on public property, exceptindividuals plugging that portion of the sanitarysewerservice pipe on public property are responsible for removing that obstruction.

25.2TheVillageof Mannvilleowns,operatesandisresponsibleformaintainingthesanitarysewersystemonpublicproperty,includingthesanitarysewerservicepipefromthesewermainstotheboundaryoftheprivateproperty which is then the responsibility of the property owner.

25.3All properties that generate sewage and waste water shall be connected to the Village's sewersystem.

  1. No person,withoutfirsthavingobtainedapplicableprovincialpermitsaswellaspermissionfromtheVillage through a development permit, or signed servicing agreement will make connection with any ofthe public sewer lines or mains. The person so authorized will be fully liable for any damage causedwhilemakingsuchconnectionandwillalsoprovideadequatesafetyprovisionsduringtheconnection.
  1. Allsewerservicelines,laid downonprivateproperty,betweenthepropertylineandthebuildingsbeing serviced, willbesoconstructedofC.S.A.approvedmaterialofequalqualitytothesewerservice line inthestreetbetweenthestreetmainandthepropertyline. ConnectionmustbeaspercurrentC.S.A. standards.
  1. Authorized persons shall have the right at all reasonable times to enter houses or other placeswhichhavebeenconnectedwiththeVillagesewersystem,thathavebeengivenhim/hertoascertainwhetherornotanyimpropermaterialorliquidisbeingdischargedintothesewers,andhe/sheshallhavethepowertostoporpreventfromdischargingintosewersystemwhichareliabletoinjurethesewersorobstructtheflowofsewage.
  1. No substance may be discharged into the sewer system that is toxic, hazardous orpoisonous.
  1. The owner of any property, building or facility connected to the Village’s sanitarysewersystemsowns,operatesandhastheresponsibilitytomaintain thesanitarysewerpipeonprivateproperty and any other maintenance costs or expenses (snaking/camera).
  1. The ownerofanypropertyconnectedtotheVillage’ssanitarysewersystemisresponsibleforunplugginganyblockage inthesanitarysewerservice pipeonbothprivateandpublicproperty, fromthebuildingtothesewermainconnectionlocation,both withrespecttoengagingasewer cleaningcontractortounplugthepipeandbearingthecostofsuchservice. If themainsewer lineis runningfree, thenthepluggedsewerisdeemedtobetheresponsibilityofthepropertyowner. The unpluggingofablockage in asanitarysewerservicepipecausedbytreerootsfrom tree locatedon privateproperty isconsideredtobe theresponsibilityofthepropertyowner.
  1. In the eventthatablockageoccursinthatportionofthesanitarysewerpipeonpublicpropertywhichiscausedbyastructuraldefect inthepipe,theVillagewillrepairthesewerpipeandreimbursethepropertyowneroroccupantforthecostsofunpluggingthatpipe,if suchcostscanbesupported by a paidinvoice.
  1. Thatonallnewconstructionasewerback-flowpreventiondevicemustbeinstalled inallbuilding sewer lines.
  1. Thatonallnewconstruction, agrease, oil andsandseparatorsmustbeprovidedonprivatepropertyforallcommercialgarages,servicestationsandcarwashes.
  1. TheVillagemayuponreasonablenoticeandatreasonable timesenter buildingsorotherplaceswhich havebeenconnectedwiththe Villagessewersandfacilitiestoascertainwhetherornotany improper materialorliquidisbeing discharged insewersandtheVillageshallhavetherighttouseanytestor othermeansnecessarytodeterminecompliancewiththis Bylawandtostoporpreventthedischarge ofanysubstances thatareliableto injurethesewerorobstructtheflowofsewage.
  1. Onlyauthorizedpersonalshallraise,turn,liftorremoveanymanholecover,ventilatororanyotheritemof the Village's sanitary sewersystem.
  1. Theownerofanybuildingshalldischargetherainfallorsnowmeltfromroofsbymeansofroofdrainsto the ground surface at the exterior of a building in such areas where public storm sewerconnectionsare not provided. No person will discharge or cause to be discharged any storm water or naturalwater to any sanitarysewer.
  1. All new construction, at the owner's own expense, must have the building weeping tile or any other foundationdraintoasumpinstalledwithinthebuilding; thesumpshalldischargebypumpingtothe groundsurfaceatthebuildingexterior, aspertherequirementsoftheAlbertaBuildingCode.No personshallconnectaweepingtileorotherfoundationdraintoasanitarysewer.
  1. Guidelines with Garbage:

39.1TheVillageprovidesforresidentialgarbagepickupthroughanautomatedgarbagepickupwith quick carts/ roll out carts, which are the property of the Village, with each cart registered toeachaddress.

39.2Quickcart/rolloutcartreplacementcostsaretheresponsibilityofthepropertyownerifthey aredamagedor lost due tonegligenceand/orabuse.

39.3Where necessary or advisable, Council isherebyauthorizedtomakecertainadjustments regardingtheplacingofquickcarts/rolloutcarts, etc.

39.4GarbageofanysortisnotallowedtoaccumulateonanypremiseswithintheVillageandshallbedisposedofasnottocreateanuisance.

40.Termination of Village Utilities:
40.1Anownerwhohasbeensuppliedwithserviceandwhodesiresthediscontinuanceoftheuse, mustgivetheVillagenoticeofdiscontinuanceandprovide; thenameofthepersonresponsibleforfurtheruse,otherwisetheratepreviouslychargedwillcontinueuntilsuch noticeisgivenorthewaterturnedoff.
40.2A final meter reading recorded on the last day of inhabitation orpossession.
40.3Thefinalestimatedbillmaybeaddedtothetaxaccounttoensurepaymentwhenthepremiseistransferringownership.
40.4Whenthepremisestowhichutilityservice isprovidedbecomesvacantandnorequestforservicehas beenmade,theVillagemayterminatetheaccountand,inlieuofdisconnectingtheservice,openanew utilityaccountinthenameofthenewpropertyowner. Nothingshallpreventthenewproperty ownerfromrequestingthattheVillagedisconnectsuchutilityserviceprovidedallservicecharges,prescribedhereinarepaid.
40.5The Village may discontinue the supply of all utility services for any of the followingreasons:
40.5.1Non-payment of any utilityaccounts;
40.5.2Failureby,orrefusalof,acustomertocomplywith anyprovisionsofthisbylaw;
40.5.3Failure by, or refusal of, a customer to comply with any provisions of any Provincial Acts,theBuilding Code or any regulationsthereunder;
40.5.4Attheowner'srequesttohaveservicesdiscontinued;
40.5.5Repair;
40.5.6Lack of watersupply;
40.5.7Defectivepiping;
40.5.8Failure to comply with waterrationing;
40.5.9Inanyothercaseprovidedfor inthisbylaw.

41.OffensesandPenalties:

41.1Anyrates, costsorcharges inarrearsforwaterservicesuppliedbytheVillagetoanyproperty,maybeaddedtothetaxesassessedagainsttherealpropertytowhichthewaterorotherserviceshavebeen supplied, andmaybecollected inanyofthewaysprovidedbythecollectionoftaxes,includingtax recovery.

41.2AnypersonviolatinganyprovisionofthisbylawmaybeservedbytheVillagewithwrittennoticestatingthenatureoftheviolationandrequiringthesatisfactorycorrectionwithin48hours,or such additional time as determined by Administration. Such person shall, within thetime stated in such notice, permanently cease allviolations.

  1. Anypersonwhofailstocomplyandaccordancewithanynoticegiventohim/herunderthis bylaw;shallbeguiltyofanoffenceanduponsummaryconvictionshallbe liabletoapenaltyofnot lessthan$200andnotmorethan$10,000,pluscourtcosts, toatermof imprisonmentnotexceeding6months.
  1. General:

43.1In caseofanydisputeastotheproperchargetowhichanypropertyissubjectbyreasonoftheprovisions herein contained, the matter shall be referred to the Chief Administrative Officer andwherethe dispute is not then settled to the satisfaction of a property owner, the owner may refer the matterto Village Council. Final appeal may then be made in the manner provided for the Arbitration Actofthe Province ofAlberta.

  1. Bylaw 2012-777 and any other subsequent amendments, are hereby rescinded, aswellasanypreviouslypassedmotionsthat maybe inconflictwiththisBylaw.
  1. ShouldanyprovisionofthisBylawbedeterminedtobeinvalid,then such invalid provision shall be severed and the remaining Bylaw shall be maintained.

That this bylaw shall take effect on the date of the third and final reading.
