TO AMEND SECTION 59-63-510 OF THE 1976 CODE, RELATING TO THE AUTHORIZATION BY COUNTY BOARDS OF EDUCATION TO ORDER THE TRANSFER OF A STUDENT FROM ONE SCHOOL DISTRICT TO ANOTHER SCHOOL DISTRICT WITHIN THE COUNTY, TO REMOVE THE REQUIREMENT THAT EACH PUPIL TRANSFERRED BY ORDER OF THE COUNTY BOARD OF EDUCATION MUST PAY TUITION IN ADVANCE SEMIANNUALLY; TO AMEND SECTION 59-63-500, RELATING TO THE TRANSFER OF A STUDENT WITHOUT THE CONSENT OF THE SCHOOL DISTRICT OF RESIDENCE, TO CLARIFY THAT A SCHOOL DISTRICT THAT KNOWINGLY ENROLLS A PUPIL WHOSE TRANSFER HAS NOT BEEN CONSENTED TO BY THE PUPIL’S SCHOOL DISTRICT OF RESIDENCE IS NOT GUILTY OF A MISDEMEANOR IF THE TRANSFER WAS APPROVED PURSUANT TO SECTION 59-63-510.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION1.Section 59-63-510 of the 1976 Code is amended to read:

“Section 59-63-510.When a transfer of pupils from one district to another is sought and the trustees of the latter district unreasonably or capriciously withhold their consent, the county board of education of the county in which the districts are located shall have the right, after hearing, to make the transfer., but only on condition that each pupil so transferred pay semiannually, in advance, if financially able to do so in the opinion of the board of trustees, as tuition, an amount not less than the per capita expenditure from the special tax for operating the school to which the pupil is to be transferred, together with all other charges paid by patrons of such district for any special course or courses.”

SECTION2.Section 59-63-500 of the 1976 Code is amended to read:

“Section 59-63-500.The trustees of any school district who knowingly permit the enrollment of pupils who have not been transferred with the consent of the trustees of the district wherein such pupils reside, unless the transfer was approved pursuant to Section 59-63-510, shall be guilty of a misdemeanor and, upon conviction, shall pay a fine not exceeding twentyfive dollars or be imprisoned not more than thirty days.”

SECTION3.This act takes effect upon approval by the Governor.
