MONTHLY TOWN BOARD MEETING MINUTES

September 27, 2016

Chairman Miller called the meeting to order at 7:30 PM. The following Board members were in attendance: Chairman Miller, Supervisors Mueller and Averbeck, Clerk and Treasurer. Minutes from the August meeting were read aloud and a motion was made by Mueller / Averbeck to approve them as read. Motion carried.

A Bartender License Application from Carolyn Hass, for Jim’s County Line, was reviewed. Completion of the responsible serving course was verified. A motion was made by Averbeck / Mueller to approve the application and issue the license. Motion carried 3-0.

A Business Permit application from Josh Duel, for Duel Concrete and Construction, was reviewed. No fee was paid with this submission, so he still owes the $10 permit fee, which Clerk Linger agreed to contact him about. Discussion followed and a motion was made by Averbeck / Mueller to approve the permit, conditioned upon receiving the $10 permit fee required. Motion carried 3-0.

The sidewalk project was reviewed and Averbeck suggested that Clerk Linger follow up with the County on the $1500 proposal to do the engineering, which was approved at the August Town Board meeting. There is nothing further to report at this time.

Several residents of Townline Circle were present at the meeting to discuss a property there that is a mess with trash, weeds, unkept lawn and pets that wander. Clerk Linger reported that a letter had been sent to the owner of NW7345 Townline Circle, addressing the Nuisance Ordinance violations. They were given a deadline of October 20th to get things cleaned up. Discussion followed and residents also asked the Board to consider placing speed bumps or signs on the circle, to slow down traffic.

The Board addressed an issue with road damage and excessive mud that occurred recently. Ruedinger, Voss and others were present to discuss this matter with the Board. The Board expressed concern over the lack of communication and concern shown over these damages. There also seemed to be a lack of concern over liability issues associated with excessive mud on the roads. The Board also feels that there are several alternatives to the way things were done and handled. Chairman Miller suggested that the parties involved, owners and operators, meet and sit down to talk things thru, possibly at the location to see the extent of the damages, now that the mud has washed off a bit.

Dennis Mueller expressed repeatedly that the Board has always tried to prevent controlling too much and is not trying to make life difficult, because he, himself, and Bill Averbeck are both farmers and know how conditions have been this year, but there needs to be some communication and respect for the position of the Town Board. Mike Pionke reported that there is also a problem this year with farmers pushing the mud off into the ditches, creating piles that will eventually cause problems with plowing and mowing. Ruedinger spoke on the condition of the roads in that area, with the blacktop at only about ½ inch thick where they pull out of the field. The condition of the road surface also made it difficult to determine what to leave and what to push off when cleaning up the mud. The reason they went down Marsh Road when they were asked not to, was because of a near accident on County I the day before. Bill Averbeck spoke on the condition of the road and that it’s main use seems to be ag related and access to the fields. The only homes along there are located on the east end. The matter of repairs and future use needs to be talked about and remedied. The matter of closing roads, alternative methods for farmers, and what the protocol should be were all discussed and the Board again stressed that they are not looking to penalize anyone, but trying to come up with a solution to a continuing problem. It was agreed that the Town Board would meet with Voss and Ruedinger at 10:00 AM on Thursday, September 29th, at the corner of Church Road and Marsh Road, to review the situation and discuss it further.

A draft of the Town’s amended Road Access Control Ordinance was reviewed. It can be further reviewed by the Board over the next month and placed on the October agenda for adoption.

Plan Commission report – Carlton Kastorff reported on a pending concept plan application and scheduling a meeting in the near future to address it.

Highway report – Mike Pionke reported that he is almost done with the second round of mowing and getting ready to start the third round. Him and Mike Rabe finished filling in culverts with cold mix.

Fire Department report – one mutual aid call, but otherwise quiet.

Monthly bills were approved and paid.
