TO AMEND SECTION 1237220, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROPERTY THAT IS EXEMPT FROM AD VALOREM TAXATION, SO AS TO PROVIDE THAT CERTAIN PRIVATE PASSENGER VEHICLES OWNED OR LEASED BY PURPLE HEART RECIPIENTS ARE EXEMPT FROM AD VALOREM TAXES; AND TO AMEND SECTION 5633310, AS AMENDED, RELATING TO THE ISSUANCE OF SPECIAL LICENSE PLATES FOR PURPLE HEART RECIPIENTS, SO AS TO ELIMINATE THE BIENNIAL FEE FOR THIS LICENSE PLATE, AND TO PROVIDE THAT THE SURVIVING SPOUSE OF A PURPLE HEART RECIPIENT IS ELIGIBLE TO OBTAIN THIS LICENSE PLATE AS LONG AS THE SURVIVING SPOUSE DOES NOT REMARRY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION1.Section 1237220(B)(3) of the 1976 Code is amended to read:

“(3)(a)Two private passenger vehicles owned or leased by anya disabled veteran designated by the veteran for which special license tagsplates have been issued by the Department of Public Safety under the provisions ofMotor Vehicles pursuant to Sections 5631110 to 5631130 or, in lieu of the license, if the veteran has a certificate signed by the county service officer or the Veterans Administration of the total and permanent disability which must be filed with the Department of Public SafetyMotor Vehicles.

(b)Two private passenger vehicles owned or leased by a Purple Heart recipient designated by the recipient for which special license plates have been issued by the Department of Motor Vehicles pursuant to Sections 5633310 and 5633320.”

SECTION2.Section 5633310 of the 1976 Code, as last amended by Act 17 of 2001, is further amended to read:

“Section 5633310.(A)The department may issue a permanent special motor vehicle license plate to a recipient of the Purple Heart for use on a private passenger motor vehicle without the recipient accompanying the application for this license plate with the usual fee for registration and license of a vehicle of similar type. The biennial fee for the special license plate is the same as the fee provided in Article 5, Chapter 3 of this title, and Not more than two license plates may be issued to a person. The application for a special plate must include proof the applicant is a recipient of the Purple Heart.

(B)A person who is issued a license plate pursuant to this section is not required to reapply as long as he owns or leases the vehicle for which the plate is issued. A surviving spouse of the person who is eligible to obtain this license plate is eligible to also obtain this license plate as long as the surviving spouse does not remarry.”

SECTION3.This act takes effect upon approval by the Governor.
