1DEFINITIONS

In these rules unless the context otherwise requires:

  1. “Bowls Australia” means Bowls Australia Incorporated.
  2. “Act” means the Associations Incorporation Act 1984
  3. “Association” means Illawarra Zone 16 Bowls Association
  4. “Association Match” means any match arranged by the Association in accordance with these Rules
  5. “Club” means a properly constituted bowling club or provisional club as defined in rule 3
  6. “Delegates” means a maximum of two representatives of an affiliated or provisionally affiliated club as set forth in rule 22 of this constitution
  7. “Executive Committee” means the President, Zone Representative, Vice Presidents,(3) Treasurer, Secretary, Registrar/Assistant Secretary and Match Committee Chairman.
  8. “Management Committee” means a Committee comprising the Executive Committee, Delegates – Life Members
  9. “Members” means a male person who is registered and financial with the Zone 16 Bowls Assoc and the RNSWBA
  10. “RNSWBA” means Royal New South Wales Bowling Association Inc
  11. “Life Member” means a member who may, in consideration of long or meritorious service, or for any other reason, be granted Life Membership of the Association by the Management Committee.

l“Proxy” means a member appointed to act for a Delegate.

m.“Provisional Club” means a properly constituted Club of 16 members contemplating the construction of a green which conforms with that required of a Club as defined in rule 3.

n.“Patrons” means a person or persons, appointed as a patron, by the Management Committee on the recommendation of the Executive Committee.

o.“Secretary” means the Secretary or acting Secretary for the time being of the Association and who shall be the Public Officer of the Association.

p.“Special Resolution” in relation to the association means a resolution passed by a majority which comprises not less than three quarters of such members of the Management Committee as being entitled under this constitution to do so, vote in person or by proxy at a Management Committee meeting.

q.In this constitution words in the singular include the plural and vice versa.

2.ASSOCIATION NAME AND COMPOSITION

The Name of the Association is the Illawarra Zone 16 Bowls Association Inc (Formerly Illawarra District Bowls Association inc.)

The Illawarra Zone 16 Bowls Association Inc shall consist of the following affiliated Clubs

Berkeley Sports and Social Bowling Club

Corrimal Bowling Club

Dapto Bowling Club Ltd

Dapto Citizens Bowling Club

Fairy Meadow Bowling Club

3.INTERPRETATION

In these rules unless the context or subject matter indicates or requires:

Association means The Illawarra Zone 16 Bowls Association Inc.

Association match means any match arranged in accordance with these rules.

Club means a properly constituted body of 16 or more full members whose annual subscription is not less than $2 per member, and having a green for play of not less than four(4) rinks to be laid down in conformity with the Laws Of The Game of Bowls Australia Inc.

Provisional Club means a properly constituted body of 16 or more full members, whose annual subscription is not less than $2 per member, and having acquired the necessary site, contemplates the construction of a green of no less than 4 rinks to be laid in conformity with The Laws of The Game Of Bowls Australia Inc.

Management Committee means Officers, delegates of affiliated clubs and Life Members of the Association as constituted by these Rules.

Full Members means a member who pays the full annual subscription of his club, which shall not be less than $2 or a Life Member of his club.

Junior Member means a member who is under the age of 18 years and pays less than the full annual subscription of a club, and is eligible to play in Association matches.

4.OBJECTS

The Object of the Association shall be:

(a)To affiliate with the Royal New South Wales Bowling Association Inc as a Zone Association

(b)To promote, advance and control the game of bowls.

(c)To promote the welfare of all clubs associated in Zone 16

5.APPLICATION FOR AFFILIATION

Any club applying for affiliation shall support its application by a copy of its rules and proof that it possesses the necessary qualifications as set forth in these rules.

Such proof shall be furnished whenever required by the association.

6.QUALIFICATION FOR AFFILIATION

Every club, of which at least 16 members shall have paid the full subscription for the current year shall be entitled to apply for affiliation with the association and, if admitted shall be give representation on the management committee in accordance with these rules.

Provided that on, and after the first day of July, one thousand nine hundred and forty-seven, no club shall be permitted to affiliate, or retain its affiliation with the association, if its rules permit members to share in the profits of the club.

7.ANNUAL SUBSCRIPTIONS

Every affiliated club must pay to the association an annual capitation fee for each of its full members, including Life Members and Junior members. Such fee enables them to compete in association competitions. Such capitation fee shall be determined at a management committee meeting held prior to the Annual General Meeting.

The annual subscriptions shall be due on the first day of July of each year and must be paid to the association within thirty (30) days. Such payment shall make the club financial until the following annual general meeting.

8.LIFE MEMBERSHIP

The association, at the annual general meeting, may appoint life members, provided that the person, or persons nominated shall have over a minimum period of ten (10) years, rendered meritorious service and, provided that no member shall be granted life membership unless nomination is made by two(2) officers or delegates in writing twenty eights(28) days prior to the date of the annual general meeting and subsequent adoption of the nomination by not less than 75 percent of those present and entitled to vote.

The number of life members of the association shall not at any time exceed six (6).

9.MEMBERS LIABILITIES

The liability of a member of the association is to contribute towards the payment of the debts and liabilities of the association or the cost, charges and expenses of the winding up of the association and is limited to the amount, if any, unpaid by the member in respect of membership of the association.

10DISCIPLINING OF MEMBERS

If any member shall willfully refuse or neglect to comply with the provisions of the rulesof the Association or shall be guilty of any conduct of which in the opinion of the Executive Committee is unbecoming of a member or prejudicial to the interest of the Association the Executive Committee shall have power to reprimand and fine and suspend and expel such member from the Association. Provided that at least seven(7) days before the meeting of the Executive Committee at which a resolution to reprimand and/or fine and/or suspend and/or expel such member or any combination thereof is put the member shall have had notice in writing of such meeting and of what is alleged against him and that he shall at such meeting and before the passing of such resolution have had an opportunity of giving orally or in writing any explanation or defense he may think fit and provide further that no member shall be expelled from the association unless the resolution of his expulsion is passed by a majority of those committee members present.

11.RIGHT OF APPEAL OF DISCIPLINED MEMBER

(1)A member may appeal to the association at a general meeting against a resolution of the executive committee which is passed under rule 10, within 7 days after notice of the resolution is served on the member, by lodging with the secretary a notice to that effect.

(2)Upon receipt of a notice from a member under clause (1) the secretary shall notify the committee which shall convene a general meeting of the association to be held within 21 days after the date on which the secretary received the notice.

(3)At a general meeting of the association convened under clause (2):-

(a)no business other than the question of the appeal shall be transacted;

(b)the committee and the member shall be given the opportunity to state their respective cases orally or in writing, or both; and

(c)the members present shall vote on the question of whether the resolution should be confirmed, revoked or varied.

(d)Voting shall be conducted on a show of hands unless the meeting resolved by ordinary majority a secret ballot. **Note a member has the right of appeal to the RNSWBA if still not satisfied.

12.RESOLUTION OF INTERNAL DISPUTES

Disputes between members in their capacity as members of the association shall be referred to the committee of the association for resolution.

Disputes between members of the association and the association shall be referred to the Royal New South Wales Bowling Association for determination.

13.MANAGEMENT

The management of the association shall be vested in a committee consisting of officers, life members and delegates.

The officers shall be the President, Zone Representative to the Board of management of the Royal New South Wales Bowling Association Inc, three (3) Vice Presidents, Treasurer, Secretary, Registrar/Assistant Secretary, Publicity Officer and Chairmen of the sub committees.

These officers shall be elected at the Annual General Meeting of the association and shall hold office until their successors have been elected.

Presidential candidates shall hold the office of President for an indeterminate period.

At all meetings of the management committee, the officers, life members and delegates shall be entitled to vote.

14.OFFICERS AND THEIR DUTIES

Refer to Zone 16 by-laws for duties

15.MEETING OF THE MANAGEMENT AND EXECUTIVE COMMITTEE

(a)The management committee shall meet monthly on the 3rd Wednesday or on such date, time and place to be decided upon by the Management Committee.

(b)The executive committee shall meet on the Wednesday prior to the management meeting or when summoned by the president or the secretary, or by written request signed by at least three (3) of its members.

16.NOTICE OF MEETINGS OF THE MANAGEMENT COMMITTEE

Notice in writing of every meeting of the management committee and the nature of the business to be transacted, shall be delivered to each officer, life member and affiliated club at least seven (7) days before the date of an ordinary meeting and at least three (3) days before the date of a special meeting.

Notice of motion shall be in the hands of the secretary fourteen (14) days before the date of the special meeting.

17.QUORUM OF MANAGEMENT AND EXECUTIVE COMMITTEE MEETINGS

At all meetings of the management committee, twenty (20) officers, life members and delegates and at all meetings of the Executive committee four (4) members shall form a quorum.

Should a quorum not be present within thirty (30) minutes of the appointed time, the meeting shall lapse, or may be adjourned to such time, place and date as may be determined by those present.

18.STANDING ORDERS

(a)Movers of motions are limited to ten (10) minutes, and all other speakers to the motion (including the right of reply) to five (5) minutes, provided that such time limits may be extended by the chairman, with the consent of the meeting.

(b)When a motion, or amendment has been moved and seconded, no further support to such motion shall be heard until someone shall have spoken in opposition to such motion. After a speech in opposition has been made, speeches in support and opposition must follow in rotation, except with the consent of the meeting.

(c)A member shall be entitled to speak only once to each question, but with the permission of the chairman, may be treated as a new question. The mover only of any original motion has the right of reply.

(d)No motion to dissent from the chairman’s ruling, or decision shall be permitted unless made before any other business, or speech, has intervened and no debate shall be allowed, except by the mover, who shall be limited to five (5) minutes, and the chairman.

(e)It shall not be permitted to withdraw any motion that has been put from the chair, except with the consent of the meeting, one dissenter being sufficient objection.

(f)A speaker shall not be interrupted, except on a point of order.

(g)A notice of motion to alter, or rescind a resolution, and a notice of motion which has the same effect as a motion that has been negated by the association, shall not be in order unless it has been signed by ten (10) members, provided that this shall not apply where three (3) months have elapsed since the motion was passed, or negated.

(h)Where a motion to alter or rescind has been negated, no similar motion shall be brought forward within three (3) months. The effect of the provision shall not be changed by substituting any motion differently worded, but in principle the same.

(i)Discussion shall not be permitted upon any motion for adjournment of a meeting of the association. Upon the question being put on any such motion, the same is negated the subject than under consideration, or next on the business paper, shall be discussed and it shall not be allowable for any member to again move for an adjournment of a meeting until thirty (30) minutes has elapsed.

The Proceedings of any committee appointed by the association shall be guided by these standing orders.

(j)Suspension of standing orders for this purpose of speaking on a matter of vital importance may occur at any stage of the meeting.

(k)Where a speaker desires to quote from a letter, or document, a copy of such letter or document shall be tabled by him by handing it to the secretary and becomes part of the records of the association.

(l)The Chairperson has Power to direct any officer, or delegate, breaching these standing orders to leave the meeting.

19.CONDUCT OF DELEGATES AND REGISTERED BOWLERS

Should the conduct of a delegate at a Management Committee meeting be such that he is asked to leave the meeting by the President/Chairman, the following procedure shall apply:-

iThe delegate(s) is to leave the premises on the night of the meeting.

iiA letter is to be sent by the Secretary of the Association to the Club or Clubs concerned regarding the delegate(s) conduct at the meeting.

iiiThe Club or Clubs concerned are to inform the Association of any action taken against the delegate(s) in regards to this matter (i.e. warning, replacement, suspension or no action).

ivShould any member by his action be deemed to bring the game into disrepute, the Zone 16 Executive Committee may take action against the member in regards to the matter and may warn, suspend or expel such member.

vThe member shall be given at least 14 days notice to appear before the Committee to answer the charge.

viThe notice shall set out the reason for the citation and the possible penalty that the committee may impose if the charge is proven.

viiPenalty – suspension as per RNSWBA By-Law 22 or a monetary penalty up to a maximum $5000

viiiPenalties to be determined by the Zone Executive Committee for each individual case and issue.

viiiiThe RNSWBA should be advised in writing of any action within fourteen days.

20.ABSENCE AND LEAVE OF ABSENCE

(a)Upon being satisfied with the bona fides of the case and provided no undue inconvenience may ensue, the Management Committee may grant leave of absence to members of the Executive Committee and members of the Sub-Committee.

(b)The position of any officer of the association who absents himself from three (3) consecutive meetings of the Management Committee without having obtained permission, shall be declared vacant by the management committee.

(c)The position of any member of a sub-committee who absents himself from three (3) consecutive meetings of that sub-committee, without having obtained leave of absence from the chairman, shall automatically become vacant.

21.VACANCIES

The management committee shall fill the vacancies occurring amongst its officer, or in any sub-committee, or in the position of auditor, with exception of the president, who shall be elected at a special meeting of the association. No such vacancy shall be filled until fourteen (14) days previous notice has been given to those entitled to attend and vote at the meeting at which it is intended to fill the vacancy.

22.DELEGATES

Every fully affiliated Club shall be entitled to send two (2) delegates to every Management Committee meeting of the Association . Each club is entitled to two(2) votes. Observers are allowed to attend, but cannot participate in the meetings procedures.
